Subject: Observations on the budget of the Midrash schools
To the Presidency of the Honorable Lay Council
1) It was stated in the revenue section of the Midrash schools' budget for the year 1930 - 1931
an amount of four thousand rupees (4000) under the name (Midrash's share of the revenues of the Nuriel endowments)
And in my capacity as the bookkeeper of the Midrash administration, I wish to draw the attention of the honorable Council to the fact that this
amount has not been received yet and has not been recorded in the books of this administration as revenue. Regarding this matter,
much correspondence has taken place between the agent of the endowment trustee and the Council through the Schools Committee, and we have not
obtained a result for it until now. In the letter from the assistant director of the Midrash school dated August 20, 1930,
attached to this report, he requested the Council's approval to file a lawsuit against the administration of the Nuriel endowments in the civil
courts to obtain this amount for the Midrash administration.
You see that the administration is not yet confident that obtaining the mentioned amount is within the realm of possibility; therefore,
including the amount within the revenues of the year 1930 - 1931 must have been an oversight.
2) The Council has an old claim against the Midrash schools administration amounting to five thousand rupees, and the
previous Council communicated its decision to the Midrash administration regarding the necessity of paying the mentioned claim from the rental fees
of certain properties. Regarding this matter, there are reports and correspondence that the Council can review in the Midrash file
kept at the administration headquarters. Therefore, I saw fit to draw the attention of your honorable Council to the necessity of addressing

I hope your schools' budget will be finalized as we arranged with you in the school administration, and I also hope you will resolve
the issue of this year's deficit approved by the previous council.
What occupies my thoughts greatly is the issue of the Naoum School, and your Excellency knows it: this school cannot
continue in the coming year solely with its income from the solution, so the situation must be addressed. I ask you to deliberate
on the matter in one of your sessions and resolve this subject.

In response to the petition of Rabbi Yehoshua dated August 23, 5690, referred to me
on August 17, 1930
The aforementioned Rabbi was receiving, prior to March 3, 1929, 40 rupees on account
of the Spiritual Court clerkship and 60 rupees on account of the slaughterhouse. The previous Council decided in its
ninth session held on March 3, 1929, to add 40 rupees to his monthly salary on account of the clerkship of
the Spiritual Court, provided that this decision takes effect from a year and some months ago; thus,
his total salary became 140 rupees.
The aforementioned Rabbi informed me today that he has other information regarding
his salaries and he intends to attend the next session to provide the necessary clarifications.

In response to the petition of the broker Aboudi Safi dated August 14, 1930, which was referred to me on
the 18th of it, I hope to inform you of the following:
1) That the aforementioned broker participated in conducting the brokerage for the Nabla auction with the broker Yaqub
Hazqil Mukhtar.
2) That the brokerage conditions stated in the auction paper are that the total brokerage fee is half a percent;
half of it is deserved by the broker who brings the final bidder through whom the commitment contract is completed and definitively assigned to his custody, and the other half is deserved by the broker appointed by the Council, who is Yaqub Mukhtar.
The brokerage fee is collected in full from the contractor and given to the two aforementioned brokers by the Council.
3) This department has no knowledge of what took place regarding the Nabla contracts, and I submitted to His Eminence
the Acting Hakham Bashi on April 29, 1930, a report in this regard to waive responsibility; however, it has
come to our attention that the brokers have received their stipulated brokerage fees directly from the contractors, and this department does not have
details of the distribution of the brokerage fee to those entitled to it.

You will find enclosed the private letter in question along with a decision taken by the previous
Lay Council on 25 March 1930 regarding the approval of dispensing with the services of both the
hospital director and its accountant, along with another decision to spend an amount of 49 Rupees and eight Annas.
The accounting department did not receive this decision until after the resignation of the Lay Council, as it
had observations regarding the disbursement of the decided amount, so the mentioned decision remained among the papers
referred to the next Lay Council. This is for your command.

Reference to your letter dated the 21st inst. No. 1154
Awqaf Account: The Waqf is in fact indebted to the Lay Council for (1/5314)
Rupees, the amount paid from its fund for the construction of 13 rooms on the Shat coffeehouse floor
As we have pledged to pay this amount starting from 1/1 at the beginning of this year from the rental fees
of the mentioned properties, and the total of these rental fees ⟦which⟧ have been collected to date is 1362 Rupees. The reason for our failure
to present this amount is due to the fact that the Lay Council must pay us an amount of (4/2972)
Rupees, the remainder due to us from the total value of the papers we submitted which are in its possession, in addition to
the necessity of liquidating the account of expenses spent on Khan Bakr until this day.
We wish to liquidate all these accounts (debt and credit) accordingly, and if you agree to
that, we are ready to proceed immediately; otherwise, this can be postponed until the meeting of the new
Lay Council. Of course, there is no objection ⟦for me⟧ to liquidating these accounts so that no
unsettled account ⟦remains⟧ there.

