Instructions
Administrative Council for Iraqi Jews
Order of the Minister of Justice
Based on what was presented by the Bureau of Codification in its decision issued on 11/2/1958 and what it relied upon from previous ministerial decisions and orders, and what is necessitated by necessity and the reality of the situation, I have decided to establish the following instructions for the management of public funds belonging to Iraqi Jews which were under the management of the Lay Council that used to carry out its work in accordance with the Mosaic Community Law No. 77 of 1931, and to put them into effect starting from their publication in the Official Gazette.
Article One - For the purposes of these instructions, Iraqi Jews means all Iraqi Jews residing in all parts of Iraq who are proven by official statistics and census departments to still retain Iraqi nationality until these instructions are put into effect.
Article Two - A - An administrative committee shall be formed in Baghdad in accordance with these instructions, consisting of five persons from the Jews residing in the city of Baghdad.
B - The members of the committee shall be elected by secret ballot in accordance with what is stipulated in these instructions.
C - The term of membership is two years, and a former member may be re-elected.
D - The administrative committee shall elect a chairman from among its members by secret ballot.
E - It is required that the chairman and the member be at least thirty years old, and the term of the chairmanship ends with the end of the term of membership, and that he has not been convicted of a felony or misdemeanor, or has been convicted and had his civil rights restored.
Article Three - The committee shall perform the following tasks with respect to all parts of Iraq, namely:
1 - Management of estates, roofed properties, and exploited properties endowed for charitable purposes, the guardianship and management of which were entrusted to the Lay Council or to any previous communal body.
2 - Management of schools and charitable institutions.
3 - Management of expenditure and revenue matters, collection of communal fees, and appointment of the necessary employees for that.
4 - Supervision of the management of slaughterhouses, cemeteries, preparation, shrouding, and burial from a financial perspective.
Article Four - A committee shall be formed in the Ministry of Justice consisting of the Head of Codification, a legal codifier, and a member elected by the administrative committee from among non-members, to serve as a reference for the administrative committee to which its actions and behaviors are presented, its budget is submitted, and appeals against the validity of the decisions it issues are raised. The decision of this committee, after being ratified by the Minister of Justice, shall be final and enforceable.

Alice, and Naim, according to the legal distribution 57 / M / 965 on 22 / 6 / 965 issued
by the Personal Status Court in Karrada. Also, Aziza Menashi Rubin Abdullah
Battat passed away - and her transfer rights were limited to her son Naji Shaul Eliyahu Samouha.
Therefore, please audit and inform us of the date of death of Menashi Rubin Abdullah Battat and all information
available to you regarding the subject for the purpose of knowing the legal distribution of the deceased and the entity that issued it,
hoping for a response as quickly as possible.

⟦illegible⟧ Minister of Justice. At that time, the Minister announces the result
by a ministerial order notified to the members of the committee who won the election.
Article Thirteen - Election expenses shall be paid from the fund of
the administrative committee.
Article Fourteen - If a ⟦membership⟧ of the committee becomes vacant for any reason
whatsoever, the person whose name follows the names of the members in
terms of the number of votes shall replace them. If the vacancy is the position of the President, the
committee shall re-elect the President in accordance with what was mentioned in Article Three of these
instructions.
Article Fifteen - If one of the members of the committee
or the President fails to attend its meetings three consecutive times without an excuse approved by the committee,
a warning to attend shall be sent to him, and if he does not attend the fourth time, he shall be considered
resigned, and whoever replaces him shall be elected in accordance with Article Seven. If
the absence was due to travel, the committee's approval of the absence is required, provided that
it does not exceed three months.
Article Sixteen - The committee's decisions are issued by a majority of
votes, including the President's vote.
Article Seventeen - These instructions shall be implemented from the date of
their publication in the Official Gazette.

