And if the Director-General is forced to withdraw from this
deposit the value of what is due for fees, transport,
or wages, whether all or one of them, and the deposit does not reach
the specified limit within the mentioned period of fifteen days,
the Director-General of Posts and Telegraphs may confiscate that deposit
entirely without prejudice to other claims arising under
the provisions of the contract regarding what is due for transport, fees,
or rents, whether all or one of them.
The certification by the Director-General of Posts and Telegraphs of the account
required to be paid by the subscriber for fees, wages, or
expenses or the value of damage shall be considered sufficient evidence of the amount
claimed.
⟦line⟧ In the event of the Director-General of Posts and
Telegraphs having to draw on this deposit for fees,
services and/or rent dues and the deposit not being
made up to the required amount within the stated
period of 15 days' the Director-General of Posts and
Telegraphs may confiscate without any prejudice
to further claims arising out of the contract in respect
of service, fees and/or rents still due the whole of
the said Deposit. Any account of his fees, charges,
expenses and damage payable by the subscriber shall
be when certified by the Director-General of Posts
and Telegraphs conclusive evidence of the amount
thereof.
(14) If the number of incoming calls to the telephone
or telephones mentioned in this contract which, due to
the telephone being busy, were not answered exceeds 25 percent of the number
of calls answered within a period of 4 consecutive working
days, the Director-General of Posts and Telegraphs may give to
the subscriber a written notice accompanied by a certified record of the calls
and request him in the notice to rent an additional number of telephone lines
as the Director-General of Posts and Telegraphs deems appropriate
considering what he sees as necessary for performing the telephone transactions
incoming to the subscriber's house or outgoing from it, and in case
the subscriber fails to implement this notice within one
month, the Iraqi Government may terminate this contract.
14. If, of the calls made to the telephone or
telephones mentioned in the contract, the number not
completed on demand by reason of the telephone
exchange connections being engaged exceed 25% of
the number completed during a period of 4 consecu-
tive working days the Director-General of Posts and
Telegraphs may give to the subscriber notice in
writing, accompanied by a certified record of the
calls, requiring him to hire such number of additional
exchange lines as in the opinion of the Director-
General of Posts and Telegraphs are necessary to
meet the requirements of Telephone Traffic to and
from the subscriber premises. If the subscriber fails
to comply with such notice within one month the
'Iraq Government may determine the contract.
(15) The Director-General may notify the subscriber in writing
from time to time regarding the increase or decrease he will implement in
the percentage of the quarterly wage and rent accounts
required to be paid under the contract, and this
decrease or increase in the percentage of the accounts due
to be paid on the due date of the quarterly installment should not be implemented except after
the end of two calendar months from the date of the notice.
15. The Director-General of Posts and Tele-
graphs may from time to time give notice in writing
to the subscriber that a percentage will be added to
or deducted from the quarterly accounts for rentals
and charges thereafter payable under the contract
and such percentage shall be added to or deducted
from (as the case may be) such part of the account
due on the quarterly day of payment falling due
after the expiration of 2 calender months from the
date of such notice.
(16) If a private branch exchange board is installed connected
to the general subscribers' exchange center by a line or lines,
the subscriber must employ at his own expense competent telephone
operators to ensure the operation of the exchange board in the
required manner, provided that their competence is approved by the Director
of Posts and Telegraphs General.
16. If a Private Branch Exchange (P.B.X.)
switchboard is installed in connection with the
subscribers exchange line or lines, the subscriber shall
provide at his own expense and to the reasonable
satisfaction of the Director-General of Posts and
Telegraphs sufficient competent operators to ensure
the proper working of the Switchboard.

