We confirm to Your Excellency the request contained in the aforementioned petition, requesting the favor of notifying the Governorate of Baghdad in this regard so that it
may complete its expropriation procedures for the house under discussion. In doing so, you will have answered our request with thanks, in addition to the confirmation from the

Baghdad 24 / 8 / 1955 His Excellency the Chairman of the Administrative Committee of the Israelite Community, the Respected After greetings: When I received from Mr. Salim all the properties in his possession, I began inspecting them one after the other. After that, I received news that the house numbered 28 located in the neighborhood of ⟦Taht Takia⟧ is an absolute property that Rachel daughter of Shaya Isaac Shalom had endowed according to the endowment deed issued by the Personal Status Court in the Baghdad Court of First Instance, numbered 91 / 2 / 33 sequence number 144 and dated July 22, 1933, stating the endowment of this house for the poor sick Israelites wherever they may be, and the trustee shall be the head of the community. This is a copy of the endowment deed. Then I went to the house itself yesterday and asked its occupant, from whom have you rented? He said to me, I rented this house 4 years ago. And what is your name? He said, my name is Sergeant Lazim. I rented it from the General Secretariat for Frozen Assets for five dinars monthly, and now the Income Tax Department has expropriated it to ⟦swallow⟧ its department. I inquired from the neighbors of this house whether the appraisal of the ten houses adjacent to the Tax Department was at a good value or not. They said yes, and pointed to a very small house ⟦and its walls are patched⟧ to the walls of the community's house and said this house was appraised at an amount of 1700 dinars, while our house is double the size of the neighboring house. Therefore, and due to the lack of proof of the revocation of the nationality of the owner or her heirs if she is deceased, the General Secretariat has the right to seize the house and utilize it. 1 - The endowment deed (waqfiyya) attached to our letter No. 2298 dated 30 / 1 / 1952, which proves the ownership of house number
28 / 120 to the Presidency of this community in its capacity as the trustee over the affairs of the endowment, is not registered in the Land Registry (Tabu) department.
2 - The endowment becomes binding as soon as a ruling is issued by the Personal Status Court that has acquired final status, and
the failure to register the endowment deed in the Land Registry department does not diminish its binding nature.
Accordingly, we see no place for the question mentioned in your letter referred to above as long as the endowment document is explicit that the said property
belongs to the Presidency of this community. Therefore, we emphasize our previous letter, requesting the handover of the house to the Presidency of this community.
