واذا اضطر المدير العام ان يسحب من هذا
التأمين قيمة ما هو مستحق من الرسوم او المواصلات
او الاجور سواء كلها او احدها ولم يبلغ التأمين الى
الحد المعين في خلال مدة خمسة عشر يوما المذكورة
للمدير العام للبريد والبرق ان يصادر ذلك التأمين
برمته دون مساس بالطلبات الاخرى الناشئة بمقتضى
احكام المقاولة عما هو مستحق عن المواصلات او الرسوم
او الايجارات سواء كلها او احدها .
ان تصديق المدير العام للبريد والبرق على الحساب
المقتضى دفعه من المشترك لقاء الرسوم او الاجور او
المصروفات او قيمة التلف يعتبر شهادة كافية على المبلغ
المطالب به .
.. In the event of the Director-General of Posts and
Telegraphs having to draw on this deposit for fees,
services and/or rent dues and the deposit not being
made up to the required amount within the stated
period of 15 days' the Director-General of Posts and
Telegraphs may confiscate without any prejudice
to further claims arising out of the contract in respect
of service, fees and/or rents still due the whole of
the said Deposit. Any account of his fees, charges,
expenses and damage payable by the subscriber shall
be when certified by the Director-General of Posts
and Telegraphs conclusive evidence of the amount
thereof.
(١٤) اذا كان عدد النداءات الواردة الى التلفون
او التلفونات المذكورة في هذه المقاولة التي من جراء
انشغال التلفون لم يجاوب عليها يزيد ٢٥ في المائة عن عدد
النداءات التي اجيب عليها في ظرف ٤ ايام اشتغال
متتالية فللمدير العام للبريد والبرق ان يعطى الى
المشترك اخطارا تحريريا مرفقا بسجل مصدق للنداءات
ويطلب منه في الاخطار ان يؤجر عددا اضافيا من الخطوط
التلفونية حسب ما ينسب ذلك المدير العام للبريد والبرق
نظرا لما يراه ضروريا لتأدية المعاملات التلفونية
الواردة الى منزل المشترك او الصادرة منه وفي حالة
مخالفة المشترك لتنفيذ هذا الاخطار في خلال شهر
واحد فللحكومة العراقية ان تنهي هذه المقاولة .
14. If, of the calls made to the telephone or
telephones mentioned in the contract, the number not
completed on demand by reason of the telephone
exchange connections being engaged exceed 25% of
the number completed during a period of 4 consecu-
tive working days the Director-General of Posts and
Telegraphs may give to the subscriber notice in
writing, accompanied by a certified record of the
calls, requiring him to hire such number of additional
exchange lines as in the opinion of the Director-
General of Posts and Telegraphs are necessary to
meet the requirements of Telephone Traffic to and
from the subscriber premises. If the subscriber fails
to comply with such notice within one month the
'Iraq Government may determine the contract.
(١٥) للمدير العام ان يخطر المشترك تحريريا
من وقت لآخر عما سيجريه من الزيادة او التخفيض في
المائة من حسابات الاجور والايجارات الربع سنوية
المقتضى دفعها بموجب المقاولة ولا ينبغي اجراء هذا
التخفيض او الزيادة في المائة من الحسابات المستحق
دفعها في يوم استحقاق دفع القسط الربع سنوي الا بعد
انتهاء شهرين تقويمية من تاريخ الاخطار .
15. The Director-General of Posts and Tele-
graphs may from time to time give notice in writing
to the subscriber that a percentage will be added to
or deducted from the quarterly accounts for rentals
and charges thereafter payable under the contract
and such percentage shall be added to or deducted
from (as the case may be) such part of the account
due on the quarterly day of payment falling due
after the expiration of 2 calender months from the
date of such notice.
(١٦) اذا نصبت لوحة تبادل خصوصية فرعية تتصل
بمركز تبادل عموم المشتركين بواسطة خط او خطوط
فعلى المشترك ان يستخدم على نفقته الخاصة مأموري
تلفون اكفاء لضمان تشغيل لوحة التبادل على الوجه
المطلوب على ان يوافق على مقدرتهم مدير البريد
والبرق العام .
16. If a Private Branch Exchange (P.B.X.)
switchboard is installed in connection with the
subscribers exchange line or lines, the subscriber shall
provide at his own expense and to the reasonable
satisfaction of the Director-General of Posts and
Telegraphs sufficient competent operators to ensure
the proper working of the Switchboard.

