Description

These are documents from the Baghdadi Jewish community and schools. The majority of the documents are a contract agreement between the Administrative Committee for Iraqi Jews and a general contractor to build another classroom and additional storage in the Frank Iny School (1956-1957). This includes the general contract; ledgers of schedules, materials, and costs; and design plans, including front elevation, done by Saleh Joseph. One section is correspondence between the Jewish Lay Council and all Jewish schools regarding teacher certifications and curricula (1931-1933).

Subject: The new building at Frank Iny School

The works on the new building at Frank Iny School, including materials and all
other expenses, have reached 2110.122 Dinars (only two thousand one hundred and ten Dinars and one
hundred and twenty-two Fils). Therefore, I request Your Honor to settle the remaining balance owed by the community after
deducting the advances and after receiving a letter from the Principal of Frank Iny School informing you
of the provisional receipt of the building according to the terms of the contract concluded between Your Honor
and the contractor Mr. Salloum Shamoun.
This is for your consideration.

To the esteemed contractor Mr. Sassoon Shamoun
Based on the contract concluded between the Presidency of the Administrative Committee of the Jewish Community in Baghdad and yourselves,
You undertook to complete the work within a maximum period of two months, and as a result of the increase occurring in the construction which does not exceed 25% in any case,
The contract period shall not exceed 75 days, while more than 100 days have passed since the construction began according to the Community's letter dated 3 / 10 / 956
Numbered M / 395 / 56, which orders you to work. Since the Community has the right to deduct three Dinars daily from your security deposits according to Article
- 6 - of the General Conditions sheet, and you have no excuse in any case according to the same article which states (Any objection
submitted by the contractor for his delay in the work will be rejected). Your dispute with the Community's engineer does not justify your failure or delay according to the fifth article of the same
sheet, which states "-
The supervising engineer has the right to change the maps and quantities as he sees fit, and the contractor has no right to object to that,
and the surplus or deficit quantities are priced according to the contractor's price in the bill of quantities.
Therefore, the Administrative Committee warns you according to the sixth article of the second page of the General Conditions, which states
"The two contracting parties waive the serving of warnings from one to the other via the Notary Public regarding the affairs of this contract,
and every warning directed from one of the parties must either be delivered to the address of the other party or sent to it by registered mail."
The Administrative Committee warns you according to this article to begin work at a date no later than Tuesday, corresponding to 22 / 1 / 1957, and in
the event that you do not begin on the aforementioned date, the Community may be forced to exercise its right according to Article - 18 - and it will complete the work on
your account based on the provisions of that article.
If you do not begin work on the mentioned date, you are requested to attend on Tuesday of the same previous date in the evening to conduct the necessary
inventory according to what is stated in Article - 18 - and in case you or your representative do not attend, the Community will be forced to conduct the necessary inventory
according to what is stated in Clause C of Article - 18 - which states "-
If the contractor does not attend or does not send a representative to act on his behalf, the inventory shall be conducted in his absence. We inform you that the Community will stop paying
any amount to you until the work is completed according to what is stated in Article - 18 - and the text is (The Community may refrain from paying any amounts
due to him until these expenses and losses are settled). The Community prevents you from removing any materials, tools, or scaffolding belonging
to you in case you do not begin work on the mentioned date according to Article - 18 - of the General Conditions.
This warning does not prevent the Community from upholding its right to fine you according to what is stated in Article (6), just as its order to you
to start work is not considered an acknowledgment of the quality of the work that has been completed.

Subject: Settlement of the new building account at the school
Greetings,
With reference to the letter from Mr. Saleh Yousef, the engineer, dated 7 / 2 / 1957, addressed to
your respected committee and a copy to us, please be informed of the following:
1- The roof of the water jar room (Al-Habbab), which was damaged by the contractor's workers during their work
on the new building, has not yet been completed, noting that this causes the drinking water jars to be constantly
contaminated with dust and rainwater.
2- The locks of the five doors have not yet been changed as stipulated in the contract according to what was mentioned by Mr. Saleh
Yousef.
3- There are still some paintings on the building's windows that have not been completed yet.
4- It is necessary to complete the painting of the walls permanently from the outside and inside and to repair some spots on the internal
walls after completing the painting on the windows of the rooms.
5- It is necessary to replace one of the doors as it is smaller than the door opening by about half a foot.
6- There is a section of the roof directly above the toilet that remains without leveling and without
an outlet for water drainage, which harms the walls of the new room.
Furthermore, although these deficiencies do not cost much to complete, they prevent us from
using the new rooms that we are in dire need of at the present time. Therefore, please request
the contractor to complete them before settling his remaining debts as soon as possible.

