Dear Sirs,
I am in receipt of your letter of the 18th March handed over
to me by Mr. M. Laniado, advocate of Jerusalem.
I am prepared to follow the same system for distribution of
the Bagdad Charities as was agreed to by Mr. Morgan, my predecessor in
office for distribution of the Jerusalem Charities.
I also approve of the proposed committee and of its personnel.
As suggested the committee should get the recommendation of the British
Consul in Bagdad.
It has been held that selection should be made out of those
Institutions which were in existence at the time of death of the testator,
R.A. Gubbay, who died on the 27th November 1922, and that synagogues are
not to participate in distribution of the fund meant for Jewish Charitable
Institutions. I give below a list of the Jewish Institutions in Bagdad
from which applications were received upto 31st August 1938 (the last date
advertised for receiving applications.) Selection should be made out of
these Insitutions having regard to what has been said above.
I hold the following funds for the Jewish Charitable Institutions
in Bagdad:-

5% Loan of 1945-55 for Rs.2,91,400/- (face value)
3% Defence Bonds of 1946 for 65,700/- (face value)
Cash balance    ..    ..    Rs.837.12.1.

The value of the funds is calculated as follows:-

5% Loan of 1945-55 for Rs.2,91,400/- @ Rs.111.14.0 %   Rs.3,26,003.12. 0.
3% Defence Bonds of 1946 for Rs.65,700 @ 101. 4.0 %      66,521.14. 0.

Intt. due on the 14th April 1941 on 5% Loan of

تسلمت كتابكم المؤرخ ١٨ مارت الذي سلمه لي السيد م. لنيا دو المحامي في القدس بتوزيع حصة
بغداد ، انني على استعداد لاتباع نفس الطريقة التي كان قد اتبعها سلفي في الوظيفة لتوزيع حصة
القدس

كذلك اوافق على اللجنة المقترحة وعلى اشخاصها . وكما حصل الاقتراح ان اللجنة تحتاج لتوصية
القنصل البريطاني في بغداد .

من المقرر ان الانتقاء يجب ان يكون من بين تلك المؤسسات التي كانت قائمة في وقت وفاة <del>العرائض</del>
الموصى ر. ا. كباي الذي توفي في ٢٧ نوفمبر ١٩٢٢ وان الكنائس ليس لها ان تساهم في التوزيعات
المخصصة للمؤسسات الخيرية الاسرائيلية .

اضع ادناه قائمة المؤسسات الاسرائيلية في بغداد التي تسلمت عرائضها حتى ٣١ اوكست ١٩٣٨
(وهو اخر موعد عين لقبول العرائض) ويجب ان يجري الانتقاء من بين هذه المؤسسات مع ⟦ملاحظة⟧ ما ذكر
اعلاه

انني احمل المبالغ الاتية للمؤسسات الخيرية الاسرائيلية ببغداد
٥ % قرض ٥٥/١٩٤٥ عن -/٢,٩١,٤٠٠ روبية (القيمة الاسمية)

لا شك ان الاعمال الخيرية التي حققتها جمعية اسعاف المرضعات منذ تشكيلها
حتى الان غير خافية على لجنتكم المحترمة وان توسيع نطاق هذه الاعمال وتحقيق اهداف
الجمعية بتقديم الاسعافات المجدية للمرضعات الفقيرات يعتمد على معاونة ارباب الخير
ولما كان المرحوم رفائيل كباي قد اوصى بتركته للمؤسسات الخيرية الاسرائيلية وان جمعيتنا
من المؤسسات المقصودة بهذه الوصية نرجو من سيادتكم ان تتفضلوا بالفات نظر اللجنة

كان المجلس الجسماني قد انتدب المحامي السيد لنيادو للسفر الى كلكتا لتعقيب
معاملة حصة المؤسسات الخيرية في بغداد من تركة المرحوم رفائيل كباي وبنتيجة المداولة
مع المحامي المومى اليه عند وجوده في بغداد حصل الاتفاق على اقتراح بتشكيل لجنة
استشارية في بغداد برئاسة سيادة رئيس الطائفة وعضوية كل من رئيس المجلس الجسماني
وممثل عن كل من لجنة المستشفيات ولجنة المدارس وثلاثة من وجهاء الطائفة . وقد
ابرق السيد لنيادو من كلكتا في ٢٧ منه ان الامين الرسمي هناك قد قبل الاقتراح
فنرجوكم التفضل باعلامنا عما اذا كنتم ستمثلون لجنتكم في هذه اللجنة الاستشارية
او تنتدبون من يمثلها ودمتم ؛

اشارة الى كتابكم رقم ٣٣٢٤ بتاريخ ٣١ مارت ٩٤١
قررت اللجنة في اجتماعها المنعقد في ٣١ مارت ٩٤١ انتداب سكرتيرها السيد موئز
ايتا لتمثيلها في اللجنة الاستشارية لتركة المرحوم رفائيل كباي ،

اجتمعت اللجنة الاستشارية لتركة المرحوم رفائيل كباي مساء الاحد ٢٢ حزيران ١٩٤١
وقررت ما يلي :

بعد الاطلاع على الكتاب المرقم ٣٧٤١ بتاريخ ٢٧ مارت ١٩٤١ الوارد من الامين
الرسمي للبنغال في الهند الموجه الى رئاسة الطائفة ورئاسة المجلس الجسماني وجدت
هذه اللجنة ان الامين الرسمي المذكور قد اشترط ان تكون المؤسسة التي يفرد لها نصيب
في التركة قائمة في وقت وفاة الموصي المرحوم رفائيل هارون كباي الذى توفي في ٢٧ نوفمبر
١٩٢٢ وان لا تكون من الكنائس وعلى ان يجرى الانتقاء من بين المؤسسات التي ورد ذكرها
في القائمة المربوطة بالكتاب المذكور وهي تلك المؤسسات التي وصلت عرائضها ليد الامين
حتى ٣١ اوكست ١٩٣٨ .