5. The subscriber shall not send or receive, nor permit to be sent or received, by or through the said apparatus, any message in respect of which any money or other consideration shall be paid, given or promised to the subscriber or to any other person or body than the 'Iraq Government.
(5) The subscriber is not permitted to send or receive, or allow the sending or receiving of a message by means of his mentioned device in exchange for any amount or gift, whether it has been paid or promised to be paid to him or to others or to any body other than the Iraqi Government.
6. The subscriber will only be permitted to hire a telephone at the "Residential" Rate provided it is in his or her private residence only and solely for social use.
(6) The subscriber is not permitted to rent a telephone according to the rates designated for housing unless the telephone is installed in the subscriber's private residence, provided that it is also not used except for purely social purposes.
At any time that it is proved that such a telephone is being used for business purposes the Director-General of Posts and Telegraphs is empowered to recover the difference in the payment already made or due to be made from the commencement of the quarter from which notice to this effect is given.
If it is proved at any time that this telephone is used for commercial business and work, the Director General of Posts and Telegraphs is authorized to collect the value of the difference for what was paid or what is due to be paid for the three months in which notice was given in this regard.
The following will not be allowed telephones at Residential Rate:—
Residential rates for telephones are not allowed for the following places: -
(a) Any residence of a medical practitioner in private practice.
(a) Any residence of a doctor who practices his work for his own account.
(b) Any residence of a principal of a business or firm, which does not rent a business phone.
(b) Any residence of a manager of commercial business or a commercial establishment that has not rented a telephone for public business.
(c) Any club.
(c) Clubs.
(d) Any Hotel excepting telephones rented by residents in their residential quarters in that Hotel.
(d) Any hotel except for telephones rented by residents in the residential quarters of that hotel.
NOTE.—Daily Newspapers are exempted from the above.

7. If Bills for rent are not paid within 15 days' from due date the apparatus may be disconnected without notice and after a further period of 7 days' be recovered. The contract may then be regarded by the 'Iraq Government as cancelled by the subscriber or may be terminated by the 'Iraq Government forthwith or at any time thereafter, without prejudice to any other right or remedy of the said 'Iraq Government. If a subscriber be disconnected and the apparatus be subsequently recovered on account of his failure to pay the subscription within the time aforesaid and the connection be consequently restored on payment of the rent due, the subscriber shall be liable for the rent during the period of disconnection up to a limit of 7 days' and will pay a reinstallation fee of Rs. 10.
(7) If the rent bills are not paid within 15 days from the due date, the connection of the device shall be cut off without notice, and after another seven days the device shall be removed, and the Iraqi Government may consider the contract cancelled by the subscriber, and it may also terminate it immediately or at any other time thereafter, provided that this does not affect any of the rights of the mentioned Iraqi Government or any measure taken by the Government. If the subscriber's telephone connection is cut off and the device is removed thereafter due to his failure to pay the subscription fee within the aforementioned period, and then the connection of the device is restored following his payment of the due rent, the subscriber becomes liable to pay rent for the period in which the connection was cut off up to seven days, and he must also pay a reinstallation fee of (10) Rupees.
8. If the subscriber shall be judged insolvent or shall make or enter into any composition or arrangement with his creditors, or shall suffer execution to be levied upon his premises or shall commit any breach of or fail to observe and perform any of the clauses or conditions of this contract, the 'Iraq Government may terminate this contract by notice in writing without payment of compensation and without prejudice to any other right or remedy of the 'Iraq Government for the recovery of arrears or
(8) In the event of the subscriber being judged bankrupt, or entering into a composition agreement with his creditors, or making any other arrangement with them, or the occurrence of what leads to the seizure of his house, or his violation of any of the texts of the contract articles or its conditions, or his failure to follow them, the Iraqi Government shall have the right to terminate this contract by giving a written notice without paying any compensation and without prejudice to any of the rights of

