HIRING CONTRACT. عقد ايجار

5. The subscriber shall not send or receive, nor permit to be sent or received, by or through the said apparatus, any message in respect of which any money or other consideration shall be paid, given or promised to the subscriber or to any other person or body than the ‘Iraq Government.

٦ — سترسل سندات الايجار قبل تاريخ الاستحقاق
بشهر واذا لم تدفع في مدة خمسة عشر يوما اعتبارا
من ذلك التاريخ يمكن قطع الجهاز بدون اعطاء
بلاغ وتعتبر الحكومة العراقية العقد ملغاة من قبل
المشترك او يمكن انهائه من قبل حكومة العراقية
حالا او في اي وقت بعد ذلك بدون اجحاف حق
اخر او صد الحكومة العراقية المذكورة . اذا قطعت
القوة من المشترك بناء على اهماله في دفع قيمة
الاشتراك في المدة المذكورة اعلاه واذا اعيدت
القوة مرة ثانية عند دفع بدل الايجار المستحق
سيكون المشترك مسؤول عن الايجار في مدة قطع
القوة لحد سبعة ايام .
6. Bills for rent will be sent out one clear month prior to the date on which due, and if not paid within fifteen days from such date the apparatus may be disconnected without notice and the contract may be regarded by the ‘Iraq Government as cancelled by the subscriber or may be terminated by the ‘Iraq Government forthwith or at any time thereafter, without prejudice to any other right or remedy of the said ‘Iraq Government. If a subscriber be disconnected on account of his failure to pay the subscription within the time aforesaid and the connection be subsequently restored on payment of the rent due, the subscriber shall be liable for the rent during the period of disconnection up to a limit of seven days.

اي اتفاق او ترتيبات صلح مع دائنيه او حجز محله
او خرق او اهمل انجاز فقرات وشروط هذا العقد
فيمكن للحكومة العراقية ان تنهي هذا العقد في
اعطائها ابلاغا كتابة بدون دفع تعويضات وبدون اجحاف
اي من الحقوق او صد الحكومة العراقية عن استحصال
الاجورات المتراكمة او اي درهم يستحقها بموجب
هذا العقد
7. If the subscriber shall be adjudged insolvent or shall make or enter into any composition or arrangement with his creditors, or shall suffer execution to be levied upon his premises or shall commit any breach of or fail to observe and perform any of the clauses or conditions of this contract, the ‘Iraq Government may terminate this contract by notice in writing without payment of compensation and without prejudice to any other right or remedy of the ‘Iraq Government for the recovery of arrears or such other moneys to which he may be entitled under this contract.

٨ — اذا رغب المشترك عمل اي تبديل في الالة المنشئة
بموجب هذا العقد يجب عليه دفع ثمن التبديلات
حسب اسعار المرعية . واذا هذه التبديلات اثرت
في طول الخط المستعمل يجب ان يصحح بدل الايجار وفقا
للاسعار المرعية بشرط اذا كان التبديل سبب
تنقيص في الايجار يجب ان يستوفى الايجار الاصلي
حتى نهاية السنة الاولى من العقد .
8 Should the subscriber wish any alteration to be made in the apparatus installed under this contract, the subscriber shall pay the cost of such alteration at the rates then in force. Further, if such alteration affects the length of line in use, the rent-charge will be revised accordingly at the rates then in force, subject to the proviso that if the alteration entails a reduction in the rent the original rent will be charged to the end of the first year of the contract term.

9. The books kept by the Director of Telegraphs shall be sufficient and conclusive proof of the dates of the commencement and termination or expiration of the contract.

والنظامات المرعية للمدة التي تخص هذا العقد .
10. The subscriber shall throughout the period of this contract conform to all the rules and regulations in force for the time being relating to this contract.

مع جميع ادواتها في حالة جيدة كما كانت حين
انشائها غير التي تستهلك في الاستعمال وذلك

11. On the termination of this contract the subscriber shall surrender to the ‘Iraq Government the said wire and apparatus with all fixtures and accessories in as good condition as when installed, ordinary wear and tear alone excepted, and the Director of Telegraphs may forthwith remove the same.

