With reference to your letter No. 1293/52/14 dated 20 / 7 / 1952, please note the following: -
1- It is not true what you imagined regarding the lack of interest of the Presidency of this community in your lists and various letters; the accountant has contacted
your company by telephone several times to inquire about the nature of the amount claimed by you, which is 25/651 Dinars, and about other details;
Upon investigating the matter, this Presidency did not find anything indicating the existence of a claim against it for your company in the amount of
25/651 Dinars.
2- We understand from the lists sent to us by your company, and among the details of the amount claimed, that the aforementioned amount is for the prices of
spare parts for a car and for its repair fees, knowing that this Presidency had one car used by the former President
which was deposited with your company on 15 / 12 / 1949, and sold on 28 / 2 / 1950, and this Presidency has not had any car after that
date until this day. From this, it is clear that there was no car with this community during the date of purchasing the materials mentioned
in your lists (June and July 1950).
Therefore, please inform us how the purchase of those materials from your company occurred, while stating the name of the person who visited you to purchase and receive them
and the number and type of the car for which those materials were used!

Based on the invitation sent by the letter of the Presidency of the Jewish Community, we attended the headquarters of the Community Presidency.
Upon inquiring about the purpose for which we were called to meet, it became clear to us that there are three endowments: the first
was endowed by Menahem and Sassoon, the sons of Saleh Daniel; the second was endowed by Ezra Menahem
and his sister; and the third was likewise endowed by Ezra Menahem Daniel, along with some properties for charitable branches.
In those endowment deeds, what is requested to be clarified in the first endowment is that after the death of
one of the trustees without offspring, the Lay Council participates in the trusteeship with the remaining trustee.
What is requested to be clarified in the second endowment deed is whether it is permissible for the trustee to send missions outside
Iraq as long as the endower stipulated the establishment of scientific institutes and as long as there is no need for scientific
institutes.
What is requested to be clarified in the third endowment is that since the endower stipulated using a portion of the endowed properties
to establish a school where professions, crafts, and trades are taught, as well as the manufacturing of clothes for
the poor and sending students outside Iraq to specialize in one of the industries, and after
the school was established and is carrying out its affairs of teaching professions and others, may the trustee send
students outside Iraq to specialize in professions?
After studying the three endowments and reviewing their contents and conditions, we present
our opinion as follows:
Answer to the first question - It is not permissible to involve the Lay Council in the trusteeship based on
the death of one of the trustees without offspring as long as it was stipulated in the endowment to transfer the trusteeship to the Lay
Council exclusively after the death of the trustees without offspring.
Answer to the second question - Since it was stipulated in the endowment that it is not permissible to spend any
amount whatsoever from the endowment's revenue for purposes other than the school in one of the articles and the second of the endowment
verified by testimony before the completion of the construction and establishment of the institutes, the trustee may not defy
the endower's condition and send students outside Iraq.
Answer to the third question - Since the trustee explained that the industrial school has been
established and is teaching professions and crafts, and due to the non-fulfillment of what the
endower stipulated regarding budget matters, the trustee may send missions outside Iraq
to specialize in professions and crafts.

Text of the Request for Fatwa
A man endowed a property and stipulated that its revenue be spent on a specific charitable cause, and he appointed two trustees over the mentioned endowment, provided that
the trusteeship passes after them to their descendants, and upon the extinction of their descendants, the trusteeship returns to the Lay Council of the Jewish Community
in Baghdad.
Then it happened that one of the two trustees died, so the endower appointed another trustee in his place and likewise stipulated that the trusteeship be for each of
the first trustee and the newly appointed trustee, provided that the trusteeship passes to their descendants after them, and upon the extinction of the descendants
the trusteeship is restricted to the Jewish Lay Council in Baghdad.
Now, since the endower had appointed two trustees and one of them died without descendants, does the trusteeship pass to the Lay Council
jointly with the other remaining trustee upon the death of one of the two trustees without descendants, or does the living trustee continue to exercise the trusteeship alone
without involving the Lay Council?
Please advise us, and may you be rewarded ⟦line⟧
The Answer
Since the endower stipulated the transfer of the trusteeship to the descendants and after the descendants to the Lay Council after the death of both of them,
if both trustees have not passed away such that one of them remains, then the trusteeship does not pass to the descendants
for whom the trusteeship was stipulated after the two previous trustees, nor does the trusteeship pass to the Lay Council
for whom the trusteeship was stipulated after the descendants. As for the current situation, the judge, if he wishes,
may appoint a partner with the remaining trustee in place of the deceased, and if the judge wishes, he may grant the remaining one sole disposal over it.