such other moneys to which they may be entitled to
under this contract.
The Iraqi Government or the measures it takes for the purpose of
recovering what it is entitled to of arrears or any other money
it is entitled to under this contract.
9. Should the subscriber wish any alteration to
be made in the apparatus installed under this
contract, the subscriber shall pay the cost of such
alteration at the rates then in force. Further, if
such alteration effects the length of the line in use,
the rent charge will be revised accordingly at the
rates then in force, subject to the proviso that if the
alteration entails a reduction in the rent, the original
rent will be charged to the end of the first year of the
contract term.
(9) If the subscriber wishes to make any change in
the apparatus installed under this contract, he must pay
the cost of the expenses of this change according to the rates followed at that
time. As for if this change affects the length of the line
used, then the rent shall be adjusted according to the rates
followed at that time, and it is stipulated that if there results from this
change a reduction in the rent, the original rent shall be collected
until the end of the first year of the contract term.
10. The books kept by the Director-General of
Posts and Telegraphs shall be sufficient and conclusive
proof of the dates of the commencement and termina-
tion or expiration of the contract.

General of Posts and Telegraphs are considered sufficient and conclusive proof for stating the dates of
the start of the contract or the end of its term or its termination.
11. The subscriber shall throughout the period
of the contract confirm to all the rules and regula-
tions in force for the time being relating to the
contract.

all rules and regulations related to it that are in force
at that time.
12. On the termination of this contract the
subscriber shall surrender to the 'Iraq Government
the said wire and apparatus with all fixtures and
accessories in as good condition as when installed,
ordinary wear and tear alone excepted, and the
Director-General of Posts and Telegraphs may
forthwith remove the same.
(12) The subscriber must, upon the termination of this contract,
hand over to the Iraqi Government the wires and the apparatus with all
fixtures and other accessories in a good condition like they were
upon their installation, and wear and tear by use alone is excepted,
and the Director-General may remove the wires and the apparatus
immediately.
13. The subscriber shall be held liable to pay
all fees and charges in respect of calls originating
from the exchange connection specified in the
contract and in respect of facilities and services
outside tariff rates rendered at the request of persons
using the Exchange Connection all such charges and
fees shall be paid to the Director-General of Posts
and Telegraphs on demand and the subscriber shall
deposit and keep deposited with the Director-General
of Posts and Telegraphs such sums of money, not
being at any time less than Rs. 15 or more than one
full quarters rent for each exchange line as the
Director-General of Posts and Telegraphs may from
time to require as security for such fees and charges
and as security against any act contravening Clause 4
above. In default the Director-General of Posts and
Telegraphs may decline to make any connection
involving a charge which has not been prepaid or to
continue a connection in respect of which the deposit
has not been brought up to the specified amount
within 15 days' of his demand to do so.
(13) The subscriber shall be responsible for paying the fees
and charges related to long-distance calls originating from
the subscriber's telephone specified in this contract, as well as for
the fees and charges for what is not specified in the tariff of charges
of facilities and communications given to individuals based
on their request when using the subscriber's telephone set.
All these charges and fees shall be paid to the Director-General
upon demand, and the subscriber must deposit and remain deposited with
the Director-General a security not less at any time than fifteen
rupees and not exceeding three full months' rent
for each telephone connected to an exchange center as requested by
the Director-General from time to time as security for the fees and charges
and as a guarantee against any violation of the fourth article above, and in case of
default, the Director-General of Posts and Telegraphs shall refuse to connect
a telephone for which the rent has not been paid in advance, as well as disconnect a telephone
whose security has not reached the specified limit within
fifteen days from the date of demanding it from the subscriber.

