We are sending you herewith a document signed by the President
of the Jewish Community & the President of the Jewish Lay Council and
other representatives of the Jewish Charitable Institutions of this city
recommending the most prominent and deserving institutions of our Community
to benefit from the bequest of the late R.A. Gubbay.
We shall be much obliged if you will kindly hand over to above
document personally to the Official Trustee in order to get his consent
for an early remittance of the amount.
The document is annexed to an affidavit signed by the President
of the Jewish Community before the British Consul and attested by him.
We understand that in addition to that the British Consul is
going to send a special letter to the Official Trustee recommending the
institutions mentioned in the above document in order to urge the remitt-
ance.
A second copy of the above document also signed and sworn before
the British Consul will be forwarded to the Official Trustee with Mr. M.
Laniado, Advocate who is trying to return to Calcutta for this object. In
case Mr. Laniado will not be able to proceed to India he will send this
copy too to yourself.
Mr. Laniado informed us that you are willing to act on behalf of
our Community and our institutions for which we thank you.
We ask you to be so kind as to wire to us after seeing the
Official Trustee and in generally keep us informed please, by sending us
your informations or instructions by cable on our own expenses with a copy
of each telegram to Mr. M. Laniado, Advocate Ben-Yehuda St. Jerusalem.

Copy of the letter of the Official Trustee of Bengal
No. 3741 dated 27th March 1941.
Dear Sirs,
I am in receipt of your letter of the 18th March handed over to me
by Mr. M. Laniado, advocate of Jerusalem.
I am prepared to follow the same system for distribution of the
Baghdad Charities as was agreed to by Mr. Morgan, my predecessor in
office, for distribution of the Jerusalem Charities.
I also approve of the proposed Committee and of its personnel. As
suggested the Committee should get the recommendation of the British
Consul in Baghdad.
It has been held that selection should be made out  of those
Institutions which were in existence at the time of death of the
testator R.A.Gubbay, who died on the 27th November 1922 and that
synagogues are not to participate in distribution of the fund meant
for Jewish Charitable Institutions.   I give below a list of the Jewish
Institutions in Baghdad from which applications were received up to
31st August 1938 ( the last date advertised for receiving applications)
Selection should be made out of these Institutions having regard to
what has been said above.
I hold the following funds for the Jewish Charitable Institutions
in Baghdad:-
5% Loan of 1945-55 for Rs 2,91,400/-(face value)
3% Defence Bonds of 1946 for Rs 65,700/- ( face value)
Cash balance               Rs 837-12-1
The value of the funds is calculated as follows:-
5% Loan of 1945/55 for Rs 2,91,400/- @ Rs 111-14-0% Rs ⟦3⟧,26,003-12-0

we beg to bring to your notice that a sum of about £.30 000- has
been left by the late Raphael Aaron Gubbay of Calcutta for the Jewish
Charitable Institutions of Baghdad.
The bequest is now in the hands of the Official Trustee of Bengal
(1. Council House Street Calcutta.) who is willing to remit the amount
to the Jewish Institutions of this city which might be recommended by
a Committee representing the Community and the Jewish Institutions.
The saim Committee after having been approved by the Official Trustee
decided to recommend.
1. The Meir Elias Hospital.
2. The Midrash Talmud Tora (School)
3. The Nouriel Elementary School for boys.
4. The Rahel Shahmoon Elementary School for boys.
5. The Menahem Saleh Daniel Elementary School for girls.
The above institutions are the most prominent institutions of the
Jewish Community of Baghdad.
We shall be much obliged if you will kindly support our our re-
commendations or give us a separate letter of recommendation to the
Official Trustee of Bengal, Calcutta, recommending the said institut-
ions.
Your help will be a great assistance to the Jewish Population of
this city for which we all thank you in anticipation.

Dear Sir:-
I am in receipt of your letter enclosing copy of a letter d/-
23rd. June 1941, addressed to the Official Trustee of Bengal.
I had seen Mr: Moore and discussed the matter with him. He
has agreed to accept the recommendations contained in your letter
except so far as the surplus money is concerned. There will be a
surplus as interest has accumulated and the Scrips are higher in price
now. He has decided to give the entire surplus to the Menahem Saleh
Daniel Elementary School for Girls. I trust this will be satisfactory
to you.
I had in this connection sent you a cable d/- 24th. July 1941
reading as follows :-
"Official Trustee accepted your recommendation
except surplus given to Girls School. Money
being remitted Consul General for payment to
respective Institutions".
I had also sent Mr: Laniado a cable in reply to his cable
reading as follows :-
"Trustee accepted recommendations except
surplus for Girls School. Baghdad informed".
The cost of the cables are Rs. 10/- and Rs. 6/8/- respectively and the
Air Mail charges for this letter and a similar letter to Mr: Laniado
are together Rs. 2/2/- totalling Rs. 18/10/- (Rupees Eighteen and
annas Ten only) due to me.
Kindly remit me this amount and oblige.

I beg to inform you that I have received a telegram from M⟦e⟧.D.J.Cohen of Calcutta
reading as follows:- TRUSTEE ACCEPTED RECOMMENDATIONS EXCEPT SURPLUS FOR GIRLS SCHHOL
BAGHDAD INFORMED.-  COHEN . This was a reply to a telegram I sent to him.
I understand that you have also received a telegram  giving you the same
details and am realy astonished why you have n<del>o</del>t informed me the content of your cable
in due time in order to decide the matter together.
I do not know if you have already answered the cable of Mr. Cohen and what
have you proposed to him.
Mr. Cohen did not mention the reason of not accepting the recommendation of
the 7000.- Ruppes devoted to the Menahem Saleh Daniel School for Girls,it may be for the
reason that the Institution is not an old one and it has been established only a short
time before <del>that</del> the death of the Testator or approximately at the death of the Testator
and it may be that the Trustee does not like to give small amount which will be spent
immediately without keeping anything in memory of the deceased..
Now you have to send a cable to the official Trustee with reference to the
cable received from Mr. Cohen proposing that the surplus be divided among the other
Institutions recommended and accepted asking in the same cable to remit you the sum by
airmail.
You have also to send a similar cable to Mr.David J . . Cohen , 6 Mangoelahe
proposing the same proposal that the surplus of about 7000<del>0</del>-/ (seven thousand Rupees)
be divided propotionally among the other instituions .
The cheques and the receipts in question will be forwarded to the British
Consul to be delivered to you.
I hope that you have already cabled to the Official Trustee and to
Mr. Cohen and you have already thought about this solution yourselves.If this is so
you have only to urge the matter by sending always cables to Mr. Cohen and to the Trustee
as we have done in the matter of Jerusalem.
From the date of my return here,I am in bed as I am suffering of an
attack of rheumatism and cannot leave my house. The whole this time I could not go to
my Office.This week I am better and I hope to go to my office very shortly.

His Excellency the President of the Jewish Lay Council in Baghdad, Respected
Greetings. -
It is not hidden from your Excellency the great charitable work that our association
"Ozre Dalim" has been and still is performing in aiding and assisting the needy and the poor among the members of our community
in Baghdad, especially those families afflicted by time in their livelihood and who cannot extend
their hands to beg or ask for charity; dozens, rather hundreds of these families have been and still are
receiving weekly assistance from our association as allowed by its financial resources, which consist -
primarily of subscriptions from some benefactors among the members of our community.
However, the grave catastrophe that befell the members of the community during the unfortunate events of June 1 and 2,
1941, has doubled the responsibility placed on our association for two reasons.
First - because this great catastrophe added hundreds more families to the list of those in need
of urgent assistance, as they were stricken in their livelihoods and lost all the worldly possessions they owned.
Second - because a large number of our association's subscribers, upon whose help we relied, were themselves stricken and looted
and became in need of assistance from our association, which greatly increased our moral
and material responsibility.
Therefore, we have sent this letter to your Excellency on the occasion of the arrival of Indian donations, requesting that you take into account
the status of our association, which you must surely consider one of the oldest charitable institutions serving the community,
and allocate a sufficient amount to it so that it may continue performing its important service to society.
Awaiting the decision of your esteemed council on this matter, please accept my abundant thanks and respect.

for your kind assistance in this connection.
As the money has not yet reached us, we would be much obliged
if you would kindly emphasise to the Official Trustee the urgency of
the help needed by our various institutions, and obtain an early remit
ttance of the money .
Enclosed please find a cheque on the National Bank of India for
Rs.18.10.0 being the cost of cables & postage incurred for which kindly
acknowledge receipt.

