Reason for Issuing the Deed
According to Tapu deed numbered ⟦illegible⟧ and dated January 929, stating that the mentioned shop
was private property under the ownership and disposal of Saleh bin Sassoon Samuel Daoud, and the aforementioned has removed
the mentioned shop from his private ownership and endowed it as a valid, legal, and perpetual endowment
and an explicit, eternal sequestration, stipulating that the trustee of the mentioned endowment shall manage it
by leasing it at a fair market rate, and from its proceeds, after its maintenance and restoration, the surplus yield shall be given
to the management body of Meir Elias Hospital located in Bab al-Mu'azzam, to be spent on
the treatment and needs of the patients of the mentioned hospital. If the mentioned hospital is abolished or suspended
according to the aforementioned, or if the management body does not operate, the surplus yield shall be given to the head of
the Council of the Jewish Community to be spent on the poor of the Jewish Community in Baghdad, and if
the Community Council does not exist, the surplus yield shall be spent and distributed to the poor of the mentioned community. The trusteeship
of the mentioned endowment shall be assigned specifically to the visionary in the center of Baghdad, Barham Mizrahi Hillel,
and upon his death or departure, the trusteeship shall revert to the person who is the Hakham Bashi in Baghdad,
whether he is a deputy or an agent. He has appointed and designated by his hand Ezra as an overseer over the mentioned trustee,
and if his son Ezra is absent, or upon his death, the oversight shall pass to the most upright and just
of the children of the children of the aforementioned Ezra, generation after generation, and the children of the children of his children, and if they become extinct,
the oversight shall revert to the most famous of the mentioned jurists, and the trusteeship and oversight may be combined in one
person. The validity and necessity of the mentioned endowment, in its specific and general terms, have been ruled upon according to an endowment deed
issued by the Sharia Court of Baghdad dated Rabi' al-Awwal 944 and numbered 84,
and certified by the Iraqi Ministry of Justice on 22 March 924, and by the court's world and others
dated 11 June 925, the registration of the mentioned shop as an endowment was carried out.