5. The subscriber shall not send or receive, nor permit to be sent or received, by or through the said apparatus, any message in respect of which any money or other consideration shall be paid, given or promised to the subscriber or to any other person or body than the 'Iraq Government.
(٥) لا يجوز للمشترك ان يرسل او يستلم او يسمح بارسال او استلام رسالة بواسطة جهازه المذكور مقابل اى مبلغ او عطاء سواء كان قد دفع او وعد بدفعه له او لغيره او لهيأة اخرى غير الحكومة العراقية .

6. The subscriber will only be permitted to hire a telephone at the "Residential" Rate provided it is in his or her private residence only and solely for social use.
(٦) لا يسمح للمشترك باستئجار تلفون حسب الاسعار المخصصة للمسكن مالم ينصب التلفون في مسكن المشترك او المشتركة الخصوصي على ان لا يستعمل كذلك الا لوسائل اجتماعية محضة .

At any time that it is proved that such a telephone is being used for business purposes the Director-General of Posts and Telegraphs is empowered to recover the difference in the payment already made or due to be made from the commencement of the quarter from which notice to this effect is given.
واذا ثبت في اى وقت من الاوقات ان هذا التلفون مستعمل للاشغال التجارية والاعمال فالمدير العام للبريد والبرق مخول باستيفاء قيمة الفرق لما دفع او ما يستحق دفعه عن الثلاثة اشهر التي اعطى فيها اخطار بهذا الشأن .

The following will not be allowed telephones at Residential Rate:—
لا يسمح بسعر تلفونات المساكن للمحلات الآتية : -
(a) Any residence of a medical practitioner in private practice.
(أ) اى مسكن طبيب يباشر فيه اعماله لحسابه الخاص .
(b) Any residence of a principal of a business or firm, which does not rent a business phone.
(ب) اى مسكن لمدير اشغال تجارية او محل تجاري لم يستأجر تلفونا للاشغال العامة .
(c) Any club.
(ج) النوادي .
(d) Any Hotel excepting telephones rented by residents in their residential quarters in that Hotel.
(د) اى فندق عدا التلفونات التي يستأجرها المقيمون في محلات السكنى من ذلك الفندق .
NOTE.—Daily Newspapers are exempted from the above.

7. If Bills for rent are not paid within 15 days' from due date the apparatus may be disconnected without notice and after a further period of 7 days' be recovered. The contract may then be regarded by the 'Iraq Government as cancelled by the subscriber or may be terminated by the 'Iraq Government forthwith or at any time thereafter, without prejudice to any other right or remedy of the said 'Iraq Government. If a subscriber be disconnected and the apparatus be subsequently recovered on account of his failure to pay the subscription within the time aforesaid and the connection be consequently restored on payment of the rent due, the subscriber shall be liable for the rent during the period of disconnection up to a limit of 7 days' and will pay a reinstallation fee of Rs. 10.
(٧) اذا لم تسدد قوائم الايجار في ظرف ١٥ يوما من التاريخ المستحق يقطع اتصال الجهاز دون انذار وبعد سبعة ايام اخرى يرفع الجهاز وللحكومة العراقية ان تعتبر المقاولة ملغاة من جانب المشترك ولها كذلك ان تنهيها في الحال او في اى وقت آخر بعد ذلك على ان لا يمس ذلك بأى حق من حقوق الحكومة العراقية المذكورة او اى تدبير تتخذه الحكومة واذا قطع اتصال تلفون المشترك ورفع الجهاز بعد ذلك لتقصيره عن دفع بدل الاشتراك في خلال المدة الآنفة الذكر ثم اعيد اتصال الجهاز اثر دفعه بدل الايجار المستحق يصبح المشترك عرضة لدفع ايجار عن المدة التي قطع فيها الاتصال لحد سبعة ايام وعليه كذلك ان يدفع اجرة اعادة نصب قدرها (١٠) روبيات .

