When I received from Mr. Salim all the properties in his possession, I began inspecting them one
after the other. After that, I received information that the house numbered 28 located in the neighborhood of
Taht al-Takiya is a pure property that was endowed by Rachel daughter of Eliyahu Yami Sheikh Slon
according to the endowment deed issued in the Personal Status Court at the Baghdad Court of First Instance, number
91 / 22, serial number 44, dated July 10, 1922, stating the endowment of this house for
the poor sick Jews wherever they may be, and the trustee shall be the head of this community in the form of the endowment.
Then I went to the house itself in the town and asked its resident, from whom are you renting? He said to me,
"I have rented this house for 4 years." And what is your name? He said, "My name is Arif Lazim. I rented it from
the General Custodian of Frozen Assets for five dinars per month, and now the Income Tax Department has expropriated it
to expand its office." I inquired about the neighbors of this house, whether the appraisal
for the ten neighboring houses for the tax was at a good value or not. They said yes, and pointed to
a very small house located next to the Community's house and said, "This house was appraised at an amount of
1700 dinars, while our house is double the size of the neighboring house."
So we request your Excellency to refer this case to the lawyer:
1- To collect the rent payments for these past four years from the General Custodian.
2- To object to the appraisal if it is inappropriate.
3- To collect the price and hand it over to the respected Head of the Community.

28 / 120 to the Presidency of this community in its capacity as the trustee over the affairs of the endowment, is not registered in the Land Registry (Tabu) department.
2 - The endowment becomes binding as soon as a ruling is issued by the Personal Status Court that has acquired final status, and
the failure to register the endowment deed in the Land Registry department does not diminish its binding nature.
Accordingly, we see no place for the question mentioned in your letter referred to above as long as the endowment document is explicit that the said property
belongs to the Presidency of this community. Therefore, we emphasize our previous letter, requesting the handover of the house to the Presidency of this community.

Your esteemed General Secretariat has rented out the house numbered 28 / 120 located in the Sitt Hadiya neighborhood, which belongs to
the presidency of this community as an endowment (waqf), on the grounds that it is frozen property belonging to its owner Rachel Elisha Benjamin, but this house
in question had been endowed by the aforementioned Rachel daughter of Elisha for the poor Mosaic patients in the Meir Elias Hospital,
provided that the trusteeship of this endowment be for the head of the Israelite community in Baghdad, in accordance with the endowment deed issued by the Personal Status Court

Based on the occurrence of a legitimate excuse, this court has sent as its deputy the First Clerk Abdul
Jabbar Effendi to hear the report of the endowing mother, Rachel daughter of Elisha, regarding the endowment of her house numbered 120/28
located in the Sit Hadiya neighborhood. The aforementioned clerk went and held a Sharia council there, attended by
the woman named Rachel daughter of Elisha Yamin Sheikh Sassoon, after her identity was verified by the neighborhood mukhtar
and the two witnesses, Shimon Reuben and Sassoon Haham Hesqel. She stated, saying: I, Rachel daughter of Elisha Yamin Sheikh
Sassoon, by my own will and choice, and in full possession of my mental faculties and maturity, acknowledge and confess that I have endowed what is my property and under my disposal,
the entire house belonging to me located in the Sit Hadiya neighborhood, numbered 120/28, and I have removed it from my ownership
and made it a valid and binding endowment for the sake of God Almighty, in its specific and general parts with all its contents, not to be sold
nor bought, nor shall any transaction be conducted upon it, provided that the trusteeship be according to the following conditions:-
First - Making the mentioned house an endowment, sequestering its revenue, and spending it first on the necessary construction and restoration for it,
and the surplus of the revenue shall be spent on the sick among the poor Israelites who are in the Meir Elias Hospital.
In the absence of these poor people in the mentioned hospital, it shall be spent on the poor Israelites present
in the hospitals of the Israelite community in Baghdad. In the absence of these poor people in the Israelite
hospitals, it shall be spent on the sick poor of the Israelite community wherever they may be in Baghdad.
Second - I have appointed the trustee to be the head of the Israelite community in Baghdad, and the supervisor of the mentioned
