Taken in the fortieth session on 26/6/1949

6 - A discussion took place regarding the sale of the Council's share of the property located in
Samarra, sequence 649 (Eastern Quarter), which was used as a synagogue (Torah)
for the members of the community in Samarra. In view of the departure of all community members from Samarra, the
Council deemed it appropriate to sell its shares of the mentioned property at the offered price, i.e., 60/-
dinars (sixty dinars). Accordingly, it was decided to approve the sale at the mentioned price
to the interested party, Mr. Abdullah bin Muhammad al-Mahdi, provided that this amount is recorded
as revenue from the Samarra synagogue, and then this entry is reflected in the revenue section.

With reference to the letter from the Al-Huwaidi Synagogue Committee dated 4 / 7 / 1949 addressed to us and a copy
of it to your esteemed council.
Our committee has studied the proposal of the Al-Huwaidi Synagogue Committee regarding granting the vacant plot measuring
176 square meters, sequence 172 / 143 Bataween, by long-term lease to Mr. Muzahim Ahmed and has decided
to approve the aforementioned proposal, provided that the lease term is ten years with an annual rent of twenty
dinars, provided that two installments are paid in advance and the remaining eight installments are paid annually, and that the value of
the building is eight hundred dinars according to the attached map.
Our committee has prepared the draft of the attached contract intended to be executed with the aforementioned tenant.
Please kindly take a decision to authorize His Eminence the Head of the Community to sign it if your esteemed council's approval

176 square meters, by long-term lease for a period of ten years at an
annual rent of twenty Dinars, according to the detailed conditions in the contract submitted
by your committee. It also decided to authorize His Eminence the Head of the Community to sign the

<del>Contract of Work</del>
The contract has been concluded between Al-Maher Haym Tawfik, the Head of the Israeli Physical Council in Baghdad, in addition
to his capacity, hereinafter referred to as the Lessor.
And between Mr. Naseem Makki Mohammed Saeed, hereinafter referred to as the Lessee, on the following:
First - The Lessor has rented to the Lessee, and the Lessee has rented from the Lessor, after inspection and viewing, the plot of land
with known boundaries belonging to the Israeli community, located in Baghdad, in the area of Tasbar
numbered cadastral sequence 1/475 and door number 1/131 for a period of ten years starting from
the first day of February 1948 until the end of January 1958
(one thousand nine hundred and fifty-eight AD) for a rental fee of (1200 Dinars),
one thousand two hundred Iraqi Dinars only.
Second - The Lessee shall pay the rental fee to the Lessor in the following manner: two hundred and forty Dinars
in cash and in advance, and the remaining amount of nine hundred and sixty Dinars shall be paid in eight annual installments, each
installment being one hundred and twenty Dinars. The first installment shall be paid on February 1, 1949, and the second installment
on February 1, 1950, and so on consecutively, according to eight promissory notes issued
on February 1, 1948. If the Lessee delays in paying any due installment, the Lessor shall have
the option to terminate this contract, and in this case, the Lessee shall pay compensation and rental fees
that may be due from him until evacuation, in accordance with paragraph four of this contract.
Third - In addition to the aforementioned rental fee, the Lessee shall construct on the said plot
the buildings he needs from his own funds, provided that the expenses are not less than six hundred Dinars.
Fourth - The Lessee shall complete the construction of the buildings he needs according to the municipal regulations within a period not
exceeding three years from the date of this contract. If this period ends and the construction is not completed,
the Lessor shall have the option to consider this contract null and void, and the Lessee shall then be obliged to pay compensation equivalent to
half of the amount specified for construction, as stated in the third paragraph above, in addition to the rental fees that
may be due from him until evacuation, without the need for prior notice or to file
a lawsuit by the Lessor or his successor in office.
Fifth - The Lessee may not transfer the lease of the said plot to another person without the Lessor's consent, and this does not prejudice
the Lessee's right to exploit the plot within the lease period and to rent out the buildings he constructs to
whomever he wishes according to customary procedures.
Sixth - The Lessee shall not neglect the maintenance of the building during the lease period and shall not demolish it, entirely or in part. If
a part of it is demolished due to technical necessity or need, he must reconstruct that part with an amount
not less than its original cost.

Seventh - At the end of the lease term, the lessee must hand over the plot of land with the building erected on it, with all its components,
to the lessor or to his successor in office in a condition suitable for exploitation, considering it property
of the Israeli Community in Baghdad, and the lessee shall have no right at that time to claim anything
whatsoever.
Eighth - The lessee must pay the fees, taxes, and charges imposed by the applicable laws and those
that the government may decide in the future on the building and the plot of land, including property tax, paving fees,
and other municipal fees, as well as water and electricity charges.
Ninth - Based on the foregoing, agreement was reached between the two parties by offer and acceptance, and the lessee received the leased plot of land
mentioned under the conditions stated above.
Tenth - This contract was drawn up in original and copy. The lessee kept the original, and the lessor kept
the copy. Issued in Baghdad on February 1, 1948.

you must renew its lease during the mentioned period; otherwise, we will be forced to take
the necessary legal measures to preserve the rights of the Waqf.
