Greetings...
I have learned that the Custodian of Frozen Assets in Babylon Governorate has approached the tenants of the shops and the khan located in
Al-Kass neighborhood in the city of Al-Hindiya, numbered sequence 918 and its annexes, belonging to the Sassoon Daniel Waqf, and informed them that he has seized
these properties and told them not to pay rents except to him. For this reason, this notice is sent to you informing you
of the following facts.
1 - These properties are waqf properties for all and are registered in the Land Registry Department as such; they do not belong to
Jews who have lost their nationality for your honorable secretariat to have the right of supervision over them. Rather, they are under the management of the entity specified
by the waqf founder for their management, which is the Administrative Committee for Iraqi Jews (the Israelite Community), and indeed these properties
are managed by the community now.
2 - Since I am a tenant under a legal lease contract for these properties from their source, their previous trustee, and this contract has been legally renewed
through the Notary Public according to the provisions of the Real Estate Lease Control Law, and this contract is still valid until now according to
the law, no entity is permitted to prevent me from benefiting from this leased property according to the lease contract. Accordingly, the notification by the Custodian
of Frozen Assets in Babylon to the tenants not to pay rent to me is an illegal act; we request that he be instructed not to
demand this from the tenants.
3 - From a legal standpoint, even assuming that your honorable secretariat has become the successor to the entity that was managing these
properties, my rights in the contract concluded between me and the predecessor from whom you received this right are valid against you according to
the provisions of the Real Estate Lease Control Law, which states that the new owner replaces the old owner in all contract rights.
Based on all this, I consider my lease contract for these properties to be legally valid unless it is rescinded or annulled by a competent court. Therefore, I request
not to be opposed in receiving rents from the tenants because the usufruct rights belong to me, otherwise I will be forced to pursue
legal channels regarding everything that contradicts this.