8. If the subscriber shall be judged insolvent or shall make or enter into any composition or arrangement with his creditors, or shall suffer execution to be levied upon his premises or shall commit any breach of or fail to observe and perform any of the clauses or conditions of this contract, the 'Iraq Government may terminate this contract by notice in writing without payment of compensation and without prejudice to any other right or remedy of the 'Iraq Government for the recovery of arrears or
(٨) وفي حالة الحكم على المشترك بافلاسه او دخوله في اتفاق للصلح مع دائنيه او اتخاذه معهم اى ترتيب آخر او احداث ما يؤدي الى الحجز على داره او مخالفته لنص من نصوص مواد المقاولة او شروطها او تقصيره عن اتباعها يكون للحكومة العراقية الحق في انهاء هذه المقاولة وذلك باعطاء اخطار تحريري دون دفع اى تعويض ودون المساس باى حق من حقوق

9. Should the subscriber wish any alteration to
be made in the apparatus installed under this
contract, the subscriber shall pay the cost of such
alteration at the rates then in force. Further, if
such alteration effects the length of the line in use,
the rent charge will be revised accordingly at the
rates then in force, subject to the proviso that if the
alteration entails a reduction in the rent, the original
rent will be charged to the end of the first year of the
contract term.
(٩) اذا اراد المشترك احداث اى تغيير في
الجهاز المنصوب بموجب هذه المقاولة فعليه ان يدفع
قيمة نفقات هذا التغيير حسب الاسعار المتبعة في ذلك
الوقت . اما اذا كان هذا التغيير يؤثر على طول الخط
المستعمل فحينئذ يعدل بدل الايجار بموجب الاسعار
المتبعة في ذلك الوقت ويشترط انه اذا نشأ عن هذا
التغيير تخفيض في بدل الايجار ان يستوفى البدل
الاصلي حتى نهاية السنة الاولى من مدة المقاولة .

10. The books kept by the Director-General of
Posts and Telegraphs shall be sufficient and conclusive
proof of the dates of the commencement and termina-
tion or expiration of the contract.
(١٠) تعتبر السجلات الموجودة لدى المدير
العام للبريد والبرق دليلا كافيا وقاطعا لبيان تواريخ
بدأ المقاولة او انتهاء مدتها او انهائها .

11. The subscriber shall throughout the period
of the contract confirm to all the rules and regula-
tions in force for the time being relating to the
contract.
(١١) على المشترك ان يراعى طيلة مدة المقاولة
كافة ما يتعلق بها من القواعد والانظمة النافذة المفعول
في ذلك الوقت .

12. On the termination of this contract the
subscriber shall surrender to the 'Iraq Government
the said wire and apparatus with all fixtures and
accessories in as good condition as when installed,
ordinary wear and tear alone excepted, and the
Director-General of Posts and Telegraphs may
forthwith remove the same.
(١٢) على المشترك عند انهاء هذه المقاولة ان
يسلم الحكومة العراقية الاسلاك والجهاز مع كافة
التراكيب واللوازم الاخرى بحالة جيدة مثل ما كانت
عليه عند تنصيبها ويستثنى من ذلك الاستهلاك بالاستعمال
فقط وللمدير العام ان يقوم برفع الاسلاك والجهاز على
الفور .

