Commercial Law Curriculum for the Sixth Commercial Grade (1970 - 1971)
1- In the first half of the academic year 70 / 71, students were given an introduction to commercial law and its relationship
with other branches of law, particularly civil law, and the sources for adjudicating commercial lawsuits in full.
Furthermore, the extent of the applicability of commercial law rules, the subjective and objective doctrines, and the position of the Iraqi legislator
regarding them.
2- Chapter One - Commercial acts and the most important criteria for distinguishing civil acts from commercial ones, such as speculation
and circulation, and the position of the Iraqi legislator regarding these criteria.
Types of Commercial Acts
a - Original commercial acts. b - Accessory commercial acts. c - Mixed acts.
The importance of distinguishing between commercial and civil acts in terms of jurisdiction, evidence, interest rates,
joint liability, formal notification, and the statute of limitations for the lawsuit.
3- Chapter Two - Traders: The importance of distinguishing between a trader and a non-trader and the conditions that must be met
to acquire the status of a trader. Such as legal capacity, the exceptions related to it, and the restrictions that
limit the freedom to practice commerce, the person's engagement in commercial acts in their own name, and taking up commercial
acts as a regular profession.
Likewise, the duties of traders in terms of keeping commercial books, adopting a trade name, and registering in
