Presidency of the Jewish Community Baghdad Committee for the Administration of Minors' Property Subject: Petition submitted by Saleh Youssef Sassoon Property Records Register: Number: 327 119 Dossier 24 A lawsuit was filed in the Karrada Court of First Instance under number 185/B/1948 by the plaintiff Saleh Youssef Sassoon in his capacity as guardian of the minors Salim and Edmond, sons of Youssef Sassoon, requesting a judgment for 1500 Dinars, representing the share of the aforementioned minors in the house numbered 15/18 in the Battaween neighborhood, claiming that their grandfather Youssef Sassoon had registered the mentioned house in the name of his wife Sarah Sassoon at the Land Registry Department in 1938, and that she had sold the mentioned house to the defendant, the Jewish Community, under the contract dated 10/22/1946 for the sum of 3000 Dinars, and that the mentioned Sarah Sassoon died in 1947, and that the mentioned sale was not registered in the Land Registry Department, and that the defendant, the Jewish Community, had taken possession of the mentioned house and acted as its owners. The plaintiff requested the annulment of the mentioned contract and a judgment for the mentioned amount representing the minors' share in the house, considering that the sale was not registered in the Land Registry and that the defendant had taken possession of the house without right. The mentioned court dismissed the plaintiff's lawsuit due to lack of proof of the minors' ownership of the house by its decision number 185/B/1948 dated 1/18/1949. The plaintiff appealed the judgment to the Baghdad Court of Appeal under number 15/1949. The mentioned court decided in its decision number 15/1949 dated 4/18/1949 to dismiss the appeal and uphold the appealed judgment due to lack of proof of the minors' ownership of the house, considering that the mentioned contract is an external sale contract not registered in the Land Registry, and that the house is registered in the name of Sarah (the mother of the deceased), and that the guardian is requesting the share of his wards from the price of the house. Since the sale was not registered in the Land Registry, it has no legal effect, and the plaintiff's claim has no sound legal basis. Therefore, the Administrative Council of the Jewish Community decided in its session held on 5/11/1949 to reject the guardian's request due to lack of proof of the minors' ownership of the house, and that the house is registered in the name of the Jewish Community in the Land Registry under title deed number 1188 dated 12/2/1948, and that the Community purchased the house from its owner registered in the Land Registry, Sarah Sassoon, under the contract mentioned above, and that the Community paid the price to the seller under official receipts signed by her and certified by the Notary Public, and that the guardian did not provide any evidence proving the minors' ownership of the house, but rather the guardian is demanding the price which their grandmother Sarah Sassoon received from the mentioned Community under the contract mentioned above. If his descendants become extinct, it returns to the descendants of his brothers, generation after generation, and after them to the heirs of the descendants of their relatives, generation after generation. If all become extinct, the trusteeship returns to the Head of the Sharia Courts in the encyclopedia in Baghdad, and that is its weapon by the claim of peace issued by the Personal Status Courts on April 4, 944, numbered 64, based on the letter of the Vice President of the Baghdad Courts of First Instance dated 17/4/941 and numbered 64/940, and known according to the Tapu knowledge and report dated March 9, 941, the Waqf transaction was registered.