13. The subscriber shall be held liable to pay
all fees and charges in respect of calls originating
from the exchange connection specified in the
contract and in respect of facilities and services
outside tariff rates rendered at the request of persons
using the Exchange Connection all such charges and
fees shall be paid to the Director-General of Posts
and Telegraphs on demand and the subscriber shall
deposit and keep deposited with the Director-General
of Posts and Telegraphs such sums of money, not
being at any time less than Rs. 15 or more than one
full quarters rent for each exchange line as the
Director-General of Posts and Telegraphs may from
time to require as security for such fees and charges
and as security against any act contravening Clause 4
above. In default the Director-General of Posts and
Telegraphs may decline to make any connection
involving a charge which has not been prepaid or to
continue a connection in respect of which the deposit
has not been brought up to the specified amount
within 15 days' of his demand to do so.
(١٣) يكون المشترك مسؤولا عن دفع الرسوم
والاجور المتعلقة بالنداءات البعيدة المسافة الصادرة من
تلفون المشترك المعين في هذه المقاولة وكذلك عن
الرسوم والاجور لقاء ما هو غير معين في تعريفة الاجور
من التسهيلات والمواصلات التي تعطى الى الافراد بناء
على طلبهم عند استعمالهم آلة تلفون المشترك .
تدفع كافة هذه الاجور والرسوم الى المدير العام
حين الطلب وعلى المشترك ان يودع ويظل مودعا لدى
المدير العام تأمينا لا يقل في اى وقت كان عن الخمس
عشرة روبية ولا يزيد عن بدل ايجار ثلاثة اشهر كاملة
عن كل تلفون متصل بمركز تبادل حسب ما يطلب ذلك
المدير العام من وقت لآخر تأمينا للاجور والرسوم
وضمانا ضد اية مخالفة للمادة الرابعة اعلاه وفي حالة
التقصير يرفض المدير العام للبريد والبرق ربط اتصال
تلفون لم يدفع ايجاره مقدما وكذلك قطع اتصال تلفون
لم يبلغ التأمين الخاص به الحد المقرر في ظرف
خمسة عشر يوما من تاريخ مطالبة المشترك به .

brought up to the specified amount within 15 days'

In the event of the Director-General of Posts
and Telegraphs having to draw on this deposit for
fees, services and/or rent dues and the deposit not
being made up to the required amount within the
stated period of 15 days the Director-General of
Posts and Telegraphs may confiscate without any
prejudice to further claims arising out of the con-
tract in respect of service, fees and/or rents still
due the whole of the said Deposit. Any account
of his fees, charges expenses and damage payable
by the subscriber shall be, when certified by the
Director-General of Posts and Telegraphs, conclu-
sive evidence of the amount thereof.
واذا اضطر المدير العام ان يسحب من هذا التأمين قيمة ماهو
مستحق من الرسوم او المواصلات او الاجور سواء كلها او احدها
ولم يبلغ التأمين الى الحد المعين في خلال مدة خمسة عشر يوما
المذكورة للمدير العام للبريد والبرق ان يصادر ذلك التأمين
برمته دون مساس بالطلبات الاخرى الناشئة بمقتضى احكام
المقاولة عما هو مستحق عن المواصلات او الرسوم او الايجارات
سواء كلها او احدها .
ان تصديق المدير العام للبريد والبرق على الحساب
المقتضى دفعه من المشترك لقاء الرسوم او الاجور او المصروفات
او قيمة التلف يعتبر شهادة كافية على المبلغ المطالب به .
14. If, of the calls made to the telephone or
telephones mentioned in the contract, the number
not completed on demand by reason of the telephone
exchange connections being engaged, exceeds 25 per
cent of the number completed, during a period of 4
consecutive working days the Director-General of
Posts and Telegraphs may give to the subscriber
notice in writing, accompanied by a certified record
of the calls, requiring him to hire such number of
additional exchange lines as in the opinion of the
Director-General of Posts and Telegraphs are
necessary to meet the requirements of telephone
traffic to and from the subscriber premises. If the
subscriber fails to comply with such notice within
one month the ‘Iraq Government may determine
the contract.

