In response to your inquiry included in your above-mentioned letter, we inform you of the following: -
1- When a teacher subject to the provisions of the Private School Teachers Pension Fund Law
No. 58 of 1969 resigns of his own accord, he loses his right to the bonus regardless of his service except for the Arab teacher
. However, if his services are terminated as a result of circumstances beyond his control, such as the closure of his school or the school
dispensing with him for exceeding its staff requirements or due to his illness or retirement upon completing sixty years
of age, he is entitled to the bonus if his services are less than (15) years and is entitled to the pension salary
if his services are more than (15) years. The pension bonus and pension salary are estimated according
to the principles stated in the Civil Pension Law currently in force, and cost-of-living allowances are not granted
to the retiree, in accordance with what was stated in Article (22) of the above-mentioned law.
2- Article (26) of the above-mentioned law shall apply to a teacher who resigns as a result of being appointed to
a government position.
3- As for what concerns the Social Security Fund, the Council has no connection with its instructions, and the resigned teacher
from service - if a decision has not been issued to add his previous services in private education as service for pension purposes
under Law No. 58 of 1969 - may consult the institution regarding his entitlement.
