The Karrada Court of First Instance was formed on 24/4/1955 by its judge
Mr. Kadhim Al-Rawaf, authorized to adjudicate in the name of His Majesty the King of
Iraq, and issued the following decision:
Plaintiff: Ibrahim Khalaschi
Defendant: 1) Trustee of the Waqfs of Haskel Menahem Daniel
2) Salih al-Dujaili
The plaintiff claimed in his petition dated that he had rented the house numbered
1/2/2 located in the Al-Sanad neighborhood from the first defendant
for a period of one year from 1/11/1953 until 31/10/1954 for an
annual rent of (108) dinars, and on 26/1/1954 the plaintiff
settled in the aforementioned house for the second defendant for the purpose of
occupying it and submitted the petition with his guarantee. He requested the summoning of both defendants
and a ruling to prevent them from interfering with him in the aforementioned house and to charge them with costs and fees.
On the day appointed for the hearing, the plaintiff and the representative of the first defendant appeared,
Attorney Madin al-Zubaidi, despite being notified and summoned by law.
Since he did not attend the public absentee session, the plaintiff repeated
his petition in the case. The representative of the first defendant replied that the lease contract
period had expired, so it became regarding it ⟦Article⟧ 105, that the plaintiff
did not renew the contract with its period, duration, and location, and due to the inability to obtain
the decision, each of the parties repeated their statements, and the hearing was concluded.
Decision: Upon review, it was found that the plaintiff requested to prevent the interference
of the defendant in enjoying the benefit for the remaining period of the lease contract
1/4/1954. Since the plaintiff had resided until he wanted to request
the two mentioned defendants, and since the lease period had ended and
the plaintiff did not renew the mentioned contract according to the regulations, he has the right to demand
to prevent the interference of the defendants in enjoying the benefit. Therefore, it was decided to dismiss
the plaintiff's lawsuit while charging him with the expenses, a judgment in presence for the plaintiff and in absentia
for the second defendant.
