The Iraqi Consulate General in Jerusalem has informed us that the General Secretariat of the Government of
Palestine informed them that the notification was indeed served to Mrs. Nazima Daoud Balas, but the Deputy
Chief Registrar returned the documents directly by mistake to the Baghdad Court of First Instance, and we
asked the aforementioned court and it informed us in its letter No. 2502 dated 6 / 4 / 1947
that it had not received the documents.

Inquiry regarding a Sharia matter
Baghdad Criminal Court
Reference to your letter No. 991 dated 4/19/1947.
We have referred your letter under discussion to the Israeli Religious Court in Baghdad, and it responded
as follows:
Betrothal is a legal contract by which the woman is designated to the man and sanctified to him by her acceptance,
even with a ring given to her hand to hand in the presence of two legal witnesses, saying to her in Hebrew: You are sanctified to me
as a wife with this ring, or with such and such if it were something else. This contract cannot be annulled except after performing
the legal divorce ceremonies, as if the marriage contract had actually taken place. ((Book of Ibn Ha'ezer, Chapter 26,
referenced on page 17, Article 56 of the Book of Sharia Rulings on the Personal Status
for Israelites, printed in Egypt)).
Note
The expression 'betrothal' mentioned in the aforementioned Book of Sharia Rulings is intended to mean ((possession
or engagement token)), however the word 'betrothal' appearing in certificate No. 52 dated 1/14/1947 issued
by this presidency mentioned in your letter is intended to mean ((Sanctification)) mentioned in the Book of Sharia
Rulings mentioned above, and we have explained the ruling of Sanctification ((Betrothal)) in the first paragraph above.
It is not required for the betrothal contract (Sanctification) to specify a named term or a predetermined dowry; however,
if any condition of this kind is agreed upon, it becomes binding.
The betrothal contract (Sanctification) may not be annulled except by the agreement of both parties or by a decision by the Sharia
Court, after performing the legal divorce ceremonies - Book of Ibn Ha'ezer, Article 3, Chapter 26 -
(Referenced in Article 60, page 18 of the Book of Sharia Rulings).
The intended meaning of the word (Kinyan) is the legal oath.
Note
The ((engagement token or possession)) contract must be documented with Kinyan, however there is no need to document
the betrothal contract (Sanctification) with Kinyan.
If the betrothed woman marries someone other than the fiancé on her own initiative while she is an adult, the betrothal is not considered
annulled, and a legal lawsuit must be filed to annul it by performing the legal divorce ceremonies - Book of Ibn
Ha'ezer, Article 5, Chapter 17. If the betrothed woman converts her religion to a non-Israeli religion, the betrothal is not considered
annulled unless the legal divorce ceremonies are performed - Book of Yoreh De'ah, Article 2,
Article 323 of the Book of Sharia Rulings.

With reference to your letter number 162 dated 4/18/1947 and in view of the excuse you kindly
offered regarding the inability of His Eminence Rabbi Salman Hooki to attend the court,
who was summoned to be questioned about certain religious laws, we have decided to waive his attendance
at the court and we present to you the religious matter that requires clarification for an answer according
to the Jewish religious laws. We hope to receive the answer before 4/28/1947.

The Religious Matter
Your community presidency issued an engagement certificate numbered 52 dated 1/14/1947 stating
that Yusuf Mordechai had entered into an engagement in Baghdad with Miss Alice Baruch Ezra. What is the
religious ruling on the engagement? Is the engagement a contract in which the two engaged parties agree to marry each other legally at a
specified time with a determined dowry and conditions they agree upon (as stated in the book of Religious Laws on Personal Status
printed in Egypt)? And is it valid to cancel the engagement by the will of one of the parties or to annul it by the will of one of them?
And does it require the performance of religious ceremonies to annul this engagement, or is it considered rescinded by mere withdrawal
by them or by one of them without the need for religious ceremonies? And what is meant by the word (⟦illegible⟧)
mentioned in the Jewish religious laws?
If the fiancée marries someone other than the fiancé on her own volition while she is an adult, is the engagement considered
annulled, or is it required to file a religious lawsuit to rescind it? And if the fiancée changes her religion to another,
is the engagement considered rescinded automatically?
Please state the religious rulings you rely on in your answer for reference, and we hope ⟦illegible⟧
the rulings and rules contained in the two works Neve Shalom and Nahar Misrayim containing the personal status
religious laws.
