called"the Settlor") of the one Part and THE PUBLIC TRUSTEE OF
RANGOON BURMA India(who and whose successors in Office are hereinafter
referred to as"the Sole Trustee")of the other Part:
WHEREAS the Settlor is desirous of placing in the hand of the
Trustee 3 1/2% India Government Stock of the nominal value of
35.000 Rupees the income of which is to be applied for the purposes of
the trust hereinafter mentioned and for the purposes of such trust
the Settlor will transfer immediately after the execution of these
presents into the name of the Trustee the said Stock and deliver to
the Trustee the scrip relating thereto NOW THIS INDENTURE WITNESSE⟦...⟧

to them the advantages of further and contined education and in
accordance with the stipulations and directions set out in the
Schedule hereto:
4. IF and when it shll happen that in the opinion of the Trustee
there are no boys available for the benefits of the trust hereby
created or if the payments in respect of the number of boys available
shall not exhaust the income of the Trust fund the Trustee shall
invest (subject to the stipulation and direction contained in the
Schedule) the unapplied or surplus income as the case may be at
the end of each year in Trustee Securities and add the same to
the said Trust fund with a view to increasing the capital thereof
and such unexpended income as may be added to Capital must never
be withdrawn and used as income:
5. The Trustee shall at the expense of the said Trust Fund or
the income thereof make all such applications as it may be necessary
to make out as he shall in his discretion think it advisable to
make for rapayment of any sums which may be recoverable in
respect of over-payments or deductions from interest or dividents

THE SCHEDULE ABOVE REFERRED TO
(a) The name of the Trust shall be "The Menashi Sadka Trust for
poor Jewish boys".
(b) The boys for whose benefit the Trust Fund shall be applied
shall be boys who have passed the sixth standard of the Jew's school
in Rangoon and who shall be accepted as fit for the 7th Standard
in any other school recognized by Government : University or College
in Rangoon or in any other part of the Province of Burma the object
of the trust fund being to enable such boys to contine their education
and to pass the Matriculation or Higher or other Examination or
Examinations as they may desire :
(c) If and whenever there shall be in the Jews' school at Rangoon
a higher standard than the sixth standard then the boys entitled to
the benefit of the Trust Fund shall have passed such higher standard
and be accepted for the next higher standard in any other Publicly
school in Rangoon or in the province of Burma.
(d) No boy shall be entitled to the benefit of the said Trust Fund
who shall fail to pass the qualifying examination for such school
recognized by Government University or College on two consecutive
ocacasions :
(e) The Trustee or Trustees for the time being of the Jews' school
in Rangoon shall decide which boys are eligible to benefit by the
said Trust Fund and in case any dispute shall arise between the
Trustees as to the eligibility of any such boy or boys such dispute
shall be decided by a vote of the Jewish Community of Rangoon whose
decision shall be final. The persons who shall vote shall be of
full age and of either sex :
(f) Any boy or boys who shall be selected for and who shall quality
for benefit of the said Trust Fund shall if the Trustee so determine
proceed to University but no more than 25 Rupees per annum shall
be expended upon any one boy in respect of books and stationery if
and when such boy shall be a pupil in a public school and not more
than 50 Rupees per annum shall be expended upon any one boy for
books and stationery when such a boy shall be a pupil in a College
or University . Such payments being in addition to all examination
and entrance fees and cost of ordinary School or College Tuition :
(g) If and when the income of the said Trust Fund shall not be
applied in manner herein contained for 10 consecutive years the
school of Jewish Boys in Rangoon shall entirely cease to benefit
by the trust hereby created and the Trustee shall not further
apply the income of the said Trust Fund for the benefit of such
boys : In place of such application the Trustee shall at the termina-
tion of the 11th year and each following years or at any other time
or times in such year and years as he shall determine remit the
income of the said Trust Fund to the Trustees of the Talmud Torah
School Baghdad, with a direction to such Trustees that they shall
apply the amount remitted for the purpose of teaching foreign languages
in such school : the receipt of two or more of such Trustees for
the amount so remitted to them shall be a sufficient discharge to
yhe Trustee :

