Sir,
I have the honour to bring the following to your kind
consideration:
The Jewish Community has a cemetery situated near the
Southern
<del>northern</del> gate of the town in a site affected since generations
to the use of the Jews as burial ground. This cemetery has
in the eyes of the Jewish public a particular importance and
a peculiar interest transformed by the traditions of many
generations into a religious respect for the sanctity of the
place. The Jews are in the habit of assembling there once a
month or at least twice a year and recite prayers. They also
take great care to keep the tombs in good condition by repairing
or building them anew every year.
Originally the place was purchased by the Jewish Community
and from time to time a neighbouring ground was annexed to it
by purchases from the Ottoman authorities.
I may add that the Jews have no other cemetery in any
other part of the town and that in this are buried the greatest
rabbis of the past and present time.
Lately I have been informed that a part of this cemetery
will be shortly levelled for the purpose of building a railway
station. The title deeds were sent for by the Municipal Engineer
in order to assess the value of the ground.
I beg to state that the Municipality cannot make any
satisfying assessment of the ground considering the spiritual
importance of the place which in the eye of the Community is
not exchangeable in any way.

ولقد اخذنا العجب من حكم غريب كهذا لم يبنى على اساس مدني او شرعي فاننا لم نتذكر انني
دعيت يوما ولم احضر الا لاسباب جوهرية قد شرحتها على اوراق الجنب وفضلا عن هذا
فقد عرضت في كتابي الاثنين انني حاضر للمرافعة امام المحكمة في هذه القضية التي لم يسبق
لغيرها من القضايا ان تأخرت اكثر من اربع سنوات وقبل ما يقارب الشهر قررت المحكمة
الروحانية ان تسمع افاداتي وعينت يوما للمحاكمة غير انني لم اعلم الاسباب التي اوجبت هذا
التأخير في هذه الدعوى التي اصرت بمصالحنا كثيرا منذ ان توالت مراجعاتنا حولها من
اربع سنوات واكثر والسبب في ذلك هو غلق المحكمة الروحانية ابوابها على حين غفلة فاننا نسترحم
سيادتكم بناء على ما خولتكم اياه المادة السادسة من نظام الخلخاخانة وما حتمه عليكم
النظام نفسه ان تنظروا مشتركا مع المحكمة الروحانية في هذه الدعوى ونصدر بما يسوغ ما يضمن
حقكم الذي لا اشك في انه سيكون حكما نزيها وانه لما يؤلمني ويؤلم كل بصير ان يرى
مثل هذه التأخيرات في قضايا واضحة ظاهر فيها الحق ظهور الصبح لدى عينين ولئن لم
يكن في امكان مقام خاخامباشي الطائفة ان يحسم هذه القضية فلا مناص لي من مراجعة
حكومتنا الجليلة لاحقاق حق صريح كثيرا ما تلاعبت به غايات شخصية بصرف امرها الخاص
والعام ولكم الامر سيدي .

اشارة الى كتابكم رقم ع/٩/٨٢٧ بتاريخ ٢٧ ايار ١٩٢٨
يتضح من سير الدعوى التي كانت مبسوطة في المحكمة الروحانية ان المدعو الياهو بن عزرا كان قد آوى زوجته مصطلحا معها بتاريخ ٢٦ آب عبري من سنة ٥٦٨٧ وقد رزقت مولودا بتاريخ ١٥ شباط عبري ٥٦٨٨ وذلك حسب اقرار المدعي فمما يجب ذكره هنا ان الشريعة الموسوية نصت :
١) ان المولود الذي تكون مدة حمله سبعة اشهر هو مولود شرعي لابويه .
٢) ان السبعة اشهر المحسوبة يدخل ضمنها شهر الاجتماع وشهر الولادة بغض النظر عن مقدار ايام هذين الشهرين ولزيادة الايضاح نضرب مثلا القضية المبسوطة البحث فالزوج الياهو اجتمع بامرأته في ٢٦ آب وولدت المرأة في ١٥ شباط لذلك فاذا اردنا تعيين عمر المولود يجب ان نعد آب ايلول تشرين كسلير طيبيث شباط فيكون عمر الابن سبعة اشهر وهو ابن شرعي لابويه
فبعد الاطلاع على ما ذكرناه واستنادا على النصوص الشرعية اعتبرت المحكمة الروحانية ان الابن شرعي لابويه

لقد ادعى الزوج الياهو بن عزرا القندرجي ان زوجته ليمة بنت الياهو قد ولدت
بعد حمل يعتبره ناقصا ولذا يطلب تحريم زوجته واثبات عدم مشروعية المولود وبعد المرافعة
الوجاهية ومراجعة النصوص الشرعية لم تر المحكمة الروحانية مبررا لادعاء الزوج لذلك حكمت

اولا جلب المزورة لبيبه بنت الياهو زوجة المستدعي والاستفسار منها عن
تاريخ اول اجتماع بها انتج الحمل والولادة واخبارنا بذلك باقرب وقت ؛