التلفونات المذكورة في هذه المقاولة التي من جراء انشغال
التلفون لم يجاوب عليها يزيد ٢٥ في المائة عن عدد النداءات
التي اجيب عليها في ظرف ٤ ايام اشتغال متتالية فللمدير العام
للبريد والبرق ان يعطى الى المشترك اخطارا تحريريا مرفقا
بسجل مصدق للنداءات ويطلب منه في الاخطار ان يوجر عددا
اضافيا من الخطوط التلفونية حسب ما ينسب ذلك المدير العام
للبريد والبرق نظرا لما يراه ضروريا لتأدية المعاملات التلفونية
الواردة الى منزل المشترك او الصادرة منه وفي حالة مخالفة
المشترك لتنفيذ هذا الاخطار في خلال شهر واحد فللحكومة
العراقية ان تنهي هذه المقاولة .
15. The Director-General of Posts and Tele-
graphs may from time to time give notice in writing
to the subscriber that a percentage will be added to
or deducted from the quarterly accounts for rentals
and charges thereafter payable under the contract
and such percentage shall be added to or deducted
from (as the case may be) such part of the account
due on the quarterly day of payment falling due
after the expiration of 2 calender months from the
date of such notice.
(١٥) للمدير العام ان يخطر المشترك تحريريا من وقت
لآخر عما سيجريه من الزيادة او التخفيض في المائة من حسابات
الاجور والايجارات الربع سنوية المقتضى دفعها بموجب المقاولة
ولا ينبغي اجراء هذا التخفيض او الزيادة في المائة من الحسابات
المستحق دفعها في يوم استحقاق دفع القسط الربع سنوي الا بعد
انتهاء شهرين تقويمية من تاريخ الاخطار .
16. If a Private Branch Exchange (P.B.X.)
switchboard is installed in connection with the sub-
scriber’s exchange line or lines, the subscriber shall
provide at his own expense and to the reasonable
satisfaction of the Director-General of Posts and
Telegraphs sufficient competent operators to ensure
the proper working of the switchboard.
(١٦) اذا نصبت لوحة تبادل خصوصية فرعية تتصل بمركز
تبادل عموم المشتركين بواسطة خط او خطوط فعلى المشترك
ان يستخدم على نفقته الخاصة مأموري تلفون اكفاء لضمان
تشغيل لوحة التبادل على الوجه المطلوب على ان يوافق على
مقدرتهم مدير البريد والبرق العام .

(٨) وفي حالة الحكم على المشترك بافلاسه او دخوله
في اتفاق للصلح مع دائنيه او اتخاذه معهم اى ترتيب آخر او
احداث ما يؤدي الى الحجز على داره او مخالفته لنص من
نصوص مواد المقاولة او شروطها او تقصيره عن اتباعها يكون
للحكومة العراقية الحق في انهاء هذه المقاولة وذلك باعطاء
اخطار تحريري دون دفع اي تعويض ودون المساس باي حق
من حقوق الحكومة العراقية او ما تتخذه من التدابير في سبيل
استحصال ما تستحقه من المتأخرات او اى نقود اخرى تستحقها
بموجب هذه المقاولة .
8. If the subscriber shall be judged insolvent
or shall make or enter into any composition or
arrangement with his creditors, or shall suffer
execution to be levied upon his premises or shall
commit any breach of or fail to observe and perform
any of the clauses or conditions of this contract,
the 'Iraq Government may terminate this contract
by notice in writing without payment of compensa-
tion and without prejudice to any other right or
remedy of the 'Iraq Government for the recovery
of arrears or such other money to which it may be
entitled to under this contract.