INSTALLATION AND REMOVAL FEES.
Fees for installing and moving the telephone
Will be charged on all telephones at actual cost plus 15% subject to a minimum of Rs. 10 per telephone.
These fees are collected for all telephones according to the actual cost plus 15 percent, provided that they are not less than ten (10) Rupees for each telephone. However, no fee is collected for moving the telephone in the subscriber's premises where a move has already been carried out and the fittings still exist.
No charge however will be made for a removal in a subscribers premises where a removal has already been effected and the fittings exist.

deposit has not reached the specified limit within fifteen days
from the date of the subscriber's demand for it.
In the event of the Director-General of Posts
and Telegraphs having to draw on this deposit for
fees, services and/or rent dues and the deposit not
being made up to the required amount within the
stated period of 15 days the Director-General of
Posts and Telegraphs may confiscate without any
prejudice to further claims arising out of the con-
tract in respect of service, fees and/or rents still
due the whole of the said Deposit. Any account
of his fees, charges expenses and damage payable
by the subscriber shall be, when certified by the
Director-General of Posts and Telegraphs, conclu-
sive evidence of the amount thereof.
And if the Director-General is forced to withdraw from this deposit the value of what is
due of fees, communications or rentals, whether all or any of them,
and the deposit does not reach the specified limit within the period of fifteen days
mentioned, the Director-General of Posts and Telegraphs may confiscate that deposit
entirely without prejudice to other claims arising under the provisions
of the contract for what is due for communications, fees or rentals,
whether all or any of them.
The certification of the Director-General of Posts and Telegraphs of the account
required to be paid by the subscriber for fees, rentals, or expenses
or the value of damage is considered sufficient evidence of the amount claimed.
14. If, of the calls made to the telephone or
telephones mentioned in the contract, the number
not completed on demand by reason of the telephone
exchange connections being engaged, exceeds 25 per
cent of the number completed, during a period of 4
consecutive working days the Director-General of
Posts and Telegraphs may give to the subscriber
notice in writing, accompanied by a certified record
of the calls, requiring him to hire such number of
additional exchange lines as in the opinion of the
Director-General of Posts and Telegraphs are
necessary to meet the requirements of telephone
traffic to and from the subscriber premises. If the
subscriber fails to comply with such notice within
one month the ‘Iraq Government may determine
the contract.
(14) If the number of calls incoming to the telephone or
telephones mentioned in this contract which, due to the occupation
of the telephone, were not answered exceeds 25 percent of the number of calls
that were answered within 4 consecutive working days, the Director-General
of Posts and Telegraphs may give the subscriber a written notice accompanied
by a certified record of the calls and request him in the notice to lease a number
of additional telephone lines as deemed by the Director-General
of Posts and Telegraphs in view of what he sees necessary to perform the telephone transactions
incoming to the subscriber's house or outgoing from it, and in case of violation
by the subscriber in implementing this notice within one month, the Iraqi
Government may terminate this contract.
15. The Director-General of Posts and Tele-
graphs may from time to time give notice in writing
to the subscriber that a percentage will be added to
or deducted from the quarterly accounts for rentals
and charges thereafter payable under the contract
and such percentage shall be added to or deducted
from (as the case may be) such part of the account
due on the quarterly day of payment falling due
after the expiration of 2 calender months from the
date of such notice.
(15) The Director-General may notify the subscriber in writing from time
to time of the increase or reduction percentage he will implement in the
quarterly rental and fee accounts required to be paid under the contract,
and this reduction or increase in percentage of accounts
due to be paid on the due date of the quarterly installment payment should not be carried out except after
the expiration of two calendar months from the date of notification.
16. If a Private Branch Exchange (P.B.X.)
switchboard is installed in connection with the sub-
scriber’s exchange line or lines, the subscriber shall
provide at his own expense and to the reasonable
satisfaction of the Director-General of Posts and
Telegraphs sufficient competent operators to ensure
the proper working of the switchboard.
(16) If a private branch exchange board is installed connected to a central
exchange for all subscribers by means of a line or lines, the subscriber
must employ at his own expense competent telephone operators to ensure
the operation of the exchange board in the required manner, provided that their
competency is approved by the Director-General of Posts and Telegraphs.