Report of the investigation committee on the incident that occurred at
the school's annual party on: ⟦illegible⟧
At 7:30 PM on Thursday, corresponding to 5 / 6 / 1958, while
the party was continuing to present its artistic program, the following occurred:
1 - While one of the female students was delivering a speech in English, a commotion occurred in the
rear side of the area designated for invitees due to a dispute between one of the guards and a person
who tried to enter without an invitation card, and the guards were able to remove him.
2 - After a period not exceeding five minutes, the commotion was repeated in the same place again,
so we, the members of the committee, rushed to the scene of the incident and it became clear to us that the mentioned guard had suffered a wound to his head.
3 - We immediately requested an ambulance for the injured person and transferred him to the hospital, and we also informed
the police station of the incident, and the station officer arrived and conducted the necessary investigation at the time.
4 - It appeared from the investigation that the person who caused the commotion is the one named ( ⟦illegible⟧ )
from the residents of the Bataween area, and he was arrested by the police.
5 - The party continued presenting its segments as usual, and this incident did not affect the progress of the program,
and the party ended at eleven o'clock in the evening.

This contract was concluded between the Presidency of the Jewish Community (hereinafter known as the Community)
And between ⟦Yaqub Cohen⟧
Known hereinafter as the Contractor, who for the purpose of this contract has taken an office in ⟦Building⟧
⟦Al-Daftarji, second floor, apartment No. 88⟧. At this address, registered letters sent to him
or warnings, orders, and instructions delivered to him by hand are considered valid delivery and notification.
The engineer or engineers ⟦—⟧ the engineer who executes this contract on behalf of the Community
is the Community's engineer or any other engineer or engineers appointed by the Community in writing in this capacity, and the
Contractor shall be notified of their names for the execution of the work stipulated in this contract. The Contractor has also agreed hereby
to provide - in accordance with the terms and conditions contained herein and in the specifications, price schedule, and maps -
the construction materials stipulated in the general conditions and all workers, machinery, equipment, tools, and instruments,
scaffolding, guards, and everything that is necessary or may be necessary for the works and services covered by this
contract and to complete them fully with the highest degree of perfection and craftsmanship in the execution of the "construction of a classroom and a storehouse" in
Frank Iny School in Baghdad.
The Contractor acknowledged that he has visited the work site and has reviewed in full, accurately and precisely, all
the maps and the work to be performed under this contract, as he has also reviewed the work
site and the location for storing construction materials and water installations.
The Contractor agrees to carry out the construction of the classroom and the storehouse according to the relevant issued maps and those which
the supervising engineer may issue in the future, the schedule of works and prices, general conditions, and technical
specifications in full in all respects, for a total lump sum amount of ⟦1436.925⟧ Dinars (in writing)

Secret tender for the construction of a classroom and a warehouse for the Frank Iny School in Baghdad
General Conditions
1- The bidder must submit cash security in the amount of -/30 Dinars, and this security may be submitted in the form of
a letter of guarantee from a bank to the Presidency of the Jewish Community in Baghdad.
2- The bidder must submit the contract documents in a sealed envelope at or before 12:00 PM on
corresponding to 20/9/1956 to the Presidency of the Jewish Community in Baghdad, provided that it is written on the envelope
(Secret tender for the construction of a classroom and a warehouse for the Frank Iny School in Baghdad).
3- The Community reserves the right not to accept the lowest-priced tenders and has the right to reject any tender without giving
reasons for doing so.
4- Any tender not submitted at the time specified in paragraph (2) above or not accompanied by the specified security
will be subject to neglect.
5- The supervising engineer has the right to change the drawings and quantities as he deems appropriate, and the contractor has no right
to object to that, and the excess and deficient quantities shall be priced according to the contractor's price in the bill of quantities.
6- If the contractor delays in completing the work within the period specified by him, he must pay three Dinars
(3 Dinars) daily to the Jewish Community in Baghdad, and any objection submitted by the contractor regarding
the delay in work will be rejected, and these compensations will be deducted from his entitlements or security deposit.
7- When the quality of any material present in the bill of quantities is not mentioned, the supervising engineer alone will be responsible
for choosing it as he deems appropriate, and the contractor has absolutely no right to object to that.
8- The contractor must specify the period he needs to complete the work, and this period will be taken into consideration
when studying the tender.
9- Bidders must sign all the drawings attached to this tender as well as all pages of the tender
and return them within their bid.
10- Materials
The contractor must provide all materials necessary for the work and fixed in the drawings and the price schedule, and
the contractor alone is responsible for all materials and tools at the work site and is responsible for every
theft or deficiency that occurs therein, noting that all materials at the work site are considered property of the Jewish
Community until the completion of the work, and the contractor has no right to remove or dispose of them except with the
written approval of the Jewish Community.
11- Dismissal of the contractor's employees
The engineer has full authority to request that the contractor dismiss or exclude any of his employees whom the
Community deems undesirable or unsuitable for continuing in the work, and the contractor must implement those requests immediately
upon their issuance, and he has no right to claim any compensation or indemnity that may result from that in any form whatsoever.
12- Advances
The Community pays cash advances at the end of each month for completed works and materials supplied at the site
of work after obtaining a certificate from the engineer to that effect, on the basis of 90 percent of the cost
of completed works according to contract prices and 75 percent of the value of construction materials supplied at