My dear Haham Khedoury,
I am in receipt of your letter of
1st June, ref No.3372/74, in which you informed me that
there was no possibility of writing Gittim for Mr.Katzuri
ben Tzalah Daniel for his wife Mrs.Naima bat Menasche or for
Farha Bat Ezra the wife of Moshe Ben-Zion Selav, of Baghdad.
From your letter I presume that you
probably have no Sopher who could write the Gittim.
Would it be possible for you to call
another two people to constitute a Beth Din with yourself.
You could then ask Mr.Katzuri ben Tzalah Daniel and Mr.Moshe
Ben-Zion Selav to appear before this Beth Din and I am enclosing
two Harshaot for each party, the top copy of which you could
read to whichever one of them it applies and they could be
asked to sign in the appropriate place at the foot of the
Harshaa appertaining to each one of them. You and your
colleagues should confirm the signatures.
This would empower our Beth Din here
to permit the Sopher named in the Harshaot to write the Get
which could then be delivered to the respective wives of these
people who have now been separated from their husbands for a
number of years.
The second Harshaa in each case should
be signed by you and your colleagues confirming the statement
of each party.
I should be very grateful if you could
deal with this matter as expeditiously as possible, because as
I mentioned above, we must have pity for these two women who
are still bound to their husbands although their husbands have
no responsibility for them whatsoever.

of my hand below I hereby appoint as witnesses to sign the bill of divorce that the scribe Tzvi son of Avraham Zeev shall write who shall see
my signature below and even up to a hundred bills of divorce until one of them is fit in writing and in signature according to
the Rabbinical Court that will arrange the divorce. And I hereby appoint Yitzchak son of Nachum HaKohen who shall see my signature ⟦line⟧
below as a delivery agent to deliver the aforementioned bill of divorce to my aforementioned wife and the scribe Tzvi son of Avraham ⟦line⟧
Zeev who shall see my signature below I hereby appoint to hand over the bill of divorce to the delivery agent Yitzchak son of ⟦line⟧
Nachum HaKohen aforementioned that he may deliver it to my wife Neima daughter of Menashe ⟦line⟧ and deliver it into her hand in any place ⟦line⟧
where she may be. And thus I say to the scribe Tzvi son of Avraham Zeev who shall see my signature below ⟦line⟧
write the bill of divorce that you shall write for my name and for her name and for the purpose of divorce to the delivery agent Yitzchak son of Nachum HaKohen ⟦line⟧
aforementioned. And to the delivery agent Yitzchak son of Nachum HaKohen aforementioned I say: Carry the bill of divorce that the scribe
Tzvi son of Avraham Zeev who shall see my signature below shall write to my wife Neima daughter of Menashe ⟦line⟧ and give it
into her hand in any place where she may be, and let your hand be as my hand, your act as my act, and your mouth as my mouth, and your speech as my speech
and your delivery of the bill of divorce that the scribe Tzvi son of Avraham Zeev who shall see my signature below shall write ⟦line⟧
and that he shall deliver into your hand to carry it to my aforementioned wife to deliver into her hand—as my delivery from my hand to her hand. And I give ⟦line⟧
you permission to appoint an agent in your place and an agent of an agent up to a hundred agents even without constraint. And when ⟦line⟧
the bill of divorce reaches the hand of my wife Neima daughter of Menashe ⟦line⟧ from the hand of the delivery agent Yitzchak son of Nachum HaKohen
aforementioned or from the hand of his agent or from the hand of the agent of his agent even up to a hundred agents, immediately my wife ⟦line⟧
Neima daughter of Menashe ⟦line⟧ shall be divorced by it from me and permitted to any man. And the appointment of the scribe Tzvi son of ⟦line⟧
Avraham Zeev who shall see my signature below to write the aforementioned bill of divorce and of the witnesses Ezra ⟦line⟧
son of Chaim and Raphael son of Yechia HaLevi who shall see my signature below and the appointment of the delivery agent
Yitzchak son of Nachum HaKohen who shall see my signature below aforementioned and the delivery of the bill of divorce into his hand by ⟦line⟧
the scribe Tzvi son of Avraham Zeev aforementioned as written above, I hereby express with my mouth and sign with my handwriting. And I hereby
cancel all notifications and notifications of notifications if I have issued regarding the bill of divorce and regarding all the aforementioned appointments and disqualify ⟦line⟧
their witnesses if they testify that I issued notifications. And I hereby take upon myself by ban and by the oath of the Torah not to cancel ⟦line⟧
the bill of divorce nor the agent nor the agency.
And I hereby come to sign in the city of ⟦line⟧ on the ⟦line⟧ day of the month of ⟦line⟧
year ⟦line⟧ of the creation of the world, and everything is ⟦line⟧ valid ⟦line⟧ and established.
In a session of three of the Rabbinical Court as one we were and there came before us ⟦line⟧
and signed the deed of agency and read before us all the words of the deed of agency written above and we validated it
and established it as is proper.
