Investigation
In view of what appeared that the material seized in the possession of the defendants, owners of the shop belonging to
is present in the grain and date storage warehouses and the types of grains mentioned on p. 159, and upon inspecting
the shop, it became clear that the mentioned grains, in view of their smallness, largeness, and variation in this shop, and since
what was seized in the shop is of the grains mentioned above on p. 157, accordingly we decided to close
the case due to insufficient evidence against them and to release them on a bail of 12
dinars for each one of them, and to discharge them and return the grains to the shop owner
in the same quantity and quality, and to discharge them after the confirmation of the appeal.

Appeared before the court Ibrahim Effendi Daoud Nahum, the attorney for Sir Elly Kadoorie by virtue of the power of attorney
certified by the British Consul in Shanghai and its certified translation by the Notary Public of North
Baghdad on 29 May 1934, number 2548, and stated that according to his power of attorney for Sir Elly
Kadoorie, under the power of attorney authorized therein to dedicate the properties described below belonging to his client and whose
numbers are specified in the power of attorney deed, he has dedicated what is his client's property and under his disposal, which are the five houses located
in the city of Baghdad, one of which is numbered 116 / 34 located in the Taht al-Takiya quarter, the second 113 / 109 ⟦line⟧
located in the Qanbar Ali quarter, the third 113 / 111 located in the Qanbar Ali quarter, the fourth 113 / 113 located
in the Qanbar Ali quarter, and the fifth 113 / 115 located in the Qanbar Ali quarter. He has removed these ⟦line⟧
mentioned properties from his client's ownership and made them a valid, eternal, and binding endowment (waqf) for the sake of God Almighty, with all the rights
and facilities related to them, specifically and generally, with all their contents, not to be sold, bought, or subjected to any
transaction, provided that this endowment is used for the construction of a hospital for the treatment of eye diseases for the poor Israelites
in Baghdad, to be named the Rima Kadoorie Eye Hospital. If it appears at any time that the use of
the endowment as an eye hospital is not possible, it shall be leased for its appropriate value or used in another way, and then
its proceeds shall be spent first on the renovation and maintenance of the mentioned properties, and the surplus spent on assisting the sick among
the poor Israelites in Baghdad in any manner whatsoever. Secondly, this endowment, which was established in this form,
is added and joined to the endowment established by the two endowment deeds numbered 235 and dated July 27, 1924,
and the deed issued by the Baghdad Court of First Instance, under which the two houses numbered 105
and 107 were dedicated, such that this endowment is used in the same manner as used in the previous endowment
attached to the endowment deed numbered 235 and dated July 27, 1924. The trusteeship (tawliya) of this endowment shall be in the hands of
the head of the Meir Elias Hospital Committee and under the management of Menashi Ibrahim Karchi and Sion Ibrahim Karchi, jointly
and individually. After the absence of the head of the Meir Elias Hospital, the trusteeship returns to the Chief Rabbi and the President of the Lay
Council in Baghdad, while the management remains with Menashi and Sion in the aforementioned manner. After the death of Menashi and Sion,
the trusteeship itself returns exclusively to the head of the hospital committee if he exists, and if not, then to the Chief Rabbi
and the President of the Lay Council, and they shall manage it as one, in accordance with what is included in the aforementioned endowment deed ⟦line⟧
of record. He requested the registration of the endowment deed in the explained manner and the issuance of a deed to that effect. After summoning the head of
the hospital, named Meir Hakham Moshe Dangoor, and asking him about his acceptance of the trusteeship over the mentioned endowment and its registration,
he declared that he accepts the trusteeship over this endowment and pledges to implement its provisions according to the articles included therein
and in the endowment deed, and that he pledges to do everything that brings benefit and advantage to the endowment. The attorney
Ibrahim Effendi returned and claimed that he has recanted the dedication of the five houses in question and that he requests their return to the ownership
of his client and to make them free property in his name as before. The trustee Meir Hakham Moshe Dangoor opposed him before
the court and stated that since the endowment is among the binding matters for the public, and the attorney has decided on the endowment and declared it,
and it is not possible to recant the endowment after the decision and declaration, he therefore requested a judgment for the dedication of the five
houses according to the included conditions and the rejection of the attorney's request.