Article Eight - The election begins on the morning of the day appointed by
the Minister of Justice upon the first application of these instructions, then it shall be on that
same day at the start of any subsequent election.
Article Nine A - The electoral body must organize, before proceeding
with the election, a list of the names of all those who have the right to vote, and the list shall be posted
in a prominent place in the election area for a period of eight days before the day appointed
for the election. Every voter whose name is not included in the list has the right to object to
the electoral body twenty-four hours before the start of the election. The
decision of the body issued regarding that shall be considered final.
B - The electoral body shall give an identity card to every voter whose name appears
in the election list.
Article Ten - The electoral body shall be present at the election center
equipped with election papers stamped with a special stamp it designates, then the box is opened
so that the public can see inside it, then it is locked with two locks, one of which is kept by the head of
the body and the other is kept by one of its members. Then the election begins
by admitting the voters to the election room one by one, and the voter is given
an election paper in which he writes the names of five people and drops it in

Al-Sukrah, Al-Hajj Alwan, Al-Hajj Naji, and the sons of Hussein Haider with their petition dated 4/21/1948
and they supported the submitted petition which stated that the plot of land located in the Battaween district, serial 37/143
is an endowment (waqf) and used as synagogues for performing prayers, and that the Head of the Community is its custodian, and that
the owner of the adjacent plot of land serial 171/143 had inadvertently constructed his house on
part of the land used as synagogues, serial 37/143, with an area of 184.61 square meters instead
of plot serial 171/143, and similarly the owners of plot serial 172/143 had
inadvertently constructed their house on plot number 171/143, so plot number
172/143 with an area of 176 square meters has remained vacant until now, which indicates the good faith of the neighbors.
The Head of the Community, in his capacity as overseer and custodian of the aforementioned synagogues, requested the subdivision of plot
serial 37/143 into two plots and the exchange of the plot on which his neighbor Rashid
Mahdi Al-Sukrah built with the vacant plot number 172/143, and the owner of plot number
171/143 agreed to also exchange his plot with the owners of plot 172/143. The Head of the
Community requested the issuance of an exchange deed in the manner mentioned above. Upon conducting the inspection,
it was found that Rashid Mahdi Al-Sukrah, owner of plot 171/143, had inadvertently constructed his house
on a part of the endowment plot belonging to the synagogues, serial 37/143, with an area of 184.61 square
meters, thinking it belonged to him. Also, Naji and Alwan, the sons of Hussein Haider and owners of plot 172/
143, had constructed their house on Rashid Mahdi Al-Sukrah's plot, serial 171/143, thinking
it belonged to them, and plot number 172/143 has remained free of any building. As a result of the
ongoing inspection, it appeared that this exchange is not harmful to the rights of the Jewish Community endowment, as the area of
the two plots is approximately equal, the location is the same, and the value/prestige of the two plots is equal. Therefore, based
on the conditional request submitted to this court by the Head of the Community and the aforementioned neighbors, it was decided
to approve it and issue permission for the exchange in the manner mentioned above. Issued on 5/26/
1948.

sequence 37 / 143 into two plots and the replacement of the plot on which his neighbor Rashid
Mahdi al-Samaka built with the vacant plot numbered 172 / 143. The owner of the plot numbered
171 / 143 also agreed to exchange his plot with the owners of plot 172 / 243, and the Head of
the Community requested the issuance of a deed of exchange (Istibdal) in the manner mentioned above. Upon conducting the inspection,
it was found that Rashid Mahdi al-Samaka, the owner of plot 171 / 143, had inadvertently built his house
on a part of the endowment land belonging to the synagogues, sequence 37 / 143, with an area of 184.61 square
meters, thinking it belonged to him. Also, Naji and Alwan, the sons of Hussein Haider and owners of plot 172 /
143, had built their house on Rashid Mahdi al-Samaka's plot sequence 171 / 143, thinking
it belonged to them, and plot numbered 172 / 143 remained vacant of any building. As a result of the
current inspection, it appeared that this exchange is not harmful to the rights of the Jewish Community endowment, as the area
of the two plots is approximately equal, the location is the same, and the value of the two plots is equal. Therefore, based

meters, thinking it belonged to him, and that Naji and Alwan, the sons of Hussein Haider, owners of piece 172 /
143, had built their house on the piece of Rashid Mahdi Al-Samkara, sequence 171 / 143, thinking
it belonged to them, and the piece numbered 172 / 143 remained vacant of any construction. As a result of the
ongoing inspection, it appeared that this replacement is not harmful to the rights of the Jewish Community endowment, as the area
of the two pieces is approximately equal, the location is the same, and the value of the two pieces is equal. Therefore, based
on the joint request submitted to this court by the Head of the Community and the aforementioned neighbors, it was decided
to approve it and issue permission for the replacement in the manner mentioned above, and it was issued on 5/26 /
1948.
