We are informed by Lady Ezra that you are in a position to put us in touch with the present members of the Committee. Extract from the Will of the late Sir David Ezra. -------- 17. [Stamp] CALCUTTA [Stamp] 21st April, 48 [Stamp] No. 4741 [Stamp] ⟦illegible⟧ بالاشارة الى كتاب السادة اور ديكان وشركاؤهم كلكتة المرقم ٤٧٤١ والمؤرخ ٢١ نيسان ١٩٤٨ المحال لي لابداء الرأي فيه . طالعت الموضوع ويظهر لي ان احسن طريقة مناسبة لتنفيذ الوصية هو ان يشترى مال غير منقول باسم رئيس الطائفة الاسرائيلية ببغداد او باسم من يعتمد عليه من قبل منفذ الوصية ويقوم من يسجل الملك المشترى باسمه في الدوائر المختصة بتوقيفه ويذكر في الوقفية العبارات الاتية :- بأنه قد اوقف الملك المذكور بجميع توابعه ولواحقه ومرافقه وبكافة حقوقه وقفا صحيحا مؤبدا وحبسا صريحا مخلدا الى آخر الزمان على الطائفة الاسرائيلية ببغداد على ان يصرف ريعه اولا على تعمير وترميم الوقف وما يحتاج اليه من النفقات والضرائب ومن ثم يوزع ما يتبقى من الريع على الفقراء الاسرائيليين الموجودين في بغداد ويكون التوزيع بمعرفة المجلس الروحاني الاسرائيلي ببغداد وبمطلق رأيه على ان يرجح اولا الفقراء الذين هم من اقارب المرحوم السر داود عزرا المتوفى في كلكتة وذلك كمبرة على روحه ويسمى الوقف بأسمه على طول الزمان وتكون التولية الى رئيس الطائفة الاسرائيلية ببغداد ومن يخلفه بالمنصب جيل بعد جيل . هذا واذا حصلت موافقة المجلس المحترم على هذا الرأي ارى تبليغه الى الجهات المختصة وفي حالة موافقة منفذ الوصية على الاجراءات المذكورة يرجى منه ارسال المبالغ الموقوفة للقيام بتنفيذ ما تقدم . هذا ودمتم . ORR, DIGNAM & Co., 101/1, CLIVE St., C A L C U T T A/ Dear Sirs, In reply to your letter dated April 21st, regarding Clause 17 of the will of the Late Sir David Ezra, please note the following: After taking our advocates legal advice in this matter, it has been found that the best way to execute the will in question in accordance with the laws and regulations in force here, is to purchase an immovable property having the value of Rupees 50,000 to be registered first in the name of the President of the Jewish Community or in the name of any other person the Executrix may rely upon. Then, the purchaser shall register this immovable property as a Waqf - endowment to perpetuity - with the competent authorities, with the conditions that its revenue be spent on the maintenance of this immovable property first and the rest be distributed to the benefit of the destitute poor <del>inhabitants</del> Jewish inhabitants of Baghdad at such times and in such manners as the "Mejlis el Ruhaniyeh" the Jewish Spiritual Council of Baghdad in its absolute and uncontrolled discretion shall think fit save and except that the said Council shall give preference to the needy relatives of the bequeather. This Waqf - endowment to perpetuity - shall bear the name of the late Sir David Ezra, and the President of the Jewish Community of Baghdad shall be the Mutawalli i.e., superviser, of this Waqf generation after generation. After discussing the matter, they have found that the way shown in my letter of 6th June last, is the safest way to execute the will in question as the immovable property suggested to be purchased in such cases is usually a shop in one of the best bazars in Baghdad, and such places would not entail much looking af<del>d</del>er or repairs and its revenue is much more than the revenue derived from securities; anyhow if Lady Ezra prefers to keep the money invested in sound government securities, there would be no objection to do it. Orr, Dignam & Co. 29, Netaji Subhas Road, CALCUTTA Dear Sirs, I am in receipt of your letter dated August 23rd, contents of which have been carefully noted. I wish to confirm the suggestions put to you in this respect by the President of the Jewish Community of Baghdad Rabbi Sassoon Kadoori, in his letter dated August 3rd No. 729, which consist of purchasing an immovable property with the sum bequeathed to be registered as an endowment to per- petuity, the revenue of which shall be spent on the destitute poor Jewish inhabitants of Baghdad in accordance with the will of the late Sir David Ezra.
