2 - The following is added to Article 16 of the law to become paragraph (3) thereof, and the sequence of the
following two paragraphs therein is adjusted accordingly.
3 - For a teacher who resigned for the purposes of completing higher studies, the period of study shall be calculated as pensionable service for the purposes of this
law, provided that pension deductions are paid for it according to the last salary before leaving the service, taking into account the provisions of
Article 11 of the Civil Pension Law No. (33) of 1966, as amended.
Article Four / -

2 - The following is added to Article 22 of the law to become paragraphs (3) and (4) thereof.
3 - Palestinians shall be treated the same as their Iraqi colleagues covered by the provisions of this law, provided that this is conditional
upon termination in the event of the Palestinians returning to their homes.
4 - The pension bonus and pension salary for the teacher are estimated according to the principles mentioned in the Civil Pension Law
in force, provided that their pension salary, with allowances and other additions, does not exceed what their retired peer
from official schools receives, and that the total amount they receive for this purpose does not exceed, in any case,
one hundred and twenty-five (125 / -) dinars.
Article Five
Article 26 of the law is repealed and replaced by the following: -
Article Twenty-six
1 - A teacher has the right to request at any time during their work in private schools the inclusion of all or part of the period spent in
office, employment, or wages in state departments and its official and semi-official institutions—whether continuous or
intermittent—to their service in private schools for pension purposes, provided that the guaranteed period does not exceed their period of service
in private schools and does not in any case exceed ten years, provided that the pension deductions for the guaranteed period are paid to the Fund
in accordance with the provisions of the Civil Pension Law No. (33) of 1966, as amended,
or the Pension Fund Law for Officials and Employees in Semi-Official Departments and Institutions No. (49) of 1967,
as amended, and that the departments in which they served during that time do not bear any amounts for the inclusion of the aforementioned period of service.
Article Six
This law shall be published in the Official Gazette and the Ministers shall be responsible for its implementation.

Explanatory Memorandum
Upon beginning the implementation of the provisions of the Private School Teachers' Pension Fund Law No. (58) of 1969, it became clear that many teachers in
private schools and those working in them in administrative, clerical, or accounting positions who have spent a long period in its service have been subjected to injustice
due to some of its provisions, which necessitated amending those provisions in a way that ensures equity and removes unfairness from them to secure the ⟦included⟧ accomplished and comprehensive implementation
of the legal provisions that stipulated their rights and to enable the fair execution of the constitutional principle of equal opportunities among citizens, while stipulating
that Palestinians shall be treated for the purposes of the provisions of the law as Iraqis and that this shall be conditional upon termination in the case of returning to
their homes, in accordance with the decision of the Revolutionary Command Council in this regard.
For all of the above, this law was enacted.

Amendment to the Private School Teachers Pension Fund Law
No. (58) of 1969
Article One :-
Paragraph (4) of Article One of the Private School Teachers Pension Fund Law
No. (58) of 1969 is repealed and replaced by the following :-
4 - Teacher - Every Iraqi or Arab practicing in the school on a full-time basis any of the following two interests
A - The teaching profession, provided that he is a member of the Syndicate
B - An administrative, accounting, or clerical position
Article Two :-
Ten
1 - Paragraph (2) of Article Five of the Law is repealed and replaced by the following :-
2 - If the transfer of the amount to the Fund under paragraph (1) of this article is delayed for more than two months
the Fund may collect from the school on the overdue amounts a monthly interest at a rate of seven percent
(7%) starting from the date the amount is due until the date of its transfer to the Fund, and
a fraction of a month is considered a full month for the purpose of calculating the delay period.

2 - The following is added to Article Five of the Law as paragraphs (4, 5, and 6) thereof :-
4 - All private schools must deposit securities with banks determined by the Ministry of Education as
a guarantee for their obligations stipulated in paragraph (1) of this article.
5 - Banks with which the securities mentioned in paragraph (4) of this article are deposited shall not return the
security amounts to the schools that deposited them unless they receive a notice from the Fund of the discharge of the said schools.
6 - The Fund's debts shall be collected in accordance with the provisions of the Law for the Collection of Debts Owed to the Government
Article Three :-
1 - Paragraph (1) of Article Seventeen of the Law is repealed and replaced by the following :-
1 - Those covered by this Law may submit an application to the Fund requesting the calculation of their services in private education
prior to the date of its enforcement for pension purposes, provided that the pension share is paid for them in accordance with the provision of paragraph (1) of
Article Fifteen of this Law, provided that the added period does not lead the teacher to retirement
at his request before five years have passed from the date of its enforcement. Exempted from this are those who have completed sixty years of age
or were retired for health reasons, so their previous services are added for them.
