Judge - Mr. Salman al-Biyat
Saleh Faraj Hayim approached this court with his petition dated 5/20/1948 and stated that
voluntarily, by choice, and in full mental capacity and maturity, he has agreed to remove from his ownership one-third of the house
belonging to him, sequence 553, door number 31/2, located in the Ras al-Qarya neighborhood, and to keep it
as a valid, final, and eternal endowment (waqf), making it an endowment for the soul of Nom daughter of Eliyahu Nouriel, and making
the guardianship (tawliya) over it to the Spiritual Council of the Israelite Community in Baghdad or any other body that would
have the right to represent the Israelite community in Baghdad in the absence of the aforementioned Council, provided that
the Council or whoever takes its place entrusts the management of this endowment and the spending of its revenue on the designated purposes
after his death, and entrusts it to the director of the Albert David Sassoon School in Baghdad under the following conditions:
And if it becomes impossible to ensure the management of the common shares of the aforementioned house through the director of the
Albert David Sassoon School in any ⟦manner⟧ for any reason whatsoever at any time, then the Spiritual Council or whoever takes
its place, in agreement with ⟦...⟧ director of the Albert David Sassoon School, shall appoint a person or a body
to manage the affairs of the endowed shares of the house in question instead of the school director
referred to.
First - Renting it for a fair market rent, and the revenue obtained from it shall be given to pay:
A - Government and municipal fees and taxes.
B - Paying the fees for collecting revenues and managing the property's affairs.
C - Carrying out repairs and renovations on the endowed property when strictly necessary.
Second - A - Paying monthly wages to each of Rabbi Yosef Eliyahu Rabi' and Rabbi
Yaakov Ezra Musli (2.500) ⟦D⟧ two dinars and five hundred fils each,
or its equivalent in the currency in circulation at any given time.
B - Paying monthly wages to each of Rabbi Nissim Khedhouri and Rabbi Salman
Abboudi (2.550) dinars, two dinars and five hundred and fifty fils each,
or its equivalent in the currency in circulation at any given time. The monthly wages
paid to these four rabbis are for reading the Holy Torah for
the souls of the late Nom and Toba, daughters of Eliyahu Nouriel.
C - If one of these rabbis mentioned in paragraph (A) of this
article dies, or does not perform the duty assigned to him, or resigns of his own accord, then
another rabbi shall be appointed in his place by the opinion and nomination of the director of the Albert David Sassoon School in Baghdad
in agreement with the head of the religious courts of the Israelite community in Baghdad.
D - If one of the rabbis mentioned in paragraph (B) of the second article
above dies, resigns, or does not perform the duty assigned to him, there shall be delegated

instead of him, a Rabbi from (Tomchei Torah) at the discretion and nomination of the director of the Albert David
Sassoon school in Baghdad in agreement with the head of the (Tomchei Torah) association.
Third - After the spending and expenditure regarding what was mentioned above, what remains of the yield of two-thirds of the house
mentioned shall be spent at the discretion and nomination of the director of the Albert David Sassoon school in Baghdad on one of
the Israelite schools in Iraq which the aforementioned director supervises.
Fourth - The trustee has the right to purchase other properties adjacent to the endowed property or outside of it and annex them
to the mentioned endowment under the same conditions listed in this endowment deed.
Fifth - The trustee may borrow sums of money for the purpose of renovating the endowed properties on the condition of securing
the borrowed sums and their interest from the yield of the mentioned endowments within a specific period, taking into account
securing the recurring expenses mentioned above in a regular and permanent manner.
Sixth - The director of the Albert David Sassoon school responsible for the management of this endowment or whoever
acts on his behalf via an official power of attorney shall do the following:
A - Maintain special account books for the mentioned endowment
B - Keep documents, receipts, and reserve funds, and place the available
money obtained from the endowment yield in banks under a name and title specific to the mentioned
endowment.
C - Organize an annual budget showing the estimated revenue and the allocation of expenses and submit it
to the trustee to obtain approval for it.
D - He is also obligated to submit to the mentioned trustee after the end of each calendar year
a list containing the details of the actual revenues and expenditures arising and the benefit from the endowment
mentioned during the ending year in accordance with the conditions of the endowment deed he is tasked with.
Since this arrangement is in accordance with the conditions of the endowment, I have decided to issue this endowment
deed accordingly, and it was issued in Baghdad on the 1st day of June 1948.