٩) اذا اراد المشترك احداث اى تغيير في الجهاز
المنصوب بموجب هذه المقاولة فعليه ان يدفع قيمة نفقات هذا
التغيير حسب الاسعار المتبعة في ذلك الوقت . اما اذا كان هذا
التغيير يؤثر على طول الخط المستعمل فحينئذ يعدل بدل
الايجار بموجب الاسعار المتبعة في ذلك الوقت ويشترط انه
اذا نشأ عن هذا التغيير تخفيض في بدل الايجار ان يستوفى
البدل الاصلي حتى نهاية السنة الاولى من مدة المقاولة .
9. Should the subscriber wish any alteration to
be made in the apparatus installed under this
contract, the subscriber shall pay the cost of such
alteration at the rates then in force. Further, if
such alteration effects the length of the line in use
the rent charge will be revised accordingly at the
rates then in force, subject to the proviso that if the
alteration entails a reduction in the rent, the
original rent will be charged to the end of the first
year of the contract term.

(١٠) تعتبر السجلات الموجودة لدى المدير العام
للبريد والبرق دليلا كافيا وقاطعا لبيان تواريخ بدء المقاولة
او انتهاء مدتها او انهائها .
10. The books kept by the Director-General
of Posts and Telegraphs shall be sufficient and con-
clusive proof of the dates of the commencement and
termination or expiration of the contract.

(١١) على المشترك ان يراعى طيلة مدة المقاولة كافة
ما يتعلق بها من القواعد والانظمة النافذة المفعول في ذلك الوقت .
11. The subscriber shall throughout the period
of the contract confirm to all the rules and regula-
tions in force for the time being relating to the
contract.

(١٢) على المشترك عند انهاء هذه المقاولة ان يسلم
الحكومة العراقية الاسلاك والجهاز مع كافة التراكيب واللوازم
الاخرى بحالة جيدة مثل ما كانت عليه عند نصبها ويستثنى من
ذلك الاستهلاك من جراء الاستعمال فقط وللمدير العام ان يقوم
برفع الاسلاك والجهاز على الفور .
12. On the termination of this contract the
subscriber shall surrender to the 'Iraq Government
the said wire and apparatus within all fixtures and
accessories in as good condition as when installed,
ordinary wear and tear alone excepted, and the
Director-General of Posts and Telegraphs may
forthwith remove the same.

(١٣) يكون المشترك مسؤولا عن دفع الرسوم والاجور
المتعلقة بالنداءات البعيدة المسافة الصادرة من تلفون المشترك
المعين في هذه المقاولة وكذلك عن الرسوم والاجور لقاء ماهو
غير معين في تعريفة الاجور من التسهيلات والمواصلات التي
تعطى الى الافراد بناء على طلبهم عند استعمالهم آلة تلفون المشترك .
تدفع كافة هذه الاجور والرسوم الى المدير العام حين
الطلب وعلى المشترك ان يودع ويظل مودعا لدى المدير العام
تأمينا لا يقل في اى وقت كان عن ١٢٥-١ دينار ولا يزيد عن
بدل ايجار ثلاثة اشهر كاملة عن كل تلفون متصل بمركز تبادل
حسب ما يطلب ذلك المدير العام من وقت لآخر تأمينا للاجور
والرسوم وضمانا ضد اية مخالفة للمادة الرابعة اعلاه وفي حالة
التقصير يرفض المدير العام للبريد والبرق ربط اتصال تلفون
13. The subscriber shall be held liable to pay
all fees and charges in respect of calls originating
from the exchange connection specified in the
contract and in respect of the facilities and services
outside tariff rates rendered at the request of persons
using the Exchange Connection. All such charges
and fees shall be paid to the Director-General of
Posts and Telegraphs on demand and the subscriber
shall deposit and keep deposited with the Director-
General of Posts and Telegraphs such sums of
money, not being at any time less than I.D. 1-125
or more than one full quarter's rent for each ex-
change line as the Director-General of Posts and
Telegraphs may from time to require as security for
such fees and charges and as security against any
act contravening Clause 4 above. In default the
Director-General of Posts and Telegraphs may
decline to make any connection involving a charge
which has not been prepaid or to continue a con-
