With reference to your letter No. Q / 19079 / 529 / 100 dated
December 25, 1939.
It is not hidden from your Ministry that no obstacles were placed in the way of the arrival of
Iranian subjects to Iraq, and the movement of these people between the two countries is proceeding with full freedom,
except that in view of what had appeared from the abnormal situation adopted by
Iranian clergymen after their arrival in Iraq, and the emergence of intentions they had other
than those they had declared when requesting to come to it, this Ministry had
decided to take the measures mentioned in its letter No. Kh / 1693 dated
May 21, 1939, which were intended to verify the reality of the interests that
bind such people to Iraq on one hand, and to maintain public tranquility within the country on the
other hand. No one can deny any government in the world
its right to do so.
Based on the above, we do not see anything that calls for changing the plan established in this regard,
and we believe that your Ministry supports this, and we request that the Iranian Legation be answered in the appropriate manner.
This Ministry has noted with great regret that the Iranian authorities - whether in
this case or in many other cases - are following a path that is inconsistent with the basic
principles that two neighboring countries must follow in dealing with matters that
arise between them, as well as diplomatic courtesies, in that they assert the correctness of
matters they attribute to the Iraqi authorities for the requirements of justice and neighborly
relations before they know the facts, and consequently resort to threats to take
retaliatory measures. Dealing with this aspect of the subject, although it belongs
to your Ministry alone, we would like to indicate that if the Iraqi authorities wanted to
specify the measures that were in fact contrary to international practice and contrary
to the rules of friendship which the Iranian authorities had previously taken against subjects

The Imperial Iranian Legation presents its compliments to the Royal Iraqi Ministry of Foreign Affairs
and has the honor to respond to its memorandum numbered Q/15677/529/100 and dated October 16
1939, and to inform it that among the persons to whom the Royal Iraqi consulates
in Iran refuse to grant the necessary visa for entry into Iraq are the Iranian scholars who wish
to travel to Iraq or return to it. The aforementioned consulates obstruct this matter specifically,
and lately, they make its completion conditional upon obtaining permission from the Royal Iraqi Government, while those
who intend to travel to Iraq <del>will sit</del> include among them individuals who had been residing in Iraq for many years,
and their travel to Iran was for medical treatment or to visit their relatives temporarily; and now when they wish
to return to Iraq, they are demanded to produce residency permits or other obstacles are placed before them.
Such actions by the Iraqi consulates and their restrictions against Iranian subjects,
since they are very much contrary to the prevailing friendship between the two kingdoms, it is requested to kindly have the competent authorities
decide on this matter firmly and issue confirmed instructions to the Iraqi consulates in Iran
to amend their treatment toward Iranian subjects who wish to travel to Iraq and to cease
placing obstacles before them without any justification; otherwise, the Imperial State will be forced to reconsider
the method followed by it regarding the travel of Iraqi subjects to Iran.

The Iraqi Consulate in Tabriz requested the approval of the General Police Directorate
on granting an entry visa to the two Iranian scholars mentioned above to Iraq, so
the mentioned directorate replied that it has no objection to that in its letter numbered 7454
on 14 / 4 / 938, and since the purpose of the mentioned persons' request to come to Iraq was not clear to the consulate, it
inquired again from the General Police Directorate
regarding the validity and necessity of their visit to Iraq
The Iraqi Consulate in Tabriz stated that the purpose of reaching the regions of
Iraq is to visit the Holy Shrines, and that Agha
the one called Agha Bashari Tabrizi is going to Shayesteh where he resides
and upon its investigation as to whether they have any desire to come to Iraq, as for the second
Habib Mirza Habibullah, he is continuing his follow-ups regarding the granting of the visa
The General Police Directorate stated to the Ministry of Foreign Affairs to instruct the processing of
the request of the mentioned person in light of what was stated in its letter regarding the validity
of the purpose and his grace's approval for the sake of granting the concerned persons an entry visa
to Iraq validly
The Iraqi Consulate in Tabriz stated in its letter numbered 225 / 4 / 14 on 28
and dated 5 July 938 that it is verifying that Agha Bashari Mirza Habibullah
informed that consulate about the purpose and repeated that his goal is
visiting the Holy Shrines and he wants to remain in Iraq at the end of
the current summer, and since it has [no objection] to granting the entry visa to Iraq

-1 Please kindly refer to our letter No. S / 1007 dated
28/6/39 regarding the entry of Iranian scholars, which contains the necessary
clarifications requested by the esteemed Ministry in paragraph three of its letter
No. M.Kh / 1693 dated 15/5/39.
-2 It has become clear as a result of the investigation that there is nothing against the two scholars
Al-Hajj Mirza Habibullah Maleki and Rassi al-Shabestari, but in view
of the recently adopted plan, we leave the matter of allowing them to enter
Iraq to the opinion of the esteemed Ministry.

After the investigation carried out by this consulate, it became clear that Haj Mirza Habibullah
Aalam Malaki son of Haji Muhammad Hussain is among the persons characterized by good conduct and that his purpose
for entering Iraq is only to visit the Holy Shrines, provided that he travels at the end of the current summer
season for the aforementioned purpose. Therefore, we have no objection to granting him the visa to enter Iraq after
your approval thereof.