the work site according to its local estimation. Provided that these advances granted to
the contractor are not considered an admission of acceptance of the work by the Community; rather, the terms of the contract apply to all
completed and uncompleted work until it is finally handed over to the Community.
13 – Final Measurement and Settlement of the Contractor’s Account
After the work is fully completed in all respects as certified by the Community's engineer, the Jewish Community
shall take provisional delivery of the work, and the contractor’s account shall be settled according to the agreed-upon lump sum amount
in this contract, after deducting all advances paid to the contractor on account of his work. As for
the contractor’s security deposits, the Community shall retain them for the maintenance period and return them to him upon its conclusion and after the
final handover of the work.
14 – Rejection of Work
The engineer has the right to reject any materials supplied by the contractor or any work which, in the engineer's view, is based on
quality and workmanship that do not meet the required standard or are not compliant with the relevant specifications or drawings
of the contract. The contractor must remove the rejected materials and work and re-execute them at his own expense,
including the materials present in the rejected work.
Any work carried out without authorization in addition to the details given in the drawings or
issued instructions will not be recognized, measured, or paid to the contractor for the value of the materials
used in the execution of such works.
15 – Maintenance Period
The contractor shall maintain the work for a period of three months from the date the Community takes delivery of the work from him
provisionally. He must repair all deficiencies or defects that may appear during the maintenance period
at his own expense. The security deposits or what remains of them shall be returned to him after deducting the amounts due
from him properly at the end of the maintenance period and after the contractor has fulfilled his obligations and the
final handover of work from him has been completed.
The contractor must carry out the repairs requested by the Community within one week from the date
of written notification. If he fails to perform the work, the Community shall withdraw the security deposits belonging
to him if they are in the form of a bank guarantee, and carry out the work at his expense and deduct the amount from him.
16 – Notices
The two contracting parties waive the right to direct notices from one to the other through
the Notary Public regarding the matters of this contract. Every notice directed from one party should
either be delivered to the address of the other party or sent to them by registered mail.
17 – Labor Laws
The contractor is responsible for applying the Labor Law regarding all labor matters and observing it
concerning wages for official holidays, feasts, and compensation. He is also responsible for accidents that
occur to his employees at the work site and must pay all compensation resulting therefrom,
as the Community is not responsible at all regarding the laborers.

