Dear Sirs,
I am in receipt of your letter of the 18th March handed over
to me by Mr. M. Laniado, advocate of Jerusalem.
I am prepared to follow the same system for distribution of
the Bagdad Charities as was agreed to by Mr. Morgan, my predecessor in
office for distribution of the Jerusalem Charities.
I also approve of the proposed committee and of its personnel.
As suggested the committee should get the recommendation of the British
Consul in Bagdad.
It has been held that selection should be made out of those
Institutions which were in existence at the time of death of the testator,
R.A. Gubbay, who died on the 27th November 1922, and that synagogues are
not to participate in distribution of the fund meant for Jewish Charitable
Institutions. I give below a list of the Jewish Institutions in Bagdad
from which applications were received upto 31st August 1938 (the last date
advertised for receiving applications.) Selection should be made out of
these Insitutions having regard to what has been said above.
I hold the following funds for the Jewish Charitable Institutions
in Bagdad:-
5% Loan of 1945-55 for Rs.2,91,400/- (face value)
3% Defence Bonds of 1946 for 65,700/- (face value)

The value of the funds is calculated as follows:-

I received your letter dated 18 March, which was delivered to me by Mr. M. Laniado, the lawyer in Jerusalem, regarding the distribution of the
Baghdad share; I am prepared to follow the same method that my predecessor in office had followed for the distribution of the
Jerusalem share.
I also agree to the proposed committee and its members. As per the proposal, the committee requires the recommendation of
the British Consul in Baghdad.
It is stipulated that the selection must be from among those institutions that were existing at the time of the death of the <del>petitions</del>
testator R. A. Gabbay, who died on 27 November 1922, and that synagogues are not to participate in the distributions
allocated to Jewish charitable institutions.
I set out below the list of Jewish institutions in Baghdad whose petitions I received until 31 August 1938
(which is the deadline set for accepting petitions) and the selection must be made from among these institutions, taking into ⟦account⟧ what was mentioned
above.
I hold the following amounts for the Jewish charitable institutions in Baghdad:

There is no doubt that the charitable works achieved by the Association for the Relief of Nursing Mothers since its formation
until now are not hidden from your esteemed committee, and expanding the scope of these works and achieving the goals
of the association by providing effective aid to poor nursing mothers depends on the assistance of people of benevolence.
Since the late Raphael Gabbay bequeathed his estate to Israeli charitable institutions, and our association
is among the institutions intended by this will, we ask your excellency to kindly draw the attention of the

The Advisory Committee for the estate of the late Raphael Gabbai met on Sunday evening, June 22, 1941
And decided the following:
After reviewing the letter numbered 3741 dated March 27, 1941, received from the Official
Trustee of Bengal in India addressed to the Presidency of the Community and the Presidency of the Lay Council,
this committee found that the mentioned Official Trustee has stipulated that the institution to which a share
of the estate is allocated must have been existing at the time of the death of the testator, the late Raphael Aaron Gabbai, who died on November 27,
1922, and that it must not be one of the synagogues, and that the selection be made from among the institutions mentioned
in the list attached to the said letter, which are those institutions whose petitions reached the hand of the Trustee
up to August 31, 1938.
It also appeared to the committee from the mentioned letter that the amount of the bequeathed estate reached, until the date
of the mentioned letter, 400,647.12.1 Rupees, which is approximately 29,900 Pounds Sterling.
Accordingly, and in view of the reasons explained above, it has become necessary
to reconsider the decisions taken by the committee on April 16, 1941, when
these conditions were not known to it due to the late arrival of the numbered letter after those decisions were issued.
After deliberation, it found that the following institutions were existing at the time of the testator's death and are still
performing useful services to the community until now, and they are in the greatest need of assistance. Therefore, it decided
to distribute the bequeathed amount as follows:-