من الجهة الثانية -
حيث ان الموقف راغب في ايداع الى المتولي اوراق مالية للحكومة الهندية ٣ ١/٢٪
ذات قيمة اسمية (٣٥٠٠٠ روبية) على ان يصرف ريعها لاغراض الوقفية المبينة ادناه او لاغراض
اي وقفية اخرى يوقفها الموقف مباشرة بعد توقيع الوقفية بأسم المتولي وتسليم الوثيقة المتعلقة بها
اليه والآن تعتبر هذه الوثيقة موثقة وتنص على ما يلي :
١ - يسلم الموقف الى المتولي مباشرة بعد توقيع هذه الوثيقة اوراق مالية للحكومة
الهندية ٣ ١/٢٪ بقيمة اسمية تبلغ خمسة وثلاثين الف روبية (٣٥٠٠٠ روبية) (وتسمى هذه الاوراق
المالية والمبلغ المودع الذي يمثل هذه الاوراق "بمال الوقف المذكور") ولغرض القيام بتحويل
هذا المبلغ سيوقع الموقف وينفذ كافة الاوراق والوثائق اللازمة بغية تقييد المال المذكور وقفا
بأسم المتولي وتخويله بحق التصرف بالغلة الناتجة منه .
٢ - على المتولي ان يبقى محتفظا بالمال الموقوف لغرض تخصيص غلته كما مبين فيما
يلي بالشروط والتوجيهات المبينة في الجدول المدرج ادناه وعند استحقاق الاوراق المالية
المذكورة للحكومة الهندية ٣ ١/٢٪ فعليه اعادة استثمار المال في اسهم مماثلة .
٣ - على المتولي ان يصرف الغلة المذكورة لتمكين الطلاب اليهود الفقراء من الاستمرار
في الدراسة والذين لا يمكن لا هلهم بسبب العوز من الصرف عليهم على ان يكون الصرف وفقا للشروط
والتوجيهات المبينة في الجدول المدرج ادناه .
٤ - في حالة حدوث انعدام الطلاب الفقراء المذكورين حسب رأي المتولي وذلك
لغرض شروط هذه الوقفية وفي حالة زيادة الغلة على المبالغ المتطلب صرفها على الطلاب المذكورين
ففي ذلك الحال على المتولي ان يستثمر (بموجب الشروط والتوجيهات المبينة في الجدول) زيادة

الغلة في نهاية كل سنة في اسهم مالية وان يضيف هذه الاسهم الى المال الموقوف بغية
زيادة رأس المال وعلى ان لا يسحب هذا المال المستثمر في اي حال من الاحوال لغرض
صرفه كغلة .
٥ ـ على المتولي ان يصرف لحساب الوقف اي مصاريف يراها ضرورية حسب تقديره
كضريبة الدخل والاسترجاعات والاستقطاعات المتعلقة بالوقف المذكور او اي ضريبة حكومية
اخــــــــــــــــرى .
٦ ـ تكون حسابات المتولي عرضة للتدقيق من الحكومة ويجب تجهيز اي صورة
مطلوبة للحسابات بعد استيفاء مصاريفها .
الجدول المذكور اعــــــــــــــــلاه
أ ـ يسمى المال الموقوف ( وقفية منشي صدقة للطلاب اليهود الفقراء )
ب ـ يشترط في الاولاد الموقوف هذا المال لمنفعتهم ان يكونوا ناجحين من الصف السادس
لمدرسة اليهود في رانكون والمعتبرين لائقين للقبول في الصف السابع ( معدل ) في
اي مدرسة اخرى معترف بها من الحكومة او في اي جامعة او كلية في رانكون او مقاطعة
اخرى من بورما اذ ان الغرض من الوقفية هو تمكين هؤلاء الطلاب من الاستمرار في
دراستهم وتأدية امتحان المتريكوليشن او اي امتحان او امتحانات اخرى ارقى كما يرغبون .
ج ـ في حالة حدوث مستوى ارقى من الصف السادس في مدرسة رانكون لليهود فيشترط في
الطلاب اللائقين للاستفادة من هذه الوقفية ان يكونوا قد نجحوا من هذا الصف وان يكونوا
مقبولين في الصف الاعلى في اي مدرسة عامة في رانكون او في مقاطعة بورما .
د ـ لا يمكن لاي طالب ان يستفيد من هذه الوقفية فيما اذا كان قد سقط في الامتحان
الذي يخوله للدخول الى المدرسة المذكورة المعترف بها من جامعة او كلية حكومية
في مناسبتين متعاقبتين .
هـ ـ ينتخب المتولي او المتولين لمدرسة اليهود في رانكون في الوقت الحاضر الاولاد اللائقين
للاستفادة من هذه الوقفية وفي حالة حدوث نزاع بين المتولين بخصوص انتخاب طالب
او طلاب لائقين للاستفادة من الوقفية المذكورة فيحسم هذا النزاع بتصويت من الطائفة
الاسرائيلية في رانكون والتي يكون قرارها بهذا الخصوص قطعيا . ويشترط في الاشخاص
المشتركين في مثل هذا التصويت ان يكونوا بالغين ومن الجنسين .
و ـ اي طالب او طلاب ينتخبون للاستفادة من هذه الوقفية يدخلون في الجامعة فيما
اذا قرر المتولي ذلك على ان لا يصرف لهم اكثر من ( ٢٥ روبية ) سنويا لغاية الكتب
والقرطاسية وذلك خلال دراستهم في المدرسة العامة ولا اكثر من ( ٥٠ روبية ) سنويا
للغرض نفسه خلال دراستهم في الكلية او الجامعة على ان تصرف هذه المخصصات
بالاضافة الى رسوم الامتحانات وتكاليف الدراسة الاعتيادية .