they are under the trusteeship of the Head of the Meir Elias Hospital Committee and under the supervision of Menashi bin Ibrahim Kouhi and Sion
Ibrahim Kouhi jointly and severally, and that the conditions of this endowment listed in the plaintiff's statement be fully applied in accordance
with the endower's conditions, and that this endowment be annexed to the first endowment he established pursuant to the endowment deed issued by this
court on July 27, 1924, number 335; and the trustee, the Head of the Israeli Hospitals Committee named
Meir Hakham Moshi Dangoor, has accepted the trusteeship over this endowment and pledged to manage it in accordance with the conditions
of the endower. Since the aforementioned attorney has recanted the endowment before the court and requested to return the endowed houses to
his principal and make them free property in his name as before, and the trustee Meir Hakham Moshi Dangoor has contested him before
the court and requested a judgment to endow the mentioned houses based on the establishment that occurred for the endowment; and the court
found that ruling for the endowment is more appropriate and beneficial for the public interest. After requesting a copy of the registration of the mentioned houses from
the Land Registry Department, it appeared they are registered in the name of the principal Sir Elly Kadoorie and that they are not mortgaged or seized, nor
does anyone else have an interest in them. Therefore, it has ruled on the validity of this endowment in its boundaries and totality with all its contents, which cannot

It shall not be bought nor shall any transaction be carried out upon it, provided that this endowment remains and functions as a hospital for the treatment of diseases
of the eye for the poor Israelites in Baghdad, and it shall be named the Rima Khedouri Eye Hospital. If it appears at
any time that the use of this endowment as an eye hospital is not possible, it shall be leased for an appropriate consideration
and used in another manner. In such case, its revenue shall be spent first on the reconstruction and restoration of ⟦the aforementioned⟧ and the balance secondly shall be spent
on assisting the sick among the poor Israelites in Baghdad in any manner whatsoever. Secondly, the endowment that is established
by this deed must be annexed to the endowment established pursuant to the endowment deed dated July 27, 924
numbered 235, such that this endowment is used in the same manner as the previous endowment
attached to the aforementioned deed, and the trusteeship shall be in the hands of the head of Meir Elias Hospital and under the supervision of Menashi
Ibrahim Karhi and Zion Ibrahim Karhi, jointly and severally. In the absence of the head of the board of the hospital of
Meir Elias, the trusteeship shall revert to the Chief Rabbi and the President of the Lay Council in Baghdad ⟦with⟧ the supervision of
Menashi and Zion remaining in the aforementioned manner. After the death of the aforementioned Menashi and Zion, the trusteeship shall be restricted to the head of
the board of the hospital if ⟦he is⟧ present, and if not, to the Chief Rabbi and the President of the Lay Council
together without anyone's supervision, in accordance with the purposes of the endowment. What occurred was written by request on the date of 6 Rajab
year 1353, corresponding to October 14, 1934.

