Dear Sir,
I duly received your letters of the 17th April and 30th June last.
I also received on the 6th instant another letter bearing no date and
signature.
I have already selected five out of the several institutions in
Baghdad applying for a share in the legacy left by the late Mr. R.A.Gubbay
and in this act of selection I have been guided by the recommendations of the
Presidents of the Jewish Community and the Jewish Day Council of Baghdad and
of Mr. D.J.Cohen of Calcutta. I am not therefore now in a position to do
anything to change the allotment already made. As you are aware, I have
allotted Rs.80,000/- for the Midrash Talmudtora. You should better apply to
these Presidents for a share in the above sum for the Midrash of Kift. I am
sending a copy of this letter to these Presidents.
As soon as permission is available from the Exchange Control
Department here, the remittances will be made.

With respect,
It is no secret to you that in the Al-Kifl sub-district, which is considered one of the sectarian affairs in
the Baghdad Governorate, there is a (Midrash Talmud Torah) established since ancient times by the late
Aaron Gabbay, as confirmed by the writing engraved on the stone placed in the structure of the mentioned Midrash.
Therefore, a portion of the bequest of the late Raphael Aaron Gabbay—the son of Aaron Gabbay, the founder of the aforementioned
Midrash Talmud Torah—belongs to the Midrash Talmud Torah located in the mentioned Kifl.
The bequest allocated for the Midrash Talmud Torah in Baghdad amounts to eighty thousand rupees. We have contacted the
official executor in Bengal and also the British Consul in Baghdad to determine a share of the amount of the
mentioned bequest <del>⟦illegible⟧</del> for the Midrash in Kifl. He replied that we should refer to the Chairman of the Midrash Talmud Torah Committee in
Baghdad, who received the Midrash Talmud Torah's share of the mentioned bequest amount. We hope that you will look
into this matter and take note of the severe need of the aforementioned Kifl Midrash Talmud Torah. Especially
since it is among the charitable legacies of the father of the late Raphael Gabbay, the testator, so please allocate a
sufficient amount for it to rely upon in continuing the teaching of ( ⟦Torah and Fear of Heaven⟧ ) to our community's children
in the Kifl sub-district, so that the charitable legacy of the founder, the father of the testator, is not erased. We believe
that by virtue of your spiritual position, you will appreciate this task as it deserves and designate a sufficient amount
for it. May you remain in peace.

Decision of the Lay Council regarding the estate of the late Raphael Gabbay, taken on March 29, 1942
After reviewing the correspondence concluding with letter No. 1240, dated January 30, 1942, a copy of
which was received by the Lay Council from the Official Trustee of Bengal in Calcutta (India) regarding the estate of
the late Raphael Haron Gabbay, who died in Calcutta, and after hearing the explanations of the President of the Lay Council, who
is one of the members of the Advisory Committee appointed by the aforementioned Official Trustee to provide advice on this matter,
the Council has determined the following:-
1 -- That the late Raphael Haron Gabbay, who died in Calcutta on November 27, 1922, had bequeathed
a portion of his estate to the Jewish charitable institutions in Baghdad and entrusted the execution of this will to the Official
Trustee of Bengal in Calcutta, who agreed at the time to the proposals submitted to him by the lawyer M. Laniado, who
was appointed by the Lay Council by its decision taken on December 17, 1940, which was the appointment of an advisory committee
in Baghdad composed of His Eminence Rabbi Sassoon Khedhouri, President of the Community, and Mr. Eliyahu Hayim Tawfiq, President
of the Lay Council on behalf of the Lay Council, and Mr. Meir Hakham Moshe Doctor, President of the Hospitals Committee on behalf
of the hospitals, and Mr. Meir Etta, Secretary of the Schools Committee on behalf of the schools, and Messrs. Ibrahim Hayim Hakham Isaac, Yehuda
Salih Zeloof, and Menashi Salih Shlomo Daoud from the notables, to provide him with the necessary advice for nominating the Jewish
charitable institutions in Baghdad that meet the conditions stipulated in the will and which are most deserving and in need
to benefit from the estate, and on the method of distributing the amount of the estate among them.
2 -- Pursuant to the recommendations submitted by the aforementioned committee, the Official Trustee sent the following checks with the letter
referred to above as follows:-
1 -- Check No. 208 dated 1/30/1942 for the amount of 200,000 rupees to the order of the President of the Jewish Lay Council
of the Jewish Community and the President of the Jewish Hospitals Committee for Meir Elias Hospital.
2 -- Check No. 209 dated 1/30/1942 for the amount of 93,000 rupees to the order of the President of the Jewish Lay Council
of the Jewish Community and the President of the Jewish Schools Committee for Nuriel Primary School for Boys.
3 -- Check No. 210 dated 1/30/1942 for the amount of 80,000 rupees to the order of the President of ⟦the Council⟧ the persons mentioned
in paragraph 2 above for Midrash Talmud Torah School.
4 -- Check No. 211 dated 1/30/1942 for the amount of 20,000 rupees to the order of the persons mentioned in paragraph 2 above
for Rachel Shahmoon Primary School for Boys.
5 -- Check No. 212 dated 1/30/1942 for the amount of 7,330 rupees to the order of the persons mentioned in paragraph 2 above
for Menahem Salih Daniel Primary School for Girls.
3 -- Following the receipt of these checks, the Lay Council held several meetings with the Hospital and School Committees,
during which the current financial relations between the Council and the aforementioned institutions were discussed, as well as the financial state of the Council
and the current global circumstances that leave no room for spending the bequeathed money on the aforementioned institutions, and an
agreement was reached between the Council and the two mentioned committees on the following:-

C - That the Rifqa Nuriel School be loaned a sum of three thousand and four hundred Dinars at an interest rate of three
and a half percent annually, provided that the principal of the debt along with its interest is paid off in annual installments, each
amounting to one hundred and fifty-five Dinars for a period of thirty-five years.

included you in the distributions, and that the selection be made from among
the list of institutions attached to the aforementioned letter, which