لقد حررت هذه الوثيقة في اليوم الثامن من مايس ١٩٢٣ بين السيد موريس ابراهام
راحمين من مصيف بالموزا (٢) في منتون في مقاطعة جبال الالب البحرية للجمهورية الافرنسية
ــ التاجر سابقا ( والمدعو فيما يلي " للموصي " ) من جهة وبين الوصي العام في رانكون ــ بورما
ــ الهند (والمدعو فيما يلي هو ومن يعقبه في وظيفته "بالوصي الوحيد" ) من الجهة الثانية .
حيث ان الموصي راغب في ايداع الى الوصي اوراق مالية للحكومة الهندية ½٣٪ ذات
قيمة اسمية (٣٥٠٠٠ روبية ) على ان يصرف ريعها لاغراض الوقفية المبينة ادناه او لاغراض اي وقفية
اخرى يوقفها الموصي مباشرة بعد توقيع الوثيقة باسم الوصي وتسليم الوثيقة المتعلقة بها اليه والان
تعتبر هذه الوثيقة موثقة وتنص على مايلي :
١ ــ يسلم الموصي الى للوصي مباشرة بعد توقيع هذه الوثيقة اوراق مالية للحكومة
الهندية ½٣٪ بقيمة اسمية تبلغ خمسة وثلاثين الف روبية (٣٥٠٠٠ روبية ) ( وتسمى هذه الأوراق
المالية والمبلغ المودع الذي يمثل هذه الاوراق " بمال الوقف المذكور " ) ولغرض القيام بتحويل
هذا المبلغ سيوقع الموصي وينفذ كافة الاوراق والوثائق اللازمة بغية تقييد المال المذكور وقفـــــــا
باسم الوصي وتخويله بحق التصرف بالغلة الناتجة منه .
٢ ــ على الموصي ان يبقى محتفظا بالمال الموقوف لغرض تخصيص غلته كما مبين فيما
يلي بالشروط والتوجيهات المبينة في الجدول المدرج ادناه وعند استحقاق الاوراق المالية المذكورة
للحكومة الهندية ½٣٪ فعليه اعادة استثمار المال في اسهم مماثلة .
٣ ــ على الوصي ان يصرف الغلة المذكورة لتمكين <del>استمرار اليهود</del> الطلاب اليهود
الفقراء من الاستمرار في الدراسة والذين لا يمكن لا هلهم بسبب العوز من الصرف عليهم عــــــلى ان
يكون الصرف وفقا للشروط والتوجيهات المبينة في الجدول المدرج ادناه .
٤ ــ في حالة حدوث انعدام الطلاب الفقراء المذكورين حسب رأي الوصي وذلـــــــك
لغرض شروط هذه الوقفية و في حالة زيادة الغلة على المبالغ المتطلب صرفها على الطلاب المذكورين
ففي ذلك الحال على الوصي ان يستثمر ( بموجب الشروط والتوجيهات المبينة في الجدول ) زيــــادة
الغلة في نهاية كل سنة في اسهم مالية وان يضيف هذه الاسهم الى المال الموقوف بغية زيــــــادة
رأس المال وعلى ان لا يسحب هذا المال المستثمر في اي حال من الاحوال لغرض صرفه كغلة .
٥ ــ على الوصي ان يصرف لحساب الوقف اي مصاريف يراها ضرورية حسب تقديره كضريبة
الدخل والاسترجاعات والاستقطاعات المتصلة بالوقف المذكور او اي ضريبة حكومية اخرى .