وقد ظهر للجنة كذلك من الكتاب المذكور ان مبلغ التركة الموصى به قد بلغ حتى تاريخ
الكتاب المذكور ١ - ١٢ . ٦٤٧ . ٤٠٠ روبية وهو ما يقارب ٢٩٩٠٠ باون استرليني .

وعليـــــــــــــــه ونظرا للاسباب الموضحه اعلاه فقد اصبح من الضروري
اعادة النظر في المقررات التي اتخذتها اللجنة في ١٦ نيسان ١٩٤١ عندما لم تكن
هذه الشروط معلومة لديها لتاخر ورود الكتاب المرقوم بعد صدور تلك المقررات .

وبعد المداولة وجدت ان المؤسسات التالية كانت قائمة وقت وفاة الموصي وهي لا تزال
تؤدى الخدمات النافعة للطائفة حتى الان وهي باشد الاحتياج للمساعدة لذلك قررت
توزيع المبلغ الموصى به كما يلي :-

اجتمعت اللجنة الاستشارية لتركة المرحوم رفائيل كباي مساء الاحد ٢٢ حزيران ١٩٤١
وقررت ما يلي :

بعد الاطلاع على الكتاب المرقم ٣٧٤١ بتاريخ ٢٧ مارت ١٩٤١ الوارد من الامين
الرسمي للبنغال في الهند الموجه الى رئاسة الطائفة ورئاسة المجلس الجسماني وجدت
هذه اللجنة ان الامين الرسمي المذكور قد اشترط ان تكون المؤسسة التي يفرد لها نصيب
في التركة قائمة في وقت وفاة الموصي المرحوم رفائيل هارون كباي الذي توفي في ٢٧ نوفمبر
١٩٢٢ وان لا تكون من الكنائس وعلى ان يجري الانتقاء من بين المؤسسات التي ورد ذكرها
في القائمة المربوطة بالكتاب المذكور وهي تلك المؤسسات التي وصلت عرائضها ليد الامين
حتى ٣١ اوكست ١٩٣٨ .

وقد ظهر للجنة كذلك من الكتاب المذكور ان مبلغ التركة الموصى به قد بلغ حتى تاريخ
الكتاب المذكور ١-١٢-٤٠٠٦٤٧ روبية وهو ما يقارب ٢٩٩٠٠ باون استرليني .

وعليه ونظرا للاسباب الموضحه اعلاه فقد اصبح من الضروري
اعادة النظر في المقررات التي اتخذتها اللجنة في ١٦ نيسان ١٩٤١ عندما لم تكن
هذه الشروط معلومة لديها لتاخر ورود الكتاب المرقوم بعد صدور تلك المقررات .

وبعد المداولة وجدت ان المؤسسات التالية كانت قائمة وقت وفاة الموصي وهي لا تزال
تؤدي الخدمات النافعة للطائفة حتى الان وهي باشد الاحتياج للمساعدة لذلك قررت
توزيع المبلغ الموصى به كما يلي :-

This letter is being sent to you after having seen
Advocate Mr.Labiado who just returned from India and gave us your
instructions as specified in your letter of the 27th March, 1941.

We recommend that the share of Baghdad of the above
bequest be divided to the Jewish Charitable Institutions of Baghdad
mentioned hereafter as follows:-

hereabove, we beg to deduct or add the difference to the institution
Nouriel Elementary School for boys.

All the institutions above are old institutions which
have been founded before many years and which have been in existence
at the time of death of the deceased the late Raphael Haron Gabbay, who
diedon 27th Novr. 1922.

They, actually exist and give a great assistance to
the Jewish population in Baghdad. None of them is a synaguogue, but all
are actual charitable institutions and their charity extends to the needy
population of this Community. All ofthem have as a rule an annual
budget. They are also supervised by the Jewish Lay Council and
administered by special committees appointed by the said Council.

The situation of the above institutions recommended by
us requires an immediate remittance in order to carry on their valuable
functions, and we shall be very much obliged if you would treat this case
as in urgent one.

sent be drawn on any Bank in India in Ruppes, as this will facilitate
us to cash the cheques sooner than a cheque in Pounds Sterling drawn

your capacity as official Trustee) drawn on your Bank in India.

We shall be obliged if you will make the cheques for the
above institutions as follows:-

We are sending you herewith a document signed by the President
of the Jewish Community & the President of the Jewish Lay Council and
other representatives of the Jewish Charitable Institutions of this city
recommending the most prominent and deserving institutions of our Community
to benefit from the bequest of the late R.A. Gubbay.

We shall be much obliged if you will kindly hand over to above
document personally to the Official Trustee in order to get his consent
for an early remittance of the amount.

The document is annexed to an affidavit signed by the President
of the Jewish Community before the British Consul and attested by him.

We understand that in addition to that the British Consul is
going to send a special letter to the Official Trustee recommending the
institutions mentioned in the above document in order to urge the remitt-
ance.

A second copy of the above document also signed and sworn before
the British Consul will be forwarded to the Official Trustee with Mr. M.
Laniado,Advocate who is trying to return to Calcutta for this object. In
case Mr. Laniado will not be able to proceed to India he will send this
copy too to yourself.

Mr. Laniado informed us that you are willing to act on behalf of
our Community and our institutions for which we thank you.
We ask you to be so kind as to wire to us after seeing the
Official Trustee and in generally keep us informed please, by sending us
your informations or instructions by cable on our own expenses with a copy
of each telegram to Mr. M. Laniado, Advocate Ben-Yehuda St. Jerusalem.
