Based on our tragedy in the death of the lamented Council member, the late Eliyahu Effendi
Baruch Yehuda, our Council has decided that the students of the schools in which the deceased
served shall participate in the duty of mourning for the deceased in the following manner:
1- Schools shall be closed next Wednesday afternoon, November 1, 1933,
in mourning for the late deceased.
2- After the end of the fourth lesson before noon, the director shall gather all students in the
school yard and eulogize the late deceased, explaining that this holiday is a manifestation
of our regret and grief on the occasion of this loss.

11 -- ⟦line⟧ Dismissal of the Contractor's Employees
The Engineer has full authority to request the Contractor to dismiss or exclude any of his employees whom
the Community deems undesirable or unfit to continue in the work, and the Contractor must implement those requests
immediately upon their issuance. He has no right to claim any compensation or damages that may result from that in any form whatsoever.
12 -- Advances
The Community pays cash advances at the end of each month for the work completed and materials provided at
the work site after obtaining a certificate from the Engineer to that effect, based on 90 percent
of the cost of the work completed according to the contract prices and 75 percent of the value of the construction materials
provided at the work site according to its local estimation. Provided that these advances granted
to the Contractor shall not be considered an admission of acceptance of the work by the Community; rather, the contract terms apply to
all completed and uncompleted work until it is finally handed over to the Community.
13 -- Final Measurement and Settlement of the Contractor's Account
After the work is completely finished in all respects as certified by the Community's Engineer, the Jewish Community
shall take over the work provisionally, and the Contractor's account shall be settled according to the total lump sum amount
agreed upon in this contract after deducting all advances paid to the Contractor on account of
his work. As for the Contractor's securities, the Community shall retain them for the maintenance period and they shall be returned to him upon its expiration
and after the final handover of the work.
14 -- Rejection of Work
The Engineer has the right to reject any materials provided by the Contractor or any work that is, in the Engineer's view, based
on quality and workmanship that do not meet the required standard or are not in accordance with the specifications or drawings
pertaining to the contract. The Contractor must remove the rejected materials and work and re-execute it at
his own expense, including the materials present in the rejected work.
Any work carried out without authorization in addition to the details given in the drawings or
the issued instructions will <del>not</del> be recognized, nor will it be measured, and the Contractor will not be paid the value of the materials
used in the execution of such works.
15 -- Maintenance Period
The Contractor must maintain the work for a period of three months from the date the Community takes over the work
from him provisionally, and he must repair all deficiencies or defects that may appear during the period

Maintenance at his own expense, and the insurances or what remains of them shall be returned to him after deducting the amounts
duly owed by him at the end of the maintenance period and after the contractor has fulfilled his obligations
and the work has been finally received from him.
The contractor must carry out the repairs requested by the Sect within a week from the date of
notifying him in writing. If he fails to perform the work, the Sect shall withdraw the insurances belonging to him
if they are in the form of a bank guarantee, and perform the work at his expense and deduct the amount from him.
16- Notices
The two contracting parties waive the right to send notices from one to the other through
the notary public regarding the affairs of this contract. Every notice sent by one of the parties should
either be delivered to the other party's address or sent to him by registered mail.
17- Labor Laws
The contractor is responsible for applying the Labor Law regarding all labor matters and observing them
regarding official holiday wages, feasts, and compensations, as he is also responsible for accidents that
occur to his employees at the work site, and he must pay all compensations resulting therefrom
as the Sect is not responsible at all regarding the workers.
Withdrawal of work from the contractor and its consequences
a - If the contractor fails to start work promptly upon receiving written notice to that effect.
b - Or if he falls short in performing the execution of works at the required speed.
c - Or if he fails to perform the execution of works in accordance with the contract.
d - Or if he delays in completing the works beyond the deadline specified in the contract.
e - Or if he actually stops work for a period of one week without written permission from the Sect, unless
he proves the existence of force majeure and informs the engineer and the Sect of it immediately and in writing.
f - Or if he fails to supply or install machinery, workers, materials, and equipment that are sufficient and appropriate so that he can
execute the permanent work quickly and without interruption.
g - Or if he commits, personally or through an intermediary, any violation of any of the contract provisions he is bound to implement
or follow up on, and continues in this violation for a period of 14 days (taking into account any special condition
stipulating a shorter period) after being warned in writing by the engineer to rectify this violation.
h - Or if he abandons the work entirely.

