This Legation has granted the Iranian scholar named Sheikh Murtaza Majhul son of Sheikh Zain al-Abidin, holder of
Iranian passport No. 26407 dated 12 / 19 / 1938 issued in Mashhad, a transit visa
No. 3162 dated 11 / 26 / 1939 for the purpose of passing through to Mecca for the Hajj.
The aforementioned person returned to us claiming that the border authorities in Khanaqin prevented his entry into Iraq on the pretext that
his place of residence, as stated in the passport, is Najaf, and therefore he should have obtained a regular visa authorizing him
to reside in Iraq, whereas the aforementioned person wishes to pass through Iraq via transit to Mecca, and since
there is no consulate for the Kingdom of Saudi Arabia in Iran and he wishes to travel by the overland Hajj route, there is no need
to obtain a visa authorizing entry into one of the neighboring countries.
Please kindly mediate to inform us of the validity of the claimant's assertion and the reasons that led to the refusal of the border
officials to allow the aforementioned person entry into Iraq while he had obtained a visa authorizing him to do so, and to kindly issue
the necessary order to allow such persons to pass through Iraq and obtain an entry visa to the Kingdom of Saudi
Arabia from Baghdad.

On the occasion of the Hajj season, requests have poured in heavily from Iranian scholars who intend
to perform Hajj. We have, in turn, sought the approval of the Directorate General of Police regarding their requests concerning residency in
Iraq. However, due to the lack of necessary responses from the Directorate General of Police in this regard,
a large number of them have approached us requesting transit visas for the purpose of Hajj through the mediation of the Iranian Ministry of Foreign Affairs
and other parties. We have granted them transit visas based on your circular numbered ⟦297/4/10/7⟧ and dated ⟦6/9/1939⟧
after ensuring there is no objection to that. Since there is no consulate for the Kingdom of Saudi Arabia in
Iran on one hand, and on the other hand, these individuals want to travel via the overland Hajj route, it was necessary for us
to obtain a visa for them that entitles them to enter one of the neighboring countries.
Please kindly issue the necessary orders to the border officials to allow such individuals to enter
Iraq, monitor them closely, and compel them to continue their journey to Hajj after obtaining the necessary visa
from the Saudi Arabian Legation in Baghdad, so that they do not cling to or obtain residency in Iraq.

Reference your secret letter No. S/1234 dated 16/8/1939.
Upon auditing what you explained in paragraph 2 of your aforementioned letter regarding the transit
visa, it appeared to us that although its name indicates that the purpose of granting it is
to ensure the passage of its holder from the Kingdom that granted it to another Kingdom, its definition
mentioned in Article 3 of the Residence Law stated that it (entitles the grantee the
right to enter Iraq once within a year from the date of its issuance and to reside therein
for a period of (15) days). This helps in not considering the granting of this visa restricted to the purpose
of transiting through Iraq; however, relying on the concept of this type of visa, we had stated in
paragraph 5 of the instructions issued to clarify the provisions of the
Residence Law, the application of which pertains to Iraqi consuls and their representatives, the necessity of confirming
before granting it that the applicant has obtained a visa entitling them the right to enter
one of the neighboring countries of Iraq. Therefore, the text of the law allows for amending the text of the
instructions by making the application of this condition restricted to cases where the purpose of the
transit visa applicant is indeed to transit through Iraq. But if they do not intend to transit but rather intend to come
to Iraq for a temporary purpose for which a transit visa is sufficient, there is no objection to granting this visa

We present to your office below our observations on the proposals contained in the letter of the Royal Iraqi Consulate

1- We support limiting the granting of visas by the Royal Iraqi Consulate in Iran to the residents of its region
provided that the place of birth and the city where the passport was issued are noted, because the competent consulate
would be more aware of the status and movements of the visa applicant than others, and it is the same method followed by
Iranian consulates in Iraq.
2- Transit visas are usually granted to persons who intend to pass through Iraq to other kingdoms;

Karbala and Najaf to ask the Regional Police Directorate about the situation
in the region regarding his identity, Q?