The head of the Jewish community in Baghdad and Haj ⟦Sayyid⟧ Rashid Mahdi
Al-Askari, Haj Alwan, and Haj Naji, the sons of Hussein Haidar, approached this court with their petition dated 4/21/948
And they presented the aforementioned petition which stated that the plot of land located in the Battaween district, serial number
143/37 is an endowment (waqf) and used as synagogues for performing prayers, and that the head of the community is its trustee (mutawalli).
And that the owner of the adjacent plot of land serial number 143/171 had built his house by mistake
on a part of the land used for synagogues, serial number 143/37, with an area of 184/61 square meters,
instead of plot serial number 143/171. Similarly, the owners of plot serial number 143/172
had built their house on plot numbered 143/171, so that plot
numbered 143/172 has remained empty until now, with an area of 176 square meters, which indicates the good faith
of the neighbors. The head of the community, in his capacity as overseer and trustee of the mentioned synagogues, requested the partitioning of the plot
serial number 143/37 into two plots and the exchange of the plot on which his neighbor Rashid
Mahdi Al-Askari built, with the empty plot numbered 143/172. The owner of the plot numbered
143/171 agreed to ⟦exchange⟧ his plot as well with the owners of plot 143/172. The head of the community
requested the issuance of a legal deed for the exchange in the manner mentioned above. Upon conducting the inspection,
it became clear that Rashid Mahdi Al-Askari, the owner of plot 143/171, had built his house by mistake on
part of the endowment land belonging to the synagogues, serial number 143/37, with an area of 184/61 square meters,
thinking that it belonged to him. Similarly, Naji and Alwan, sons of Hussein Haidar, the owners of plot 143/172,
had built their house on the plot of Rashid Mahdi Al-Askari, serial number 143/171, thinking
that it belonged to them, and plot numbered 143/172 remained empty of any construction. It appeared
as a result of the ongoing inspection that this exchange is not harmful to the rights of the Jewish community endowment,
as the area of the two plots is approximately equal, the location is the same, and the oriental value of the two plots is equal.
Therefore, based on the joint request submitted to this court by the head of the community and the aforementioned
neighbors, it was decided to approve it and issue permission for the exchange in the manner mentioned above. Issued
on 5/26/1948.

According to the Sharia judgment deed numbered 51 and dated 27 Dhu al-Qi'dah 937 issued by the Sharia Court in Baghdad, the deceased Naima daughter of Eliyahu owned at the time of her death
the house numbered above, and that her heirs are limited to the children of her brother from her father and mother who died before her, named Moshi, and they are Yusuf, Salih, Nassim, Meir, Isaac, Raphael, Ibrahim, and Yaqub, the sons of Moshi.
And that the mentioned house was sold by public auction by the mentioned court for the purpose of dividing its value among them, so it was transferred to the buyer Muhammad son of Salim for a sum of one hundred and twenty-five Dinars.
And the permanent register numbered 44 page 12 volume 12, and the mentioned buyer sold the entire mentioned house to the buyer Eliyahu Ezra Eliyahu for a sum of one hundred and thirty-five Dinars.
And it was registered in his name in the Tabu according to the deed numbered 44 September 1934, and the mentioned buyer Eliyahu Ezra Eliyahu passed away and his legal inheritance was limited to his wife Masouda daughter of Yusuf
and his children from her, namely Suleiman, Ladhidha, Mazli, Naima, Farha, and Nazmiya, according to the legal distribution issued by the Baghdad Conciliation Court under No. 881 and dated 11/18/1936, and that
the mentioned house belongs to them as an inheritance from their mentioned predecessor, and they have sold the entire mentioned house for a sum of one hundred and thirty-five Dinars to the buyer Ibrahim
Rubin Moallem Nassim according to the final bill of sale certified by the Notary Public of Baghdad under No. 6806 and dated 12/19/1936, and since the mentioned sellers have disposal over the house
mentioned as an inheritance from their mentioned predecessor, whose disposal is based on the permanent deed mentioned above, the mentioned house has been registered in the name of the buyer Ibrahim Rubin Moallem Nassim
based on the mentioned bill of sale, the mentioned distribution, the mentioned Khakani deed, and the payment of the Tabu fee according to receipt No. 68 dated 12/28/1936
for the sale transaction.