f -- or if the Contractor (whether in Iraq or abroad) becomes bankrupt or if he files
a petition for bankruptcy or his financial insolvency is proven or if he reconciles with his creditors or if the Contractor is a company
and it has been liquidated, whether the liquidation was mandatory or voluntary (unless the liquidation was
voluntary for the purpose of reorganizing the company on foundations decided in writing by the government) or if
the Contractor was a company and it was dissolved or if the Contractor gave, promised, or presented a gift or
an advance, reward, or benefit of any kind to any employee or worker among the employees of the Community
whether he was independent or had any relation to the work subject of this contract, the Community has in any
case of these cases --
1 - To withdraw the execution of the remaining works from the Contractor.
2 - The withdrawal of the execution of the remaining works shall be in accordance with what was mentioned above by sending a written
notice ⟦issued⟧ by the President of the Administrative Committee of the Jewish Community to the Contractor
and this notice shall be valid and effective without taking any legal
or official procedures.
3 - If the Contractor is granted any grace period or indulgence, this shall not reduce or prejudice the rights of
the Community according to this article, and the previous provisions do not affect the right of the Community
to claim the compensations stipulated according to the laws in force.
4 - In the event of withdrawing the work or part of it from the Contractor according to what was previously explained or
according to any other provisions contained in the contract, the Community has, according to its estimation of the cost, the right to
exercise one of the following rights --
a - To carry out by itself at the Contractor's expense the execution of all the works that have
not yet been completed or any part thereof.
b -- To put all or some of the works that have not yet been completed into tender again.
c -- To agree with one of the contractors in a private manner to complete the work.
In all these cases, the Community shall have the right to seize all or some of
the machinery, tools, and materials brought by the Contractor and to use them
in completing the work without being responsible to the Contractor or others
for these machines, tools, and materials, and for any damage or decrease
in value that may occur to them for any reason, and without being responsible also for paying any
amount due for them to another party or paying any wage for them to the Contractor or others.

The Community shall have the right in any case to seize all or some of the machinery, tools and materials
even after the completion of the work, in order to guarantee its rights, and the contractor must pay to the Community
all the expenses it incurs in this regard in excess of the contract value, and he must compensate it
for all the losses it incurs because of that. The Community may deduct the value of the expenses and losses
referred to from the insurance amount or from the contractor's claims or from any money belonging to him, but if
the work cost less than the contract prices, the difference shall not return to the contractor.
For this purpose, the Community may refrain from paying any amounts that have been granted to him
until these expenses and losses are settled, and the Community may sell the machinery, tools or materials
that the contractor brought without being responsible for any losses incurred by him as a result of
selling them.
In the event that the work is withdrawn from the contractor, an inventory report shall be organized regarding the works, buildings,
tools, equipment and materials that are at the work site and regarding the work that has been completed in a
satisfactory condition, by the Community's responsible engineer, and this inventory shall take place in the presence of the contractor
who must be officially notified to attend, either him or his representative. If the contractor does not attend or does not send
a representative on his behalf, the inventory shall be carried out in his absence.

and its engineer on one hand and the contractor on the other hand. If they do not agree, they may appoint experts
in that, provided that the disagreement on that does not give the contractor any right to delay the work.

to the supervising engineer on behalf of the community that a portion of

the contractor is solely responsible for that. If
the resulting castings do not conform to the maps or

is responsible for repairing them or removing them and pouring them again
as necessity dictates.

11 Asphalt and leveling works
A) First, a layer of asphalt not less than
3/8" thick is placed directly on the roof, extending to the parapet walls
at a height of 8 inches, provided that the asphalt is of the best
types of local asphalt and that an amount of 15 percent
of liquid asphalt is added during the heating of the asphalt. It is not
permissible to use crude oil at all in the asphalt, noting the
overlap of the asphalt sheet on the surfaces by 4 cm
at least over each other.
B) Leveling the surfaces with fine soil whose
fineness matches Al-Habbaniya sand, otherwise the supervising engineer
may reject it. Leveling works are carried out by placing
the soil in layers not exceeding 5 cm, slightly moistened
with water and compacted with hand rammers, provided that the average
thickness of leveling is 10 cm in the middle and 15 cm
near the parapets.
C) The surfaces are asphalted again with a layer not less than
3/8" thick, taking into account what was mentioned in the item above.