٦ ــ تكون حسابات الوصي عرضة للتدقيق من الحكومة ويجب تجهيز اي صورة مطلوبة
للحسابات بعد ⟦بشرط ان⟧ استيفاء مصاريفها

١ ــ يسمى المال الموقوف ( وقفية منشي صدقة للطلاب اليهود الفقراء )
ب ــ يكون الاولاد الموقوف هذا المال لمنفعتهم ⟦أن يكونوا⟧ ناجحين من الصف السادس لمدرسة اليهود في
رانكون والمستعدين لا تقين للقبول في الصف السابع ( معدل ) في اي مدرسة اخرى معترف
بها من الحكومة او في اي جامعة او كلية في رانكون او مقاطعة اخرى من بورما اذ ان الغرض
من الوقفية هو تمكين هؤلاء الطلاب من الاستمرار في دراستهم وتأدية امتحان المتروكوليشن
او اي امتحان او امتحانات اخرى ارقى كما يرغبون .
حــ ــ في حالة حدوث مستوى ارقى من الصف السادس في مدرسة رانكون لليهود فيشترط في
الطلاب اللائقين للاستفادة من هذه الوقفية ان يكونوا قد نجحوا من هذا الصف وان يكونوا
مقبولين في الصف الاعلى في اي مدرسة عامة في رانكون او في مقاطعة بورما .
د ــ لا يمكن لاي طالب ان يستفيد من هذه الوقفية فيما اذا كان قد سقط في الامتحان الذي
يخوله للدخول الى المدرسة المذكورة المعترف بها من جامعة او كلية حكومية في مناسبتين
متعاقبتين .
هـ ــ ينتخب الوصي او الاوصياء لمدرسة اليهود في رانكون في الوقت الحاضر الاولاد الاولاد
اللائقين للاستفادة من هذه الوقفية وفي حالة حدوث نزاع بين الاوصياء بخصوص انتخاب
طالب او طلاب لائقين للاستفادة من الوقفية المذكورة فيحسم هذا النزاع بتصويت من
الطائفة الاسرائيلية في رانكون والتي يكون قرارها بهذا الخصوص قطعيا . يشترط في
الاشخاص المشتركين في مثل هذا التصويت ان يكونوا بالغين ومن الجنسين .
و ــ اي طالب او طلاب ينتخبون للاستفادة من هذه الوقفية يدخلون في الجامعة فيما اذا قرر
الوصي ذلك على ان لا يصرف لهم اكثر من ( ٢٥ روبية ) سنويا لغاية الكتب والقرطاسية

ز - في حالة عدم استعمال غلة الوقفية المذكورة للغاية الموضحة في هذه الوثيقة لمدة عشرة
سنوات متعاقبة فتنقطع مدرسة الطلاب اليهود في رانكون من الاستفادة من الوقفية المذكورة

