The Endower - Shaul Eliyahu Naqqar
Eliyahu Shaul Naqqar appeared and, after being identified by the two identification witnesses, the lawyers Anwar Yaqoub
and Shalom Darwish, stated the following:
I, Eliyahu Shaul Naqqar, have agreed to allocate the amount of two thousand Dinars from my property to be used to purchase
immovable property to be established as a valid, final, and eternal endowment (waqf) for the rest of the soul of my late son Elisha Shaul Naqqar, provided that
the proceeds of this endowment are spent year after year, first on the restoration and maintenance of the endowment, and the remainder shall be spent on purchasing annual prizes
to be gifted for free to the male and female students of the private schools belonging to the administration of the Jewish Community in Baghdad and the students
of the Jewish vocational and industrial institutes in Baghdad who excel in languages, sciences, arts, industries,
or other school activities in each academic year. It is also possible to allocate some of these proceeds to purchase textbooks
and other school supplies to be distributed for free to poor male and female students in the mentioned schools and institutes ⟦line⟧
I have decided to entrust the guardianship to two persons who shall act jointly: one is myself, the endower Shaul Eliyahu Naqqar, and the second is the person
appointed and replaced from time to time by the Jewish Schools Committee in Baghdad, which branches from the Jewish Lay Council
in Baghdad, and the aforementioned Lay Council itself in the absence of the Schools Committee, for as long as I am
alive. After me, the guardianship shall pass to the eldest of my children in participation with the person appointed by the mentioned
Schools Committee. After him, the guardianship shall pass to the Jewish Lay Council in Baghdad or whoever takes the place of the mentioned
Lay Council according to the Jewish Community Law No. 77 of 1931 or any other law that replaces it. The
guardian must hand over once a year the accumulated proceeds of the endowment after restoration and maintenance to the Jewish Schools Committee
in Baghdad or whoever takes its place in its absence, so that they may be spent at their discretion for the designated beneficiaries. This committee
alone shall determine each year which Jewish schools and institutes in Baghdad whose male and female students are to benefit
from the prizes, books, and supplies in that year according to the following conditions:
1- The prizes shall be called (The Late Elisha Naqqar Endowment Prizes).
2- The prizes shall be useful and appropriate books, bound in a decent manner, and a paper shall be pasted after the cover of each volume gifted,
the size and shape of which shall be determined by the guardian, on which the following phrase is written: (The Late Elisha Naqqar Endowment Prize gifted to the student
[Name] from the [Number] grade of the [Name] school for his excellence in the [Name] branch of [Name] science). This paper may carry
the photograph of my late son Elisha Naqqar. It is also permissible for some of the prizes, specifically those granted
to the students of the industrial, technical, or vocational institutes, to be tools or machines or the like of supplies that assist
the male or female student in completing those studies or practicing them as a profession.
3) It is preferred that these prizes be granted during the period between the first and seventh day of the Hebrew month of Iyar each
year in a school ceremony, and a prayer for the soul of my late son Elisha Naqqar shall be read in at least one of the schools.

4- A special paper shall be pasted on the covers of the school textbooks that are gifted to the female or male student readers, the
shape and size of which shall be determined by the trustee, clearly stating that these books are granted from the late person's endowment. These books, as well as
school supplies, in order not to be consumed, are conditioned to be returned from the female and male student readers at the end of each academic
year so that they may be given again to those female and male student readers who need them at the beginning of each year.
This being said, I have handed over the amount to Mr. Israel Nessim Hai and my son Benjamin Shaul Nakkar and appointed them to purchase
the immovable property and register it as an endowment according to the conditions listed above. The aforementioned persons, until they find the suitable property
for the endowment, may invest the endowed amount in a risk-free investment and deliver the proceeds to the Committee of Israeli Schools
in Baghdad to be spent according to what is stipulated in this petition. Both Israel Nessim
Hai and Benjamin Shaul Nakkar attended and acknowledged their receipt of the two thousand Dinars, and the plaintiff requested the issuance of a deed to that effect.
The Decision
In view of the above, the endowment has been completed, becomes binding, and is ruled upon according to the conditions listed above, and it has become a
valid legal endowment, and what transpired has been recorded as requested.
