1 - This vacant lot is included within the site of the Civic Center and is scheduled for expropriation by your esteemed Municipality.
2 - The area of this plot exceeds -/3000 m2 (thirty thousand square meters).
3 - This large vacant lot is located in a densely populated area and is bordered by more than fifty houses in addition to

4 - This Presidency has previously fenced this lot several times, but its fence was subsequently demolished, in addition to it being filled
with debris and waste thrown into it by neighbors and from the roofs of their houses.

Greetings and respect:
We have been notified of your warning numbered Center Unit 1236/10 and dated 3/3/1968 regarding the necessity of fencing

I would like to present to your Excellency the following information:-

Accordingly: Given the vastness of this lot and its location in a very crowded area, fencing it and removing the debris
from it does not solve the problem, as it will be filled with debris again by neighbors and residents in a very short period
that may not exceed one month.
Therefore, either your respected municipality lifts the disposal ban and permits us to dispose of this lot by subdividing,
partitioning, and developing it, or it instructs its competent departments to remove the debris from this lot
and level it at the expense of your municipality, as it has practically laid its hand on this lot.

Judge: -: Mr. Abbas Shikara
Endower / -: Ezra Dahim Daniel
On this day, Ezra Dahim Daniel appeared, and after being identified by the identification witnesses Meir Hakham Moshe Dangoor and Ezra Maseer
Baruch, he stated the following:-
I, of my own free will and choice, and in full possession of my mental faculties and maturity, have endowed the property consisting of the house located in the Taura neighborhood in Baghdad, which is divided into
two houses by an informal division and numbered with door numbers 139/73 and 14/313 according to the Tabu deed dated June 323 and sequence 312
and registered in the name of my late father Dahim Saleh Daniel and transferred to me as inheritance according to the two distributions from the Judge of Personal Matters under number
40/136 Sh dated 11/12/40 and 43/34 Sh dated 29/3/43 from my own property, and I have endowed it as a valid, final, and perpetual endowment
for the rest of the soul of my late mother Rifka daughter of Abdullah Alawi, provided that it be used as a clinic for the medication and treatment of the sick among the poor
of the Mosaic community, and that this clinic be named after my late mother Rifka Dahim Daniel. The trustee of this endowment shall have full rights
and absolute opinion in what he deems appropriate regarding the use of the entire endowed property as a clinic or a part of it, and any surplus that arises, he may rent it out
and spend the yield obtained from it, first on paying taxes, maintenance, and necessary repairs for the endowed property, and second on the medication and treatment of
the patients who visit that clinic, and in the absence of poor visitors to the mentioned clinic, it shall be spent on the poor Israeli patients
in Baghdad.
Furthermore, I have endowed, restricted, and delivered into the hand of the trustee of this endowment a sum of money amounting to three thousand dinars, of which two thousand
and five hundred dinars are for the purpose of spending them on building the clinic endowed by this endowment deed, furnishing it, and preparing it to be suitable for the mentioned purpose, and that
at the earliest time the trustee deems appropriate. Until the commencement of the construction, the trustee may invest the mentioned amount by purchasing government bonds
or similar guaranteed methods; the interest obtained from those funds shall be added to the endowed amount and used for the same purpose of
construction. As for the remaining five hundred dinars, they shall be spent for the necessary maintenance of the endowed property and its upkeep until the commencement of building the required clinic
and furnishing it.
I have assigned the trusteeship of this endowment to the Lay Council of the Israeli community in Baghdad, and in the absence of such a council
at any time, then the trusteeship shall transfer to the authority that takes its place.
The trustee must entrust the matter of managing and liquidating this clinic, including the spending of the endowed amount for the purposes for which it was endowed, to
the person or body that manages the Meir Elias Hospital within the limits set for it.
The person named Eliyahu Hayyim Tawfiq, the current president of the Israeli Lay Council in Baghdad, appeared according to the certificate paper
presented, stating that he is the president of the Israeli Lay Council in Baghdad at the present time, issued by the Presidency of the Israeli Community
on 26/4/1944. After being identified by the identification witnesses mentioned above, he stated: I have received in full and complete
the endowed amount of three thousand dinars from the endower, the aforementioned Mr. Ezra Dahim Daniel, and I pledge to preserve it and spend it
according to the conditions set forth in the endowment deed listed above.
Based on the above, a request was made to issue a deed for the mentioned endowment.
The Decision - In view of the above, the endowment has been completed and become binding, and it is ruled upon according to the conditions listed above, and it has become a valid
legal endowment. What occurred was recorded upon request on 30/4/1944 AD.