An agreement has been reached between Gurji Abdullah Mukammal, Vice President of the Israeli Lay Council in Baghdad ⟦in addition⟧
to the aforementioned Council, hereinafter referred to as the First Party, and Dawood Sassoon, acting administrator of the endowments of Rika
Nuriel, in addition to the aforementioned endowments, hereinafter referred to as the Second Party, on the following:
First: The Second Party has leased to the First Party, and the latter has leased from him, the partitioned half belonging to the
aforementioned endowments of the Khan known as Khan Bakr, located on Bank Street, numbered (228/1 Ras al-Qarya), for a period of
fifteen years under five consecutive contracts, each for three years, provided that the term of each subsequent contract begins at the
expiration of the term of the contract preceding it, in accordance with the permission granted to the Second Party by the Baghdad Court of First Instance under
dossier number 439 for the year 929, dated December 12, 1929.
Second: The First Party shall renovate the leased property and construct upon it the building to be determined according to a map agreed upon by
the two parties. If they do not agree, the map shall be decided by a majority vote of a committee composed of two members of the aforementioned Israeli
Lay Council and the Second Party.
Third: The total rental amount for all contracts is one hundred and fifty thousand rupees, to be paid as sixty thousand rupees in cash,
sixty thousand rupees to be spent on the aforementioned construction, and one thousand rupees at the beginning of each year of the lease years, and the remainder shall be paid
in two equal installments, the first at the beginning of the fourteenth year and the second in the fifteenth year, provided that there shall be deducted from them
any amount the First Party is forced to pay as interest on any amount it needs to borrow to complete the aforementioned construction, provided
that such interest does not exceed four thousand rupees.
Fourth: The First Party shall commence drawing the map and start construction immediately, and must complete the construction within a period not
exceeding one year from the date of this agreement. Any delay resulting from the opposition of the
owner of the other partitioned half, Ali Saib Chalabi Al-Khudairi, shall not be counted within this year if his opposition necessitates delaying the construction. The method of construction,
purchase of supplies, and making decisions regarding them are all the right of the First Party, but the expenditure account shall be kept by a committee
composed of a number of persons appointed by the First Party, provided that the Second Party is a member among them, and they shall decide everything
necessary by a majority of votes. Every account submitted by the First Party for the total construction costs shall be accepted, and the Second Party has
no right to object to it.
Fifth: The date of completion of construction shall be determined by the two parties in writing, and the lease term shall begin from the date determined in this
manner. If the First Party leases some parts of the building before its full completion and receives an amount from that, it must add
everything it received in this manner to the last installment due in the fifteenth year according to the third
clause. Likewise, there shall be deducted from the mentioned installment, and from the installment and installments, everything spent on the construction or interest above
the limit specified for them in the third clause. If the mentioned installment is not sufficient, then from the installment or installments preceding it as well.
The surplus remaining from the amount allocated for construction or interest, if they do not
reach the limit specified for them, shall be added to the two last mentioned installments.
Sixth: The lessee may use the leased property as commercial shops, warehouses, or cafes, and may sub-lease it to others for any
period within the term of the preceding contracts, provided that the use by the sub-lessees does not cause more damage to the
leased property, and provided that no machinery such as printing presses or others that harm the place materially or morally be installed therein.
As for <del>that</del> property tax and every tax imposed on the leased property, it shall be the responsibility of the lessor, while the lessee pays the guard tax,
water, electricity, and sanitation fees.

Referred to me on the 11th of it
The administration of the aforementioned school requested on November 11, 1929
Payment of a deficit amounting to (254/12) rupees, and the Council decided in its session dated
January 5, 1929, to pay this amount provided it is deducted in three installments over three
months (January, February, March 1930)
So the installment for one month would be eighty-four rupees and fifteen annas (84/15)
Accordingly, the monthly allocations became (1290/6) rupees after they were
(1375/5) rupees, until the end of March 1930 as mentioned above
Since the accounting department was not notified of the details of this decision at the beginning of the fiscal year -
it did not pay attention to restoring the school's allocations as they were
Therefore, the administration's request in its aforementioned letter is a valid request