(8) In the event of the subscriber being judged bankrupt or entering

the occurrence of anything leading to the seizure of his house or his violation of any of the
provisions of the contract articles or its conditions or his failure to follow them, the
Iraqi Government shall have the right to terminate this contract by giving
a written notice without paying any compensation and without prejudice to any right
of the Iraqi Government's rights or the measures it takes in order to
obtain what it is entitled to of arrears or any other money it is entitled to
under this contract.
8. If the subscriber shall be judged insolvent
or shall make or enter into any composition or
arrangement with his creditors, or shall suffer
execution to be levied upon his premises or shall
commit any breach of or fail to observe and perform
any of the clauses or conditions of this contract,
the 'Iraq Government may terminate this contract
by notice in writing without payment of compensa-
tion and without prejudice to any other right or
remedy of the 'Iraq Government for the recovery
of arrears or such other money to which it may be
entitled to under this contract.
(9) If the subscriber wishes to make any change in the apparatus
installed under this contract, he must pay the cost of this
change according to the prices followed at that time. However, if this
change affects the length of the line used, then the rent
is adjusted according to the prices followed at that time, provided that
if this change results in a reduction in the rent, the
original rent shall be collected until the end of the first year of the contract term.
9. Should the subscriber wish any alteration to
be made in the apparatus installed under this
contract, the subscriber shall pay the cost of such
alteration at the rates then in force. Further, if
such alteration effects the length of the line in use
the rent charge will be revised accordingly at the
rates then in force, subject to the proviso that if the
alteration entails a reduction in the rent, the
original rent will be charged to the end of the first
year of the contract term.
(10) The records held by the Director General
of Posts and Telegraphs are considered sufficient and conclusive evidence to show the dates of the start of the contract
or the end of its term or its termination.
10. The books kept by the Director-General
of Posts and Telegraphs shall be sufficient and con-
clusive proof of the dates of the commencement and
termination or expiration of the contract.
(11) The subscriber must observe throughout the duration of the contract all
rules and regulations related to it that are in force at that time.
11. The subscriber shall throughout the period
of the contract confirm to all the rules and regula-
tions in force for the time being relating to the
contract.
(12) Upon termination of this contract, the subscriber must deliver to
the Iraqi Government the wires and the apparatus with all fixtures and other
supplies in good condition as they were when installed, with the exception of
wear and tear from use only, and the Director General may
remove the wires and the apparatus immediately.
12. On the termination of this contract the
subscriber shall surrender to the 'Iraq Government
the said wire and apparatus within all fixtures and
accessories in as good condition as when installed,
ordinary wear and tear alone excepted, and the
Director-General of Posts and Telegraphs may
forthwith remove the same.
(13) The subscriber shall be responsible for paying the fees and charges
related to long-distance calls originating from the subscriber's telephone
designated in this contract, as well as for the fees and charges for what is
not specified in the tariff of charges for facilities and communications that
are given to individuals upon their request when using the subscriber's telephone set.
All these charges and fees are paid to the Director General upon
request, and the subscriber must deposit and keep deposited with the Director General
a security of not less at any time than 1.125 Dinars and not more than
the rent of three full months for each telephone connected to an exchange
as requested by the Director General from time to time as security for the charges
and fees and as a guarantee against any violation of Article Four above, and in case of
default, the Director General of Posts and Telegraphs shall refuse to connect a telephone

all fees and charges in respect of calls originating
from the exchange connection specified in the
contract and in respect of the facilities and services
outside tariff rates rendered at the request of persons
using the Exchange Connection. All such charges
and fees shall be paid to the Director-General of
Posts and Telegraphs on demand and the subscriber
shall deposit and keep deposited with the Director-
General of Posts and Telegraphs such sums of
money, not being at any time less than I.D. 1-125
or more than one full quarter's rent for each ex-
change line as the Director-General of Posts and
Telegraphs may from time to require as security for
such fees and charges and as security against any
act contravening Clause 4 above. In default the
Director-General of Posts and Telegraphs may
decline to make any connection involving a charge
which has not been prepaid or to continue a con-