This letter is being sent to you after having seen
Advocate Mr.Labiado who just returned from India and gave us your
instructions as specified in your letter of the 27th March, 1941.
We recommend that the share of Baghdad of the above
bequest be divided to the Jewish Charitable Institutions of Baghdad
mentioned hereafter as follows:-

hereabove, we beg to deduct or add the difference to the institution
Nouriel Elementary School for boys.
All the institutions above are old institutions which
have been founded before many years and which have been in existence
at the time of death of the deceased the late Raphael Haron Gabbay, who
diedon 27th Novr. 1922.
They, actually exist and give a great assistance to
the Jewish population in Baghdad. None of them is a synaguogue, but all
are actual charitable institutions and their charity extends to the needy
population of this Community. All ofthem have as a rule an annual
budget. They are also supervised by the Jewish Lay Council and
administered by special committees appointed by the said Council.
The situation of the above institutions recommended by
us requires an immediate remittance in order to carry on their valuable
functions, and we shall be very much obliged if you would treat this case
as in urgent one.

Our request is <del>⟦illegible⟧</del> that the cheques which have to be
sent be drawn on any Bank in India in Rupees, as this will facilitate
us to cash the cheques sooner than a cheque in Pounds Sterling drawn
on a London Bank. You may send us your cheques signed by yourself ( in
your capacity as official Trustee) drawn on your Bank in India.
We shall be obliged if you will make the cheques for the
above institutions as follows:-
1 - For the "Meir Elias Hospital to the Order of:-

re: R.A.Gabbay's Bequest.
This letter is being sent to you after having seen Advocate Mr. Labiado who just returned from India and gave us your instructions as specified in your letter of the 27th March, 1941.
We recommend that the share of Baghdad of the above bequest be divided to the Jewish Charitable Institutions of Baghdad mentioned hereafter as follows:-

In case the amount is more or less than this mentioned hereabove, we beg to deduct or add the difference to the institution Nauriel Elementary School for boys.
All the institutions above are old institutions which have been founded before many years and which have been in existence at the time of death of the deceased the late Raphael Haron Gabbay, who died on 27th Novr. 1922.
They, actually exist and give a great assistance to the Jewish population in Baghdad. None of them is a synagogue, but all are actual charitable institutions and their charity extends to the needy population of this Community. All of them have as a rule an annual budget. They are also supervised by the Jewish Lay Council and administered by special committees appointed by the said Council.
The situation of the above institutions recommended by us requires an immediate remittance in order to carry on their valuable functions, and we shall be very much obliged if you would treat this case as in urgent one.

Our request is <del>an urgent one</del> that the cheques which have to be
sent be drawn on any Bank in India in Rupees, as this will facilitate
us to cash the cheques sooner than a cheque in Pounds Sterling drawn
on a London Bank. You may send us your cheques signed by yourself ( in
your capacity as official Trustee) drawn on your Bank in India.
We shall be obliged if you will make the cheques for the
above institutions as follows:-

re - R. A. Gubbay,
We are sending you herewith a document signed by the President
of the Jewish Community & the President of the Jewish Lay Council and
other representatives of the Jewish Charitable Institutions of this city
recommending the most prominent and deserving institutions of our Community
to benefit from the bequest of the late R.A. Gubbay.
We shall be much obliged if you will kindly hand over to above
document personally to the Official Trustee in order to get his consent
for an early remittance of the amount.
The document is annexed to an affidavit signed by the President
of the Jewish Community before the British Consul and attested by him.
We understand that in addition to that the British Consul is
going to send a special letter to the Official Trustee recommending the
institutions mentioned in the above document in order to urge the remitt-
ance.
A second copy of the above document also signed and sworn before
the British Consul will be forwarded to the Official Trustee with Mr. M.
Laniado,Advocate who is trying to return to Calcutta for this object. In
case Mr. Laniado will not be able to proceed to India he will send this
copy too to yourself.
Mr. Laniado informed us that you are willing to act on behalf of
our Community and our institutions for which we thank you.
We ask you to be so kind as to wire to us after seeing the
Official Trustee and in generally keep us informed please, by sending us
your informations or instructions by cable on our own expenses with a copy
of each telegram to Mr. M. Laniado, Advocate Ben-Yehuda St. Jerusalem.
