Al-Sukrah, Al-Hajj Alwan, Al-Hajj Naji, and the sons of Hussein Haider with their petition dated 4/21/1948
and they supported the submitted petition which stated that the plot of land located in the Battaween district, serial 37/143
is an endowment (waqf) and used as synagogues for performing prayers, and that the Head of the Community is its custodian, and that
the owner of the adjacent plot of land serial 171/143 had inadvertently constructed his house on
part of the land used as synagogues, serial 37/143, with an area of 184.61 square meters instead
of plot serial 171/143, and similarly the owners of plot serial 172/143 had
inadvertently constructed their house on plot number 171/143, so plot number
172/143 with an area of 176 square meters has remained vacant until now, which indicates the good faith of the neighbors.
The Head of the Community, in his capacity as overseer and custodian of the aforementioned synagogues, requested the subdivision of plot
serial 37/143 into two plots and the exchange of the plot on which his neighbor Rashid
Mahdi Al-Sukrah built with the vacant plot number 172/143, and the owner of plot number
171/143 agreed to also exchange his plot with the owners of plot 172/143. The Head of the
Community requested the issuance of an exchange deed in the manner mentioned above. Upon conducting the inspection,
it was found that Rashid Mahdi Al-Sukrah, owner of plot 171/143, had inadvertently constructed his house
on a part of the endowment plot belonging to the synagogues, serial 37/143, with an area of 184.61 square
meters, thinking it belonged to him. Also, Naji and Alwan, the sons of Hussein Haider and owners of plot 172/
143, had constructed their house on Rashid Mahdi Al-Sukrah's plot, serial 171/143, thinking
it belonged to them, and plot number 172/143 has remained free of any building. As a result of the
ongoing inspection, it appeared that this exchange is not harmful to the rights of the Jewish Community endowment, as the area of
the two plots is approximately equal, the location is the same, and the value/prestige of the two plots is equal. Therefore, based
on the conditional request submitted to this court by the Head of the Community and the aforementioned neighbors, it was decided
to approve it and issue permission for the exchange in the manner mentioned above. Issued on 5/26/

on a part of the endowment land belonging to the synagogues, sequence 37 / 143, with an area of 184.61 square
meters, thinking it belonged to him. Also, Naji and Alwan, the sons of Hussein Haider and owners of plot 172 /
143, had built their house on Rashid Mahdi al-Samaka's plot sequence 171 / 143, thinking
