5 — The subscriber shall not send or receive, nor permit to be
sent or received, by or through the said apparatus,
any message in respect of which any money or consideration
shall be paid, given or promised to the subscriber or to any other
person other than the Iraq Government.

power is restored again upon payment of the rent due,
the subscriber shall be liable for the rent during the period of
disconnection up to seven days.
6. Bills for rent will be sent out one clear month prior to the date on which due, and if not paid within fifteen days from such date the apparatus may be disconnected without notice and the contract may be regarded by the ‘Iraq Government as cancelled by the subscriber or may be terminated by the ‘Iraq Government forthwith or at any time thereafter, without prejudice to any other right or remedy of the said ‘Iraq Government. If a subscriber be disconnected on account of his failure to pay the subscription within the time aforesaid and the connection be subsequently restored on payment of the rent due, the subscriber shall be liable for the rent during the period of disconnection up to a limit of seven days.
7 — If the subscriber is adjudged insolvent or enters into
any composition or arrangement with his creditors, or his premises are seized,
or he breaches or neglects to perform the clauses and conditions of this contract,
the Iraq Government may terminate this contract by
giving notice in writing without payment of compensation and without prejudice
to any of the rights or remedies of the Iraq Government for the recovery of
accrued charges or any money due to it under
this contract.
7. If the subscriber shall be adjudged insolvent or shall make or enter into any composition or arrangement with his creditors, or shall suffer execution to be levied upon his premises or shall commit any breach of or fail to observe and perform any of the clauses or conditions of this contract, the ‘Iraq Government may terminate this contract by notice in writing without payment of compensation and without prejudice to any other right or remedy of the ‘Iraq Government for the recovery of arrears or such other moneys to which he may be entitled under this contract.
8 — If the subscriber wishes to make any alteration to the apparatus installed
under this contract, he must pay the cost of the alterations
according to the rates in force. If these alterations affect
the length of the line used, the rent must be adjusted according
to the rates in force, provided that if the alteration causes
a reduction in the rent, the original rent must be collected
until the end of the first year of the contract.
8 Should the subscriber wish any alteration to be made in the apparatus installed under this contract, the subscriber shall pay the cost of such alteration at the rates then in force. Further, if such alteration affects the length of line in use, the rent-charge will be revised accordingly at the rates then in force, subject to the proviso that if the alteration entails a reduction in the rent the original rent will be charged to the end of the first year of the contract term.
9 — The records kept in the Telegraph Directorate shall be
sufficient and conclusive proof of the date of commencement and termination
or expiration of the contract.

10 — The subscriber must agree to all the laws
and regulations in force for the period concerning this contract.

11. On the termination of this contract the subscriber shall surrender to the ‘Iraq Government the said wire and apparatus with all fixtures and accessories in as good condition as when installed, ordinary wear and tear alone excepted, and the Director of Telegraphs may forthwith remove the same.

CONDITIONS.
( The Conditions )
1. If the connection referred to on the
first page is not made within six months of the
date of application, the subscriber may require
the Director of Telegraphs, in writing, to complete
the same within one month and in default the
contract shall lapse.
1 - If the electric line referred to in the first
page is not completed within six months from the date of the request,
the subscriber may demand from the Director of Telegraphs in writing that
he completes it within a period of one month, otherwise the contract will end.
2. The Director of Telegraphs shall erect
and (subject to the observance by the subscriber
of all the clauses and conditions herein con-
tained) maintain in good working order the
apparatus referred to on the first page hereof, and
in the event of the apparatus not being in good
working order the Director of Telegraphs shall
repair and restore the same with all possible
despatch, and the subscriber shall give all possible
assistance for this purpose ; but it shall be lawful
for the 'Iraq Government on the expiration of
seven days' notice in writing from the Director
of Telegraphs, at any time to remove and take
possession of any apparatus installed under this
contract, should it consider it necessary or
advisable to do so, and in such case a propor-
tionate part of the rent for the unexpired period
paid for by the subscriber shall be refunded.
2 - The Director of Telegraphs shall establish the apparatus mentioned in the first
page in good condition (provided the subscriber observes
all the clauses and conditions contained therein) and if
the mentioned apparatus does not work in good condition, the Director of
Telegraphs must repair it as quickly as possible and the subscriber
must extend a helping hand as much as possible for the same purpose. And it shall be
the right of the Iraqi Government upon the expiration of the notice given by
the Director of Telegraphs for a period of seven days in writing at any time
to remove and possess any apparatus constructed under this contract
if the need arises or if it sees that as appropriate in cases
like these, the rent for the period
that has not expired must be returned.
3. The 'Iraq Government shall not be
liable for any loss or damage occasioned by
the interruption or disturbance or stoppage of
communication from any cause whatsoever ; nor
shall it be liable for any loss or damage occa-
sioned by delay in establishing or restoring
communication.
3 - The Iraqi Government shall not be responsible for any loss or damage
resulting from the interruption, disturbance, or stoppage of communications
for any reason, and for any loss or damage resulting from the delay
in establishing or restoring communications.
4. The subscriber shall take good care
the apparatus and of all the fixtures and
accessories connected therewith, and shall not
damage, alter or remove the same, or allow the
same to be damaged, altered or removed, and
shall not make or suffer to be made any attach-
ments or alterations to the same, and shall not
obliterate or allow to be obliterated any marks,
words or numbers which may be written, painted,
stamped or impressed thereon. Telegraph
officials and workmen shall at all reasonable times
have access to the premises of the subscriber
and to all other places under the control of the
subscriber, through, under or over which any
part of the wire or apparatus passes or to which
it is fixed, and the subscriber shall have no claim
for the repayment of any moneys which may have
been paid for rent or otherwise under this contract
or for any other compensation or damages what-
soever. In the event of the apparatus or any
part thereof on the subscriber's premises being
damaged or altered from any cause whatsoever,
the subscriber shall pay to the Department the
cost of repair of such damage or alteration.
4 - The subscriber must take care of the apparatus and
all that pertains to it, and it is not permissible for him to damage it or
change it or to allow anyone to do that. And it is not permissible
for him also to damage or to cause any attachment or
alteration in the apparatus itself. He may not erase or allow
anyone to remove any mark (brand) or word or number
which may be written, engraved, or printed on it.
Telegraph officials and workers may enter at any
appropriate time the subscriber's premises and other places that are
under his control and which are under or on any part of
the wires or the apparatus that passes through or is connected to it. And
the subscriber cannot demand the recovery of some
moneys that were paid for rent or otherwise under
this contract or any other compensations or destruction whatsoever.
And in the event of damage or alteration of the apparatus or any part of it in
the subscriber's premises for any reason, he must pay
the price of such damage or alteration to the administration.