18 – Withdrawal of Work from the Contractor and its Consequences
⟦line⟧
A – If the contractor fails to start the work promptly upon receiving written notice to do so.
B – Or if he falls short in performing the execution of works with the required speed.
C – Or if he fails to perform the execution of works in accordance with the contract.
D – Or if he delays in completing the works beyond the deadline specified in the contract.
E – Or if he actually stops work for a period of fourteen days without written permission from the Community, unless
he proves the existence of force majeure and immediately informs the Engineer and the Community in writing.
F – Or if he fails to supply or install machinery, labor, materials, and equipment that are sufficient and appropriate so that
the permanent work can be executed quickly and without interruption.
G – Or if he commits, personally or through an intermediary, any violation of any provision or provisions of the contract he is bound
to execute or observe, and continues in this violation for a period of 14 days (taking into account any special condition
stipulating a shorter period) after being warned in writing by the Engineer to rectify this violation.
H – Or if he abandons the work entirely.
I – Or if the contractor becomes (whether in Iraq or abroad) bankrupt, or if he files
an application for bankruptcy, or if his financial insolvency is proven, or if he reaches a settlement with his creditors, or if the contractor is a company and it
has been liquidated, whether the liquidation was compulsory or voluntary (unless the voluntary liquidation is intended
for the re-formation of the company on a basis approved in writing by the government), or if the contractor is a company
and it was dissolved, or if the contractor gives, promises, or offers a gift, advance, reward, or benefit
of any kind to any employee or worker among the Community's employees, whether he is independent or has any
relation to the work subject of this contract, then the Community may, in any of these cases:ـ
1 – Withdraw from the contractor the execution of the remaining works.
2 – The withdrawal of the execution of the remaining works shall be according to what was previously mentioned by sending a written warning
by order of the President of the Administrative Committee of the Israelite Community to the contractor, and this
warning shall be valid and effective without taking any legal or official procedures.
3 – If the contractor is granted any extension or leniency, this does not reduce or prejudice the rights of the
Community under this article, and the preceding provisions do not affect the Community's right to
claim the compensations established under the laws in force.
4 – In the event of withdrawing the work or part of it from the contractor according to what was previously explained or
according to any other provisions contained in the contract, the Community may, at its discretion regarding cost,
exercise one of the following rights:ـ
A – To perform itself, at the contractor's expense, the execution of all the works that have not been completed
yet, or any part thereof.
B – To put all or some of the works that have not been completed yet out for tender again.

C - To agree with one of the contractors privately to complete the work.
In all these cases, the Sect shall have the right to seize all or some of the machinery,
tools, and materials brought by the contractor and to use them to complete the work
without being responsible to the contractor or others for these machines, tools,
and materials, nor for any damage or decrease in value that may occur to them for any reason, and without being
responsible also for paying any amount due for them to another party or paying any fee for them
to the contractor or others. The Sect shall have the right in any case to seize all or some of
the machinery, tools, and materials even after the completion of the work as a guarantee for its rights.
The contractor must pay the Sect all the expenses it incurs in this regard
in excess of the contract value, and he must compensate it for all the losses it incurs because of
that. The Sect may deduct the value of the expenses and losses referred to from the amount
of insurance or from the contractor's claims or from any money belonging to him; however, if the work costs
less than the contract prices, the difference shall not be returned to the contractor.
For this purpose, the Sect may refrain from paying any amounts that have been granted
to him until these expenses and losses are settled, and the Sect may sell the machinery, tools,
or materials brought by the contractor without being responsible for any loss
incurred by him as a result of their sale.
In the event of withdrawing the work from the contractor, an inventory list shall be organized for the works, buildings,
tools, equipment, and materials located at the work site, and for the work that has been completed in a satisfactory
condition, by the knowledge of the responsible Sect engineer. This inventory shall be conducted in the presence of
the contractor, who must be officially notified to attend, he or his representative. If the contractor does not attend
or does not send a representative on his behalf, the inventory shall be conducted in his absence.
This inventory shall be confirmed by a report signed by the Sect engineer
and the contractor or his representative. If any dispute or conflict arises regarding the state of the existing
work, this dispute or conflict and its nature must be recorded in the aforementioned report.

The broken bricks shall be of the hard-fired type with a thickness of 12 cm. The price includes the process of pounding with iron rammers well, spraying with water, and grouting with cement mortar in a ratio of (1 - 5).

The concrete ratio shall be (1-3-6) of cement, Habbaniyah sand, and washed river gravel of graded size (1 inch and below). The sand must be from Habbaniyah Lake sources, and river sand may not be used at all for any construction purpose except with the engineer's approval.

The bricks shall be of the fired type, and construction shall be carried out with cement mortar and Habbaniyah sand in a ratio of (1-5) from the start of the concrete pouring for foundations up to five courses above the damp-proof course (DPC). It is not permissible to use broken or used bricks. The fired bricks shall be submerged in water before construction for a sufficient period of not less than six hours. All vertical and horizontal joints shall be filled with cement mortar, and the process of spraying the walls with water shall continue for a period of not less than seven days. The price includes all of the above in a professional and good manner (and the sect's engineer has the right to reject any part of the construction that he does not see as conforming to technical conditions or because it contains salts).