There appeared before this Sharia Court the named Sayem Saleh Zabli, a resident of Ras al-Qarya quarter in the Baghdad solutions, whose identity is known by the testimony of
the two witnesses in Jadid Hassan Pasha quarter, Joki Khadoori and Ibrahim Yadallah in the Khudairi quarter, and in accordance with the contents of his petition dated
dated June 27, 1944, registered under number ⟦...⟧, they stated while testifying truthfully and with full free will and consent, I have removed from my property and endowed
for the sake of God Almighty, a valid, legal, and perpetual endowment, the single piece of the orchard named Umm al-Rub orchard, located in the Al-Sur quarter, old door number
149 and sequence ⟦...⟧, registered in the name of the Land Registry Office, bounded to the north by the orchard of the agent of Sayem Zabli, Lafta Hadem and Durra Robin,
to the south by the Ozaniya orchard, to the west by a public road, and to the south by the Al-Mafraza orchard belonging to the owner of the property who is ⟦...⟧ aforementioned, and the second
piece of the orchard named Umm al-Rub orchard, located in the Al-Sur quarter, old door section 149, sequence ⟦...⟧, registered in the name of the Land Registry
Office in the name of Zabli ⟦...⟧, bounded to the north by the Al-Mafraza orchard belonging to the property owner, to the south by the orchard of Sayem Ahadi bin Al-Haj Muhammad Khalaf
Bahr, to the east by the Ozaniya orchard, and to the west by a public road, which covers five hundred square meters, along with all rights, facilities, and appurtenances. I have
removed it from my property and endowed it for the rest of the soul of my nephew, the young man Saleh Zabli, on the condition that it be granted as a site for the hospital for poor Israelites
in Baghdad, to be within the hospital of the late Eliyahu Shlomo Dawoud to look after as he wishes, noting that the Land Registry procedures were carried out without a land tax in this place
the building, and it states: (This land of the hospital was endowed by Sayem Saleh Zabli for the rest of the soul of the late young man Saleh Sayem
Zabli, who passed away on October 14, 1941, to be a memorial for generations. I have appointed a guardian for it, who is the head of the Relief and Subsistence Society
and the Rima Kadoorie Hospital, successor after successor until the end of time. The request is to hear my confession of the aforementioned endowment and record it in the registry of
your esteemed court, to rule on its validity and enforcement, to issue the endowment deed, and to notify the Baghdad Land Registry Office for registration purposes.
Upon inquiry at the Baghdad Land Registry Office, it was recorded in the monthly register under number ⟦...⟧ dated
on ⟦...⟧ that the orchards located in the aforementioned Al-Sur quarter ⟦...⟧ belonging to Sayem ⟦...⟧
and which are neither seized nor endowed, and are registered in the name of Sayem Ahadi ⟦...⟧. Since ⟦...⟧ and after looking
into the aforementioned terms of the endowment, it appeared that they comply with the legal provisions for endowments, and therefore the validity of the endowment was ruled upon
for the aforementioned orchards, and its binding nature and enforcement. It was entered into the court registry ⟦...⟧ and this endowment deed was issued and notification
was made to the Baghdad Land Registry Office for registration. This took place on the twentieth day of the month of Dhu al-Qi'dah ⟦...⟧

Reason for Granting the Deed
This real estate was registered as a valid, legal, eternal, and perpetual endowment (Waqf) for the sake of charities and good deeds
provided that it shall not be sold, gifted, mortgaged, inherited, replaced by another, nor transferred in any way
that transfers ownership and title, but rather remains dedicated to what was designated for it and conditioned by its terms written in its endowment deed
dated August 10, 932, number 45, issued by the Baghdad Sharia Court, pursuant to the legal notification
issued by the aforementioned court dated September 18, 932, number 45, which includes the ruling on the validity and binding nature of the endowment
and its registration in the court records and Tapu departments and its addition to the trustee (Mutawalli) of the endowment, the aforementioned Salih Effendi
son of the late Eliyahu Ezra Daniel, and the trusteeship over it and all other endowments of the aforementioned endower was granted to the endower himself
for the duration of his life, then after him to the eldest and then the eldest of his male children, then to his children's children, then to his children's children's children
and so on, generation after generation and era after era. If they become extinct, then to their females likewise. If they become extinct, then to
the children of the daughters, males and females likewise. If they become extinct, then to the closest of people to the endower by kinship among males and females.
If they become extinct, the trusteeship passes to the Chief Rabbi of Baghdad and after him to the head of the Israelite community in Baghdad.
If that is not possible, the Sharia judge shall appoint a trustworthy and capable trustee from the members of the aforementioned community,
on the condition that the revenues of the mentioned endowment and other endowments of the aforementioned endower be spent on the two schools
Al-Watan and Al-Taawun, the private Israelite schools, equally between them, and whatever remains of their revenues
shall be spent on the poor and needy of the Israelite community in Baghdad. In the event of the dissolution
of one or both of the mentioned schools, its or their share shall be added to the share of the mentioned poor
and spent on them. This endowment has been registered in the name of the aforementioned trustee, Salih Effendi
son of Eliyahu Ezra Daniel, in addition to the endowment based on the legal notification mentioned above
and the endowment deed mentioned earlier, the copy of which is kept in the renewed registration file under number 27 / 65.
And based on Article 8 of the Law of Disposition of Immovable Property and the decision of the Board of
Tapu Administration dated September 11, 932, number 425, the old registration was corrected and this deed was given.

The Upper Section of the Deed
Pursuant to the legal Waqf deed issued by the Baghdad Sharia Court dated 24 Rabi’ al-Thani 1344, Register Number 147, and Page 147, the endower mentioned above, Albert David Sassoon, has endowed the entire house described above as a valid, legal, eternal, and perpetual Waqf for the sake of righteousness, goodness, and charity. It is stipulated that the management and supervision of this Waqf shall be for himself during his lifetime, and after him for his brother Shaul David Sassoon, then for his male children, and then for their children and their descendants, generation after generation. If they become extinct, the management shall be for the most rational and suitable male children of the endower's children and their descendants in the mentioned order. If they all become extinct, the management shall be for the most rational and suitable male children of his mentioned brother Shaul and their descendants in the order explained above. If they all become extinct, the management shall be for whoever the Sharia judge selects from the endower's relatives. It is stipulated that the revenue of this Waqf shall be spent on the Albert David Sassoon School, Meir Elias Hospital, Rima Khadoori Eye Hospital, and other religious and charitable places as detailed and written in the mentioned Waqf deed registered in the Tabu Department under number 925 and date 9 September 925. This Imperial (Khaqani) deed is issued as a confirmation of the mentioned Waqf and its disposal.

Method of Issuing the Deed
According to Tapu deed No. 144 dated July 24, 934, which showed that
the mentioned shop was registered in the name of the trustee Sassoon Khedhouri and that
it is an endowment for the Reema Kadhourie School. Based on the request of the aforementioned
trustee, certified by the report of the Spiritual Council of the Mosaic Community
in Baghdad dated November 25, 934, and certified by the
Prime Minister's Office in its letter No. 411 dated January 11, 935,
which indicates that the endowment of the mentioned school has been dissolved and that the management of said
endowment has been transferred to the custody of the Presidency of the Mosaic Community
in Baghdad. Accordingly, it was decided to register the mentioned shop in the name of the Presidency
of the Mosaic Community in Baghdad in its capacity as the trustee of the community's endowments.
Accordingly, the mentioned shop has been registered in the name of the Presidency of
the Mosaic Community in Baghdad in its capacity as the trustee of the endowments of the
aforementioned community. Based on this, this deed has been issued.

First Owner: According to the permanent Tapu deed number 22 dated September 925 mentioned above, the shop bounded above was the private property of the late Sassoon son of Eliyahu Samuel Shalom, and the aforementioned dedicated it according to a legal deed dated 14 Shawwal year 1285 to God Almighty as a valid, legal, eternal, and observed waqf, organized and immortalized, not to be sold, nor weakened, nor mortgaged, nor inherited, nor owned in any legal manner, but rather remains a valid waqf until God inherits the earth and those upon it, and He is the best of heirs. The aforementioned dedicator stipulated that its proceeds be spent for the Albert David Sassoon School located in the Torah neighborhood in Baghdad, and that its trustee is whomever is chosen by the administrative committee of the mentioned school, and that the current trustee is Mr. Eliyahu son of Sassoon son of Eliyahu Samuel Shalom according to the trusteeship deed dated 24 Rabi' al-Thani year 1344 and certified by the Presidency of the Sharia Court of Cassation in Baghdad dated 25 Rabi' al-Thani year 1344, coupled with the order of the Ministry of Justice dated 28 Rabi' al-Thani year 1344 and communicated to the Baghdad Tapu Directorate by its letter numbered 945 and dated 29 Rabi' al-Thani year 1344. mentioned above is a correct, legal, eternal endowment and an explicit, observed, perpetual detention, endowed and detained by the late Menachem
son of Eliyahu Daniel, and he removed that from his ownership and possession and made it for God Almighty and stipulated conditions in it, including that
the trusteeship of this endowment and its supervision be in the hand of his eldest son Ezra Menachem Daniel, then after him
in the hand of the most mature among his male children, their children, their offspring, and their descendants as long as they reproduce and succeed each other.
If they become extinct, God forbid, the trusteeship returns to the most mature among the male children of his brother