THIS INDENTURE made the eighth day of May 1923 BETWEEN MAURICE
ABRAHAM RAEBURN of Villa Palmosa II-Menton in the Province of Alpes
Maritimes in the Republic of France Retired Merchant(hereinafter
called"the settlor") of the one part and THE PUBLIC TRUSTEE OF
RANGOON Burma India(who and whose successors in Office are hereinafter
referred to as"the sole Trustee") of the other part:
WHEREAS the settlor is desirous of phacing in the hand of the
Trustee 3 1/2% India Government stock of the nominal value of
35.000 Rupees the income of which is to be applied for the purposes of
the trust hereinafter mentioned and for the purposes of such trust
the settlor will transfer immediately after the execution of these
presents into the name of the Trustee the said stock and deliver to
the Trustee the scrip relating thereto NOW THIS INDENTURE WITNESSETH
and IT IS HEREBY DECLARED as follows.
1. The settlor will transfer to the Trustee immediately after the
execution of these presents India Government 3 1/2% stock of the
nominal value of Therty five thousand Rupees (35.000 Rupees) (which
stock and the Investments for the time being representing the same
are hereinafter referred to as"the said trust fund") and for the
purpose of effecting such transfer will sign and execute all necessary
transfers and documents to the intent that the said trust fund shall
shand in the name of the Trustee and that he shall be entitled to
the income thereof :
2. The Trustee shall stand possessed of the said Trust fund UPON
TRUST to apply the income as hereinafter provided and upon the
conditions and subject to the stipulations and direcions herein
contained and in the schedule hereunder written and uponthe maturity
of the present 3 1/2% India Government stock to reinvest the fund
in similar Trust securities:
3. The Trustee shall out of the income of the said Trust fund
pay for the further and continued education of poor boys brought
up and educated in the Jewish Faith whose a rents by reason of
indigent circumstances shall be unable to provide for the further
and continued education of such boys with the object of affording
to them the advantages of further and contined education and in
accordance with the stipulations and directions set out in the
schedule hereto:
4. IF and when it snall happen that in the opinion of the Trustee
there are no boys available for the benefits of the trust hereby
created or if the payments in respect of the number of boys available
shall not exhaust the income of the trust fund the Trustee shall
invest (subject to the stipulation and direction contained in the
schedule) the unapplied or surplus income as the case may be at
the end of each year in Trustee securities and add the same to
the said trust fund with a view to increasing the capital thereof
and such unexpended income as may be added to Capital must never
be withdrawn and used as income:
5/ The Trustee small at the expense of the said Trust Fund or
the income thereof make all such applications as it may be necessary
to make out as he shall in his discretion think it advisable to
make for repayment of any sums which may be recoverable in
respect of over-payments or deductions from interest or dividents
on the Trust Fund on account of income-tax or any other State Tax:

6- The accounts of Trustee are subject to audit by Government and any
copy required may be applied for and will be furnished on payment of
prescribed fees:
THE SCHEDULE ABOVE REFERRED TO?
(a) the name of the Trust shall be "The Menashi Sadka Trust for
poor Jewish boys".
(b) The boys for whose benefit the Trust Fund shall be applied
shall be boys who have passed the sixth standard of the Jew's School
in Rangoon and who shall be accepted as fit for the 7th Standard
in any other school recognized by Government: University or College
in Rangoon or in any other part of the Province of Burma the object
of the trust fund being to enable such boys to continue their education
and to pass the Matriculation or Higher or other Examination or
Examinations as they may desire:
(c) If and whenever there shall be in the Jews' school at Rangoon
a higher standard than the sixth standard then the boys entitled to
the benefit of the Trust Fund shall have passed such higher standard
and be accepted for the next higher standard in any other Publicly
school in Rangoon or in the province of Burma.
(d) No boy shall be entitled to the benefit of the said Trust Fund
who shall fail to pass the qualifying examination for such school
recognized by Government University or College on two consecutive
occasions:
(e) The trustee or Trustees for the time being of the Jews' school
in Rangoon shall decide which boys are eligible to benefit by the
said Trust Fund and in case any dispute shall arise between the
Trustees as to the eligibility of any such boy or boys such dispute
shall be decided by a vote of the Jewish Community of Rangoon whose
decision shall be final. The persons who shall vote shall be of
full age and of either sex:
(f) Any boy or boys who shall be selected for and who shall quality
for benefit of the said Trust Fund shall if the Trustee so determine
proceed to University but no more than 25 Rupees per annum shall
be expended upon any one boy in respect of books and stationery if
and when such boy shall be a pupil in a public School and not more
than 50 Rupees per annum shall be expended upon any one boy for
books and stationery when such a boy shall be a pupil in a College
or University . such payments being in addition to all examination
and entrance fees and cost of ordinary School or College Tuition:
(g) If and when the income of the said Trust Fund shall not be
applied in manner herein contained for 10 consecutive years the
School of Jewish Boys in Rangoon shall entirely cease to benefit
by the trust hereby created and the Trustee shall not further
apply the income of the said Trust Fund for the benefit of such
boys: In place of such application the Trustee shall at the termina-
tion of the 11th year and each following years or at any other time
or times in such year and years as he shall determine remit the
income of the said Trust Fund to the Trustees of the Talmud Torah
School Baghdad, with a direction to such Trustees that they shall
apply the amount remitted for the purpose of teaching foreign languages
in such school: the receipt of two or more of such Trustees for
the amount so remitted to them shall be a sufficient discharge to
the Trustee:
