Dossier 209 Sequence Number 235
924
There has appeared before this court the merchant named Munshi Ibrahim Kurji, residing in the Qanbar Ali neighborhood,
one of the neighborhoods of Baghdad, whose identity is known by the testimony of two witnesses: the lawyer Salim Isaac Effendi from the
Haydar Khana neighborhood and Haki Anbar Effendi from the Jadid Hassan Pasha neighborhood; and he repeated the contents of his petition to this court
dated July 12, 1924, acting on behalf of Eliezer <del>Khedouri</del> Saleh Khedouri, and presented a petition
signed by Eliezer Saleh Khedouri written in Arabic and translated into English, dated June 4, 1924,
and certified by the British Consulate General in the city of Shanghai, containing the power of attorney of the aforementioned Eliezer to
Khwaja Munshi Ibrahim Kurji, the merchant residing in the Qanbar Ali neighborhood in Baghdad, to appear in the competent court
in Baghdad and to state and confirm the provisions and conditions of the endowment (waqf) in the following manner, namely: that Eliezer Saleh Khedouri, residing
in Shanghai, China, has removed from his private ownership and established as a valid, legal, and perpetual endowment the two houses
belonging to him, currently under his disposal, with all their associated rights, facilities, and contents,
namely:—
1 — All shares of the first house ⟦located⟧ in the Qanbar Ali neighborhood, sequence 104 and numbered 107 / 113,
bounded at the front by the public road, to the left by a private road, to the right by the house of the owner Rachel
daughter of Saleh Khedouri and her partners, and at the rear by the house of Mu'allim Daoud bin Meir; and the shares are registered in the
Permanent Registers of June 328, July 328, and June 329.
2 — All shares of the second house located in the Qanbar Ali neighborhood in Baghdad, sequence 103 and numbered
105 / 123, bounded at the front by the public road, to the right and rear by Shlomo bin Abdullah, and to the left
by the house of the owner Rachel daughter of Saleh Khedouri and her partners; and the shares are registered in the Permanent Registers of
June 328, July 1328, and June 1329.
On the condition that the two aforementioned endowed houses be used in the following manner:
1 — The two mentioned houses shall be used as an eye hospital for the poor Israelites of Baghdad, and the
administration of this hospital shall be linked to the administration of the Meir Elyahu Shlomo Daoud Hospital.
2 — The said hospital shall be named (Rima Khedouri Hospital).
3 — The guardianship (tawliya) of this endowment shall belong to the head of the committee of the aforementioned Meir Elyahu Hospital, provided it is under
the supervision of Munshi Ibrahim Kurji and Sion Ibrahim Kurji, jointly and severally.
4 — In the event of the loss of the head of the Meir Elyahu Hospital committee, the guardianship shall pass to the Chief Rabbi and the President of the
Lay Council in Baghdad jointly, while maintaining the supervision of Munshi and Sion in the aforementioned manner; and after
the aforementioned Munshi and Sion, the guardianship shall be limited to the head of the hospital committee if he exists, and
if not, <del>then the Chief</del> Rabbi and the President of the Lay Council together without anyone's supervision.
5 — The guardian, in agreement with the supervisor, is authorized to expand the use of the endowment for poor Israelite patients
afflicted with all types of diseases, without distinction.

6 - In the event that it is not possible to use the mentioned endowment as a hospital and this is verified by the Spiritual Authority
and the Lay Council, the two houses shall be rented for a fair market rent, and after the necessary restoration, the remainder
of the yield shall be spent on poor Jewish patients in general.
7 - The administration of the Meir Eliyahu Hospital must carry out the necessary repairs for the two houses on time from
the rights of that administration whenever they are used as a hospital.
Accordingly, the aforementioned Menashe requested the registration of the said endowment in the manner explained, and it was ruled valid,
binding, and effective. ⟦Firstly⟧, the endowment deed was issued, and upon inquiry from the Land Registry Department, Baghdad district, it was
understood from the written postscript No. 3842 dated July 22, 1924, that the two houses located
in the Qanbar Ali neighborhood, numbered 105 and 107 / 113, are pure property under the ownership and disposal of Eliezer
Effendi Saleh Khedouri, registered in the permanent records of June 328, July 328, and June 329,
under numbers 317 / 312, 203, 204, 146, and 147. Considering that the two mentioned houses
are neither mortgaged nor seized, and the Khaqani deeds are in accordance with the records.
After reviewing the mentioned power of attorney, it appeared that it was duly registered by the aforementioned Eliezer in Shanghai,
and it authorizes the aforementioned Menashe Ibrahim Kochi to declare and register the endowment in the written manner. Under the endowment conditions mentioned
above, it appeared to be in accordance with the legal provisions of the endowment. Hence, the validity, necessity,
and effectiveness of the mentioned endowment were ruled. It was entered into the court register under file number 209, and this endowment deed was issued. Notification
was sent to the Baghdad Land Registry Department for registration. That was on the twenty-fifth of the month of Dhu al-Hijjah
in the year 1342, corresponding to the twenty-seventh day of July 1924.

Sassoon Hayy Shlomo Daoud, the representative of the Hakham Bashi of the Mosaic community in Baghdad, whose identity was identified by the testimony of the two witnesses present
in the session, namely Khawaja Zion Isaac Habsh and Salim Effendi Isaac from the Mosaic community. After the identification,
the aforementioned Rabbi Sassoon began to speak, saying: With my full choice and consent, and with my full maturity and health, I have removed from my ownership
and endowed as a valid, legal, and perpetual endowment the plot known as the Lime Factory, which is my property and under my disposal, located in
the district of al-Koulat of the districts of the city of Baghdad, registered in the Land Registry (Tapu) in the permanent ⟦year⟧ ⟦922⟧ volume under serial number 287

known as the Lime Factory was seized or mortgaged, and the response was received on December 6, ⟦922⟧ under number 4462
that the aforementioned Lime Factory located in the mentioned al-Koulat district under serial 287 is the pure property of the aforementioned Rabbi Sassoon
Shlomo Daoud from the listed individuals and is neither mortgaged nor seized. After reviewing the aforementioned endowment conditions,

each year shall be spent first on what is required for the repair, restoration, and painting of the school and the rest of the aforementioned endowed properties.
And what remains of it after that, the Trustee (Mutawalli) shall deposit it with the Jewish Charitable Association known by the name
((Anglo-Jewish Association)) residing in London to be added to the direct capital collected for the purpose of
investing it so that its growth may be spent on the various expenses of the aforementioned school, and if the said charitable
association is dissolved, the Trustee shall receive from it whatever has accumulated with it at that time of the capital and the specific
growth for the aforementioned school and shall purchase properties with it and endow them so that their revenue may be spent on the expenses of the aforementioned school.
Likewise, what is obtained from the surplus of the lease of the aforementioned properties after the dissolution of the said Association, the Trustee shall purchase
properties with it and endow them in the manner described. As for the affairs of the aforementioned school, such as the appointment of a director, teachers, and other
employees and their dismissal from time to time, and the specification of the amount of their salaries, the arrangement of lessons, and the specification of the hours of lessons
and teaching, and the specification of the types of expenses required for the aforementioned school and their amounts, and other affairs of the
school, they shall be managed by a committee composed of the Trustee and under his chairmanship, and two members elected by the Trustee with the approval of the Overseers (Nuzzar)
or their agents in each year for a period of one year, provided that it is permissible to renew the election of both of them or the election of one of them in the
future. Decisions issued by the said committee shall be acted upon by consensus and by a majority of votes. As for the trusteeship (Tawliya) of the
said endowments, it shall be for my brother Yusuf bin Shlomo Saleh Shamash, and after him to the eldest of his children, and his children's children, and his
children's children's children, as long as they reproduce and succeed generation after generation and layer after layer. The oversight (Nizara) over the Trustee shall be for
me, the Endower (Waqif), likewise for me and my brother Benjamin bin Shlomo Shamash, and Kurji, the son of my brother Shaul bin Shlomo Shamash, jointly
and severally, and after each one of us, the oversight shall be for the eldest of his children, and his children's children, and his children's children's children,
as long as they reproduce and succeed generation after generation and layer after layer, likewise jointly and severally. And whoever of the Overseers is absent
from this city shall appoint another person as his agent during the period of his absence. I have delivered to the Trustee present in the assembly all
the aforementioned endowed properties, and he has managed them as trustees manage for a period of time. The Trustee
Rahmin the aforementioned has confirmed everything he said. After the matter of the endowment and delivery was completed in the manner described above, the
Endower Yaqub the aforementioned hastened and stated: I have retracted the aforementioned endowment and want to return the mentioned properties to
my ownership as before, so I request the order of the aforementioned Trustee to deliver them to me to dispose of them in a proprietary manner as it was.
The mentioned Trustee Rahmin replied that the endowment is valid and that I shall continue to hold the mentioned properties for the endowment
according to the mentioned conditions, and he refused to return and deliver them to the mentioned Endower Yaqub for the purpose of returning them
to his ownership as before. Each of them insisted on requesting a judgment according to his claim and defense. After I reflected on the claim
and defense of each of them and the sayings of the jurists regarding the rulings of endowment, I ruled for the validity and binding nature of the mentioned endowment with all its rights
and facilities, in its specific and general aspects, according to the conditions included above, based on the opinion of those among the honorable Mujtahids who see it,
being aware of the existing dispute among the predecessor Imams. Accordingly, the mentioned endowment has become valid, binding, and mandatory,
protected from revocation, nullification, and suspension. Issued on 12 Rabi' al-Thani 1355 and / 1 July 1936.
