We thank you very much for the information you sent us regarding the accounts of your association, and it has
occurred to us to clarify the following points from you, requesting that you kindly provide answers to them:
1) You did not indicate on the copy of the balance sheet of your association's account book printed on pages 2 and 3
the date it was extracted from the book.
2) We requested in our letter No. 3155 dated November 29, 1938, the details of the account
of the association's revenues and expenditures for the last year, while your respected association sent us on
pages 4 and 5 the annual budget statement. We now request you to kindly send the accounts
that we requested, provided they include the revenues and expenditures of your association actually
realized for the last fiscal year, meaning the year ending at the end of March 1938 (if
your fiscal year begins on the first of April of each year) and at the end of September 1938 (if
your fiscal year begins on the first of October of each year).
3) We noticed that the sources of your association's revenues mentioned in the annual budget are four: the first
source is subscriptions and donations, the second is the allocations of the Communal Council, the third is
the Alliance allocations, and the fourth is property revenues. Meanwhile, we found in reviewing the book balance sheet
that only two of these four sources are recorded in the book under two sections, namely the section
of subscription revenues and the section of property revenues. As for the Communal Council allocations and the
Alliance allocations, we did not find a section for them in the book balance sheet, and we do not know how these
revenues—meaning the Council and Alliance allocations—were recorded in your book. We request you to enlighten us on that.

The Lay Council had decided in its meeting held on 24 January 939
to inquire about the seven rabbis mentioned in Table No. 4 attached to your letter
No. 69 dated 11/1/939 as to whether they were students or teachers; if they were teachers,
then who are the students of the association, and if these are the students, then who are the teachers. We addressed
this inquiry to you in our aforementioned letter and requested that the answer not be delayed beyond
the 26th of the same month.
As it was our hope that your answer would arrive by the requested date, the Lay Council held
its meeting on the evening of the 26th to consider it; however, it was greatly surprised when it found that you had not
answered its question, and today is the fifth of February 939 and the expected answer has not reached us.
Therefore, we saw fit to remind you for the second time that the Council is still waiting for the answer, so it is hoped that

From the Tomchei Torah Society
To the honorable members of the Israelite community
It is not hidden from our brothers that in the year 5670, i.e., 22 years ago, the late H.R. Shimon Agassi
may his merit protect us, thought of establishing a society for the purpose of producing capable Sages to fill the void that was expected in the
community - and indeed a society was formed which he named the Tomchei Torah Society. And the aforementioned society
was managed by means of subscriptions and continued its purpose and service in a manner that calls for satisfaction because it
produced capable Sages standing upon the Israelite law and most of them attained important positions
in the community, whether in the capacity of judges or in the Spiritual Council.
And when the General War broke out, it continued under the presidency of H.R. Sassoon Moshe Dangour, and in the year 5680
the society was reorganized under the presidency of H.R. Shlomo Moshe Laniado according to a constitution approved by
the venerable Ministry of Interior.
And since the initiation of the new society, two classes were formed for teaching the judicial and civil sciences, as well as
teaching the Arabic and English languages.
And the student Sages continued in a persistent manner until each of them became proficient in the judicial sciences
and speaks the eloquent Arabic language and the English language.
As for the revenues, they have decreased tremendously because most of the subscribers have ceased, and likewise the
endowment properties belonging to the society have seen their rents decrease, a matter which led to the appearance of a deficit in the
budget. Furthermore, the allocations that the Lay Council used to provide were cut by half four
years ago on one hand, and on the other hand, the students' needs and salaries have increased
and are not sufficient for them because most of them are married and have become fathers of children, and the small salary they
receive from the society is not enough for them.
And at this time, the aforementioned Sages have not received a salary for five months due to the resulting deficit in the
society, therefore we have no hope left except in the zeal of the honorable members of the community who honor the
sacred duty incumbent upon them in such situations.
And the reason for that is that the Iraqi Israelite community has progressed to the degree that it has become
in need of Sages who suit the present age and what it requires of general knowledge for the Sages
to be able to perform their duty well. Especially since learning foreign languages helps
the Sage to understand foreign sciences and the conditions of communities in other regions, whether
from reading books or newspapers, and the field becomes wide before him to delve into
various sciences, making him a complete Sage who serves the interest.
Therefore, we repeat our request to the former subscribers to continue paying the subscription, and for new
and former subscribers to extend a helping hand as their zeal dictates to them. And that is to
the president of the society, H.R. Shlomo Moshe Laniado, may God protect and sustain him. And our hope is firm that everyone will perform his portion of
this mitzvah, and the mitzvah of the Torah shall protect you, Amen, may it be His will:

The Decision

This association has received a petition signed by Abdullah Ezra Sassoon dated / 14 Shevat 5694, and below it
an explanation appended with the signature of Rabbi Benjamin Rabbi Moshe dated / 14 Shevat 5694 under number 118. In
the aforementioned petition, a request was made by the petitioner Abdullah stating that he has a right in the Tomchei Torah Association
pursuant to a decision by the Israeli Sharia Council, and he demands the implementation of the said decision. The explanation in question includes
the fact that the said decision was indeed issued by the referred Council. Upon deliberation, it became clear that:
First - In fact, there was a decision, but the same aforementioned Sharia Council had overturned it
on the date of 14 Tevet 5687, with the joining opinion of the rest of the members of the Spiritual Council with His Eminence Rabbi David son of
Rabbi Yaqub and in the presence of Menashi Effendi Ibrahim Kurji, where it was stated in the last aforementioned decision that the two thousand
pounds endowed by Farha daughter of Solomon David Sassoon for the soul of the late Ronald Sassoon shall be spent as follows:
A - The properties shall be repaired from the revenues when necessary, and the remainder shall be distributed to the Rabbis belonging to Tomchei Torah.
B - The revenues shall be distributed under the supervision of the Tomchei Torah Association under the presidency of the Association's Rabbi at all times by agreement
of the Sharia Council.
C - The Rabbi who resigns from the Association in any form requires the appointment of another under the supervision of the Association and by agreement
of the Sharia Council.
D - Aid shall be distributed to the Rabbis who do not have an external salary.
E - The Rabbis are required to study "Poskim and Talmud" in Midrash Beit Zilkha.
F - On the anniversary of the death, they are required to read for the soul of the deceased.
G - The entry of the Rabbi <del>who</del> and his teaching with the Rabbis and the allocation of a salary for him from the revenues shall be under the supervision of the Association
by agreement of the Sharia Council.
Accordingly, the petitioner has no right to belong to the Association because:
1 - When the last decision was given, he was not among the ranks of the Rabbis ⟦af⟧filiated with the Association.
2 - He did not study with the Rabbis in Midrash Beit Zilkha and did not reach a level equal to theirs in religious sciences.
3 - Even assuming he had a prior right, his lack of attendance and non-acceptance according to the aforementioned conditions does not necessitate
his acceptance now.
4 - Furthermore, the Association's revenues are limited to specific persons and have been spent on Rabbis
who have reached a level that warrants appreciation in religious sciences and the "Poskim and Talmud," and
the current revenues are not sufficient to cover the salaries of the existing Rabbis. Therefore, it is not permissible in this case
to accept any person regardless of his status, considering the current situation of the Association, especially since
the petitioner had been absent for a long time from Baghdad and does not have sufficient ability to qualify him
for acceptance.

Jacob had paid to this committee an amount of three thousand five hundred rupees for the purpose of purchasing a property
in the name of Tomchei Torah. Unfortunately, due to the lack of the association's income and because the Lay Council did not pay
the previous allocations belonging to this association, we have paid these amounts for the salaries
of the rabbis and its teachers. Now, from the date of the past Hebrew month of Sivan, the association is in debt
for the salaries of the rabbis and teachers, and we hope to receive the accumulated amounts from the Lay Council in order to

society replied in its letter No. 43 dated September 14, 933, a copy of which is attached, that it spent
the funds amounting to 3,500 rupees on the salaries of the Rabbis, which was contrary to the donor's condition.
