Commercial Law Curriculum for the Sixth Commercial Grade (1970 - 1971)
1- In the first half of the academic year 70 / 71, students were given an introduction to commercial law and its relationship
with other branches of law, particularly civil law, and the sources for adjudicating commercial lawsuits in full.
Furthermore, the extent of the applicability of commercial law rules, the subjective and objective doctrines, and the position of the Iraqi legislator
regarding them.
2- Chapter One - Commercial acts and the most important criteria for distinguishing civil acts from commercial ones, such as speculation
and circulation, and the position of the Iraqi legislator regarding these criteria.
Types of Commercial Acts
a - Original commercial acts. b - Accessory commercial acts. c - Mixed acts.
The importance of distinguishing between commercial and civil acts in terms of jurisdiction, evidence, interest rates,
joint liability, formal notification, and the statute of limitations for the lawsuit.
3- Chapter Two - Traders: The importance of distinguishing between a trader and a non-trader and the conditions that must be met
to acquire the status of a trader. Such as legal capacity, the exceptions related to it, and the restrictions that
limit the freedom to practice commerce, the person's engagement in commercial acts in their own name, and taking up commercial
acts as a regular profession.
Likewise, the duties of traders in terms of keeping commercial books, adopting a trade name, and registering in
the commercial register, and unfair competition.
Up to this point was the mid-year examination.
In the second semester of the year... we began the subject of Part Two, which is commercial companies, and students were given
a comprehensive introduction to the subject, then the definition of companies, their types, and the rules governing them in terms of
the contract and its substantive and formal requirements, and then the legal personality.
The characteristics of the company contract in terms of each partner providing a share in the capital, the intent to profit, and participation in
profits and losses, and the intent to associate.
Then the types of companies: partnership companies and capital companies... and now we have finished partnership companies ⟦and started⟧
we started with capital companies and we will finish them next week.
As for the remainder of the curriculum from 28 / 3 / 1971 until the end of the academic year 70 / 1971:
1- Checks and policies (commercial papers), mandatory conditions, and the penalty resulting from their absence,
payment of the check, the presentation period, refusal of payment, the crossed check, and the statute of limitations for the
commercial lawsuit.
2- Bankruptcy: introduction, its types, its conditions, its effects on the debtor trader and on their property, commercial rehabilitation.
