This court was approached by the President of the Jewish Community in Baghdad, Hajj Rashid Mahdi Al-Saffar, Hajj Naji Alwan, and Hajj Mahdi Hussein Haidar with their request dated
on 24/4/948, and they presented the submitted petition stating that the plot of land numbered in Al-Saadoun neighborhood, sequence 147/47, is an endowment (waqf) and registered immediately for the endowments of
charity therein, and that the President of the Community is the trustee over it, and that the owner of the adjacent plot of land with sequence 171/144 has built his house by mistake on a part of
the land taken as sequence 147/47 with an area of 84/61 square meters instead of plot sequence 171/144, and because the owners of plot sequence 144/172
have built their house on the plot numbered 171/144, the plot numbered 172/144 with an area of 106 square meters has remained vacant until now, which
indicates the good faith of the neighbors. The President of the Community, in his capacity as supervisor and trustee of the aforementioned charities, requested the subdivision of plot sequence 147/47 into two parts and the replacement of
the plot on which his neighbor Rashid Mahdi Al-Saffar built with the vacant plot numbered 172/144. The owner of plot numbered 171/144 also agreed to exchange
his plot with the owner of plot 172/144, and the President of the Community requested the issuance of a ruling for the exchange in the manner mentioned above. Upon conducting the inspection, it was found that Rashid
Mahdi Al-Saffar, owner of plot 171/144, had mistakenly built his house on a part of the endowment plot belonging to the charity, sequence 147/47, with an area of 84/61 square
meters, thinking it belonged to him. Likewise, Naji and Alwan, sons of Hussein Haidar, owners of plot 172/144, had built their house on Rashid Mahdi Al-Saffar's plot
sequence 171/144, thinking it belonged to them, and plot numbered 172/144 remained vacant of any building. The result of the ongoing inspection showed that this
exchange is not harmful to the rights of the Jewish Community endowment, as the area of the two plots is almost equal, the location is the same, and the value of the two plots is equal.
Accordingly, and based on the joint request submitted to this court by the President of the Community and the aforementioned neighbors, the court decided to grant permission for the exchange
in the manner mentioned above, and it was issued on 26/5/1948 AD.