According to the Khaqani deed dated January 1st, 918, number 1811, the aforementioned house was registered as a valid family endowment (Waqf) in the name of Rahma daughter of Abdullah bin Yusuf, and its supervisor was Ezra bin Saleh Hayyim. According to the Sharia Court notification dated November 24th, 923, number 1182, the endower passed away and the trusteeship was restricted to her nephew, the aforementioned Ezra bin Saleh. According to the notification of the Single Judge in Baghdad dated February 24th, 924, number 129, the trustee Ezra bin Saleh passed away and the trusteeship was restricted to his son, Saleh Effendi. According to the Sharia Court replacement certificate dated November 24th, 923, number 1183, permission was granted to replace the aforementioned house with a cash sum to buy another property and make it an endowment in its place. For the purpose of replacing it with another property, the aforementioned house was sold to the buyer below for a sum of five hundred and fifty Rupees. The mentioned price was paid in cash, the trustee acknowledged receiving it in full, and the fees were collected.

There has appeared before this court the merchant named Munshi Ibrahim Kurji, residing in the Qanbar Ali neighborhood,
one of the neighborhoods of Baghdad, whose identity is known by the testimony of two witnesses: the lawyer Salim Isaac Effendi from the
Haydar Khana neighborhood and Haki Anbar Effendi from the Jadid Hassan Pasha neighborhood; and he repeated the contents of his petition to this court
dated July 12, 1924, acting on behalf of Eliezer <del>Khedouri</del> Saleh Khedouri, and presented a petition
signed by Eliezer Saleh Khedouri written in Arabic and translated into English, dated June 4, 1924,
and certified by the British Consulate General in the city of Shanghai, containing the power of attorney of the aforementioned Eliezer to
Khwaja Munshi Ibrahim Kurji, the merchant residing in the Qanbar Ali neighborhood in Baghdad, to appear in the competent court
in Baghdad and to state and confirm the provisions and conditions of the endowment (waqf) in the following manner, namely: that Eliezer Saleh Khedouri, residing
in Shanghai, China, has removed from his private ownership and established as a valid, legal, and perpetual endowment the two houses
belonging to him, currently under his disposal, with all their associated rights, facilities, and contents,
namely:—
1 — All shares of the first house ⟦located⟧ in the Qanbar Ali neighborhood, sequence 104 and numbered 107 / 113,
bounded at the front by the public road, to the left by a private road, to the right by the house of the owner Rachel
daughter of Saleh Khedouri and her partners, and at the rear by the house of Mu'allim Daoud bin Meir; and the shares are registered in the
Permanent Registers of June 328, July 328, and June 329.
2 — All shares of the second house located in the Qanbar Ali neighborhood in Baghdad, sequence 103 and numbered
105 / 123, bounded at the front by the public road, to the right and rear by Shlomo bin Abdullah, and to the left
by the house of the owner Rachel daughter of Saleh Khedouri and her partners; and the shares are registered in the Permanent Registers of
June 328, July 1328, and June 1329.
On the condition that the two aforementioned endowed houses be used in the following manner:
1 — The two mentioned houses shall be used as an eye hospital for the poor Israelites of Baghdad, and the
administration of this hospital shall be linked to the administration of the Meir Elyahu Shlomo Daoud Hospital.
2 — The said hospital shall be named (Rima Khedouri Hospital).
3 — The guardianship (tawliya) of this endowment shall belong to the head of the committee of the aforementioned Meir Elyahu Hospital, provided it is under
the supervision of Munshi Ibrahim Kurji and Sion Ibrahim Kurji, jointly and severally.
4 — In the event of the loss of the head of the Meir Elyahu Hospital committee, the guardianship shall pass to the Chief Rabbi and the President of the
Lay Council in Baghdad jointly, while maintaining the supervision of Munshi and Sion in the aforementioned manner; and after
 the aforementioned Munshi and Sion, the guardianship shall be limited to the head of the hospital committee if he exists, and
if not, <del>then the Chief</del> Rabbi and the President of the Lay Council together without anyone's supervision.
5 — The guardian, in agreement with the supervisor, is authorized to expand the use of the endowment for poor Israelite patients
afflicted with all types of diseases, without distinction.
