4) And from reviewing the decision of the Lay Council taken on December 17, 940, it appeared to the Council
that the agreement was made at the time with the lawyer Mr. M. Theodore that the legal fees

I have the honour to refer you to your letter No. 1286 of the 5th
July and its enclosures. 24/1/18
I have accepted the selection of the five Jewish Charitable Institutions
in Bagdad as made by the Presidents of the Jewish Community and the Jewish Lay
Council, to share the bequest made by the testator the late Mr. R.A.Gubbay of
Hongkong to the Jewish Charitable Institutions in Bagdad.
I send herewith five receipts and five crossed cheques, as under, drawn
by me on the Imperial Bank of India, Calcutta.
(1) Cheque No. 208 dated 30/1/42 for Rs.2,00,000/- (Two lacs) in favour of
the President of the Jewish Lay Council of the Jewish Community of Bagdad and
the President of the Committee of the Meir Elias Hospital. (For Meir Elias
Hospital).
(2) Cheque No. 209 dated 30/1/42 for Rs.93,000/- (Ninetythree thousand) in
favour of the President of the Jewish Lay Council of the Jewish Community of
Bagdad and the President of the Jewish Schools Committee. (For Nouriel Elemen--
tary School for Boys).
(3) Cheque No. 210 dated 30/1/42 for Rs.80,000/- (Eighty thousand) in favour

For this reason, and in confirmation of the agreement reached between us, we present to your esteemed Council a check on the Ottoman Bank
in the amount of five thousand five hundred Dinars, numbered 308001 and dated March 23, 942. From
this amount:
1 - One thousand nine hundred and sixty Dinars (1960) from the original amount received to be spent on the Midrash
Talmud Torah school in Baghdad as follows:

Copy of the resolution of the Lay Council regarding the Gabbay estate
After reviewing the correspondence ending with letter number 1240 dated January 30, 1942
a copy of which was received by the Lay Council from the Official Trustee of Bengal in Calcutta (India)
concerning the estate of the late Raphael Haron Gabbay who died in Calcutta, and after hearing the explanations of the President
of the Lay Council, who is a member of the Advisory Committee appointed by the aforementioned Official Trustee
to provide advice on this matter, the Council noted the following:-
1) That the late Raphael Haron Gabbay, who died in Calcutta on November 27, 1922, had bequeathed
a portion of his estate to the Jewish charitable institutions in Baghdad and entrusted the execution of this will to
the Official Trustee of Bengal in Calcutta, who agreed at the time to the proposals presented
to him by the lawyer M. ⟦Linhado⟧, who was appointed by the Lay Council by its resolution taken on December 17,
1940, which included appointing an advisory committee in Baghdad consisting of His Eminence Rabbi Sassoon Khedouri,
President of the Community, and Mr. Eliyahu Hayim Tawfiq, President of the Lay Council, representing the Lay Council, and Mr.
Meir Hakham Moshe Doctor, President of the Hospitals Committee, and Mr. ⟦Moritz Ita⟧, Secretary of
the Schools Committee, representing the schools, and Messrs. Ibrahim Hayim Hakham Isaac, Yehuda Saleh Zeloof, and Menashi
Saleh ⟦Lumo⟧ Daoud from the notables, to give him the necessary advice for nominating the Jewish charitable institutions
in Baghdad that meet the conditions stipulated in the will and which are most deserving and in need of benefiting
from the estate, and on how to distribute the amount of the estate among them.
2) Pursuant to the recommendations submitted by the said committee, the Official Trustee sent the following checks
with the letter referred to above as follows:-
1 - Check No. 208 dated 1/30/1942 for the amount of 200,000 rupees to the order of the President of the Jewish Lay Council
of the Jewish Community and the President of the Jewish Hospitals Committee for the Meir Elias Hospital.
2 - Check No. 209 dated 1/30/1942 for the amount of 93,000 rupees to the order of the President of the Jewish Lay Council
of the Jewish Community and the President of the Jewish Hospitals Committee for Jewish Schools,
to the Nuriel Primary School for Boys.
3 - Check No. 210 dated 1/30/1942 for the amount of 80,000 rupees to the order of the persons mentioned in
paragraph 2 above for the Midrash Talmud Torah School.
4 - Check No. 211 dated 1/30/1942 for the amount of 20,000 rupees to the order of the persons mentioned in
paragraph 2 above for the Rachel Shahmoon Primary School for Boys.

6 - Likewise, the contents of the letter numbered and dated March 24, 942, received by the Council from the
Schools Committee, stating that the revenues of the Talmud Torah schools for the fiscal year ending on the last
day of September 942 and for the three years following it ending on the last day of
September 1945, including the loan amounts that will be returned to the schools' fund during the four mentioned years
as stated in the committee's letter dated March 24, 942, and numbered, will be
sufficient to cover the expenses of the ⟦and the board⟧ schools during that period. Accordingly, we agree to suspend the payment of the usual annual allocations
to the Talmud Torah schools' fund for each of the four years ending on the last
day of September 945.

Sir,
I have the honour to refer you to your letter No.1286 of the 5th
24/1/18
July and its enclosures.
I have accepted the selection of the five Jewish Charitable Institutions
in Bagdad as made by the Presidents of the Jewish Community and the Jewish Lay
Council, to share the bequest made by the testator the late Mr. R.A.Gubbay of
Hongkong to the Jewish Charitable Institutions in Bagdad.
I send herewith five receipts and five crossed cheques, as under, drawn
by me on the Imperial Bank of India, Calcutta.
(1) Cheque No. 208 dated 30/1/42 for Rs.2,00,000/- (Two lacs) in favour of
the President of the Jewish Lay Council of the Jewish Community of Bagdad and
the President of the Committee of the Meir Elias Hospital.(For Meir Elias
Hospital).
(2) Cheque No. 209 dated 30/1/42 for Rs.93,000/- (Ninetythree thousand) in
favour of the President of the Jewish Lay Council of the Jewish Community of
Bagdad and the President of the Jewish Schools Committee.(For Nouriel Elemen--
tary School for Boys).
(3) Cheque No. 210 dated 30/1/42 for Rs.80,000/- (Eighty thousand) in favour
of the persons as in (2). (For Midrash Talmud Torah).
(4) Cheque No. 211 dated 30/1/42 for Rs.20,000/- (Twenty thousand) in favour
of the persons as in (2). (For Rahel Shahmoon Elementary School for Boys).
(5) Cheque No. 212 dated 30/1/42 for Rs.7330/- (Rupees Seven thousand thr⟦ee⟧
hundred and thirty) in favour of persons as in (2). (For Menahem Saleh Danie⟦l⟧
Elementary School for Girls).
I shall be much obliged if you will kindly make these payments on my
behalf by handing over the cheques to the respective proper party in exchange
for the respective receipts duly signed by the payees. As soon as payments have
been made, please return the receipts to me as vouchers for my record. I am
sending a copy of this letter to the payees and also advising them by cable.
In the meantime please acknowledge receipt hereof.
I enclose a copy of the Exchange Central Department letter No.CA.E.C.
20077/129 of the 13th December 1941 sanctio⟦n⟧ing these remittances.