CONDITIONS.
( الشروط )
1. If the connection referred to on the
first page is not made within six months of the
date of application, the subscriber may require
the Director of Telegraphs, in writing, to complete
the same within one month and in default the
contract shall lapse.
١ - اذا لم يكمل خط الكهربائي المشار اليه في الصحيفة
الاولى بظرف ستة اشهر من تاريخ الطلب يمكن
للمشترك ان يطالب مدير البرق كتابة على ان
يكمله في مدة شهر واحد والا سينتهي العقد
2. The Director of Telegraphs shall erect
and (subject to the observance by the subscriber
of all the clauses and conditions herein con-
tained) maintain in good working order the
apparatus referred to on the first page hereof, and
in the event of the apparatus not being in good
working order the Director of Telegraphs shall
repair and restore the same with all possible
despatch, and the subscriber shall give all possible
assistance for this purpose ; but it shall be lawful
for the 'Iraq Government on the expiration of
seven days' notice in writing from the Director
of Telegraphs, at any time to remove and take
possession of any apparatus installed under this
contract, should it consider it necessary or
advisable to do so, and in such case a propor-
tionate part of the rent for the unexpired period
paid for by the subscriber shall be refunded.
٢ - سينشىء مدير البرق الالة المبنية في الصحيفة
الاولى في حالة جيدة (بشرط ملاحظة المشترك
لجميع الفقرات والشروط المحتوية فيها ) واذا كانت
الالة المذكورة لم تشتغل في حالة جيدة على مدير
البرق ان يعمرها باسرع ما يمكن وعلى المشترك
ان يمد يد المعاونة مهما امكن لنفس الغاية . وسيكون
الحق للحكومة العراقية عند انتهاء البلاغ المعطى من
مدير البرق لمدة سبعة ايام كتابة في اي وقت
ان ترفع وتمتلك اي آلة مشيدة بموجب هذا العقد
واذا مست الحاجة او رأت ذلك مناسبا في قضايا
كهذه يجب ان تسترجع بدل الايجار في المدة
التي لم تنته .
3. The 'Iraq Government shall not be
liable for any loss or damage occasioned by
the interruption or disturbance or stoppage of
communication from any cause whatsoever ; nor
shall it be liable for any loss or damage occa-
sioned by delay in establishing or restoring
communication.
٣ - لا تكون الحكومة العراقية مسؤولة عن اي ضياع او ضرر
يحصل من الانقطاع او الثورة او وقوف المواصلات
لاي سبب وعن اي ضياع او ضرر يحصل من التأخير
في تأسيس او اعادة المواصلات .
4. The subscriber shall take good care
the apparatus and of all the fixtures and
accessories connected therewith, and shall not
damage, alter or remove the same, or allow the
same to be damaged, altered or removed, and
shall not make or suffer to be made any attach-
ments or alterations to the same, and shall not
obliterate or allow to be obliterated any marks,
words or numbers which may be written, painted,
stamped or impressed thereon. Telegraph
officials and workmen shall at all reasonable times
have access to the premises of the subscriber
and to all other places under the control of the
subscriber, through, under or over which any
part of the wire or apparatus passes or to which
it is fixed, and the subscriber shall have no claim
for the repayment of any moneys which may have
been paid for rent or otherwise under this contract
or for any other compensation or damages what-
soever. In the event of the apparatus or any
part thereof on the subscriber's premises being
damaged or altered from any cause whatsoever,
the subscriber shall pay to the Department the
cost of repair of such damage or alteration.
٤ - يجب على المشترك ان يتحفظ على الالة وعلى
جميع ما يتعلق فيها ولا يسوغ له ان يضررها او
يبدلها او ان يسمح لاحد ان يعمل ذلك . ولا يسوغ
له ايضا ان يضرر او ان يسبب اي ارتباط او
تبديل في نفس الالة . لا يجوز له ان يمحي او يسمح
لاحد ان يزيل اي علامة ( ماركة ) او كلمة او عدد
الذي يمكن كتابته او نقشه او طبعه عليها .
يمكن لموظفي البرق وعمال ان يدخلوا في اي
وقت مناسب محل المشترك والمحال الاخر التي
تحت رقابته والتي تحت او على اي قسم من
الاسلاك او الالة التي تمر او التي مربوطة فيها . ولا
يمكن للمشترك ان يطالب في استرداد بعض
الدراهم التي دفعت لايجار او لغيره بموجب
هذا العقد او اي تعويضات اخرى او اتلاف مهما كان .
وفي حالة تضرر او تبديل الالة او اي قسم منها في
محل المشترك لسبب ما يجب عليه ان يدفع
ثمن تضرر او تبديل كهذا الى الادارة .
