Greetings
In connection with the consideration of the subject of laws issued during the defunct era that conflict with the provisions of the Provisional Constitution issued in
the prosperous Republican era, this committee wishes to place before your Excellency its observations regarding the subject of the deprivation of Iraqi
citizenship from Jews [followers of Moses] pursuant to Law No. 12 of 1951.
1- Whereas the aforementioned law discriminated between Jews and other Iraqis, which is in total conflict with the text of
Article Nine of the Provisional Constitution of 1958, which made all citizens equal before the law in rights and duties.
In addition, the principle of "deprivation of citizenship," the principle established by the aforementioned law, contradicts the explicit text of the Provisional
Constitution, as citizenship is a natural right for every citizen that cannot be taken away.
2- Our community highly appreciates all the democratic steps taken by the government of the Iraqi Republic under the leadership of the
Sole Leader, Major General Abd al-Karim Qasim, those steps that met with full satisfaction and joy from the members of this community
due to what we have sensed in the disappearance of the era of discrimination between citizens in all fields; we hope that our eternal Republican government
will repeal the aforementioned law.

The General Secretariat had taken possession of the movable and immovable property that was at the disposal of the Israelite community
this was due to the loss of Iraqi citizenship by the members of the physical councils of that community or due to the loss of citizenship of the custodians over those funds
except for the Baghdad area, because the Israelite community in Baghdad manages and exploits the funds located within its
jurisdiction. Therefore, it is clear that the funds seized by the Secretariat are those that were under the management of the physical
councils whose members lost Iraqi citizenship or those that were under the management of custodians who lost
Iraqi citizenship. As for other funds under the management of the community in Baghdad or under the management of custodians who still
retain Iraqi citizenship in Baghdad or other Iraqi cities, the Secretariat has not interfered with them. The seizure
as explained above was taken based on what was stated in the Council of Ministers' decision dated 31 / 1 / 1952 and taken in its twelfth session.
As for the instructions of the Ministry of Justice published in the Iraqi Gazette No. 4104 and dated 15 / 2 / 1958, they relate to the funds