the 25th of last regarding the estate of Rael Gubbay and we thank you

Dear Sir
I beg to inform you that I have cabled last week twice to Calcutta
to Mr. David J. Cohen regarding the Fund of the late R.A.Gubbay and asked
him to expedite the remittance of the bequest to Baghdad. I reply to my
cables I received yesterday the following cable from Mr.D.J.Cohen :-
" Advocate Meir Laniado, Jerusalem. Your cables received. Delay owing
Reserve Bank permission refused,as Iraq not now entered Sterling Block.
Bank expects entry later. Signed : David J.Cohen.
It is clear from the above cable that a special permit is necessary
to be obtained from the Reserve Bank of India who is the authorised dealer
appointed by the government of India to grant such permission,on behalf of
Controller of Foreign Exchange .
Here in Palestine too,a special permission is necessary to transfer
any sum of money to Baghdad,and I suppose that such permission could be
obtained from the government of India.
In my opinion the best way to get a special permission is to have
a recommendation from the British Ambassador of your city explaining the
object of this money which is devoted for charity to the Jewish Institutions
of your city. I suppose it would not be difficult for your Community to
obtain such a recommendation,as otherwise all your institutions would not be ab
able to continue their existence,so the Community has to act very prompt ly

Summary of conditions under which deferred foreign telegrams are accepted
1 - Deferred foreign telegrams are sent according to the foreign telegram regulations published in the Iraqi Post and Telegraph Guide.
2 - The fee for this telegram is half of the fee charged for an ordinary foreign telegram.
3 - It is not permitted to use more than one language in writing the body of this telegram.
4 - The sender of the telegram undertakes, by signing the face of this form, that its body is written entirely in plain language and does not convey any other meaning than what it indicates.
5 - The sender of the telegram must record in the space provided on the left side of the address on the face of the form, his desire to send the telegram via any of the
telegraph routes used, or that the fee for its reply is prepaid. If the telegram is for the interest of the Iraqi government, the word (Official) shall be recorded.
6 - The Iraqi Post and Telegraph Administration shall not be responsible for delay, error, loss, or damage that may occur to the telegram due to its non-transmission or non-delivery, failure to
send or distribute.
7 - The Iraqi Post and Telegraph Administration has the right to refuse to register the telegram. It also has the right not to send it even if it has been registered for transmission or distribution. In
this case, its fee is returned to the sender upon submission of a request for that.
8 - Requests related to the refund of fees and all complaints about telegrams shall be submitted to the Directorate General of Posts and Telegraphs in Baghdad.
9 - To prevent the occurrence of mistakes, this telegram should be written carefully and clearly.

Conditions on which Deferred Foreign Telegrams are accepted
1. Deferred Foreign Telegrams are forwarded in accordance with the rules for Foreign Telegrams published in the 'Iraq
Post and Telegraph Guide.
2. The rate of this telegram is half that charged for Ordinary Foreign Telegram.
3. The use of more than one language in the text of this telegram is not allowed.
4. The sender, whose signature on this form, declares that the text is entirely in plain language and does not bear any mean
ing other than that which appears on the face of it.
5. The sender may write the instructions, in the space provided, at the left side of the address, on the face of this form
such as Route, Reply Paid, or State if on 'Iraq Government Service.
6. The Administration of Posts and Telegraphs, 'Iraq, shall not be liable to make compensation for any delay, error, loss,
injury or damage arising from omission, non-transmission or non-delivery of the telegram.
7. The Administration of P. & T., 'Iraq, may decline to accept the telegram. It may also decline to forward it although it
has been booked. In such case the amount paid for transmission shall be refunded to the sender on application.
8. Complaints and applications for refund should be addressed to the Directo⟦r⟧ of Posts and Telegraphs, Baghdad.

for which I thank you.
The money has not yet been remitted as the
Reserve Bank has refused permission due to Iraq not
entered at present into Sterling block. I am told
before very long this is expected to be done when the
Official Trustee will be able to remit.

So I thank you. The money has not been transferred yet because the Reserve Bank refused permission given that Iraq
has not joined the Sterling area at the present time. I have been told that this is expected to happen
before a very long time has passed when the Official Trustee will be able to transfer

Conditions under which telegrams are accepted

Remittance to Bagdad.
With reference to your letter No.9994 of the 13th. instant,
we have to advise that even though a rupee cheque would be issued by
you this would involve a remittance of foreign exchange from India and
as Iraq is outside the sterling area, application for permission ⟦should⟧
properly have been made through an authorised dealer in foreign ⟦line⟧
exchange.
2. Please note that the present regulations do not allow the
remittance as the transaction constitutes a transfer of capital to a
non-sterling area country. It is, however, probable that at a later
date Iraq will be readmitted to the sterling bloc and we suggest that
you should postpone for the present the distribution of the assets
under the will. Meanwhile we would be prepared to allow remittance ⟦of⟧
income of the Trust.
