With reference to your letter No. Q / 12 / 12 / 100 / 472 dated
January 24, 1940.
It is no secret that there is a decided plan adopted after deep reflection and coupled with the support
of your Ministry regarding the arrival of Iranian religious scholars to Iraq. The
motive for adopting this plan, as is also not hidden from you, was
the suspicious situations and harmful conditions characterized by most of these scholars towards the entity
of the Kingdom. On the occasion of the requests made by the Iranian Legation
in Baghdad recently, the Iraqi government clarified its position regarding their case with justification
along the lines of what was stated in your Ministry's two memorandums numbered Q / 12 / 12 / 100 and Q / 12 / 12 /
100 / 365 dated 1/6/1940 and 1/16/1940. However, the mentioned scholars,
when they felt the firmness of the Iraqi authorities' stance against their disregard
for the country's interests, began to circumvent the followed plan by applying
for entry to Iraq using its land for visiting the Holy Shrines in the Karbala Governorate
or going to the Hijaz to perform the Hajj pilgrimage or otherwise, pretending to be satisfied
with transit visas which there was no choice but to grant, considering that the duration of this type
of visa is more than what one of them might need to perform the duty of visiting
or passing through Iraq to the Hijaz, if this was the true intention for coming
to Iraq. Upon their arrival, they began to persist in staying, and their requests
of this kind multiplied, supported by representations from the Iranian Legation and consulates in Iraq
in a manner that invites more suspicion regarding the eagerness of the aforementioned Iranian authorities
for their freedom of movement between Iran and Iraq, and showing sympathy for them in a way that does not align with the reality
of the Iranian government's treatment of religious men like them in their own country. The
Iranian Legation has reinforced the arrival of the scholars whose names appeared in the list attached
to its memorandum notified to us by your letter being answered, into obstacles placed by the consulates

the Iraqis in Iran in this regard.
Based on the foregoing, this Ministry cannot deviate from the established plan ⟦hinted⟧
at, nor does it see any interest in considering residence requests from Iranian
religious scholars in the form submitted by the Iranian Legation. Rather, it will
handle these requests (when they occur) individually, each request according to its circumstances
and on the basis of verifying the reasons for the applicant's departure to Iran, if they were
previously residing in Iraq, and the purpose for which the transit visa through Iraq was granted,
and the true nature of the relations that bind them to this country, and ensuring the absence
or potential emergence of harm from their residence therein.
We therefore request that you respond to the Iranian Legation as you deem appropriate in light of the above.

listed in the list attached to this memorandum, were forced to travel to Iraq via
transit due to the obstacles placed by the Royal Iraqi consulates in Iran against
their travel to Iraq. Therefore, please be so kind as to mediate in issuing the necessary instructions
to extend the residency periods of the aforementioned scholars, most of whom are Iranians residing in
Iraq and had traveled to Iran temporarily, so that the Iraqi authorities do not,
after the expiration of their residency periods in Iraq, prevent them from residing there or cause
difficulties for them, so they can reside in Iraq for a period of time and return to Iran after
settling their affairs.

We support the Ministry of Interior regarding the abnormal conduct of the Iranian
clerics for their activities in intrigue, espionage, and spreading harmful propaganda against Iraq.
Therefore, the measures proposed by the aforementioned Ministry against them were appropriate.
We also support the observations made by the aforementioned Ministry regarding the agitation of Iranian
authorities in handling these cases and others, which are not based on truth and do not align

in Baghdad and with reference to the correspondence ending with the Legation's memorandum numbered
7991 and dated 31 December 1939, it has the honor to state that the
Royal Iraqi Consulates in Iran do not hesitate to grant Iraqi visas to Iranian
subjects of various sects in accordance with the laws in force in this regard. As for
those whose identities are unknown to them and who have no clear purpose for traveling

Subject: Visas for scholars.
The Iraqi Legation in Tehran stated in its letter ⟦565⟧ that
requests from Iranian scholars have poured in heavily on the occasion of the season
of Hajj, and that it has in turn obtained the approval of the General Police Directorate
for this, but given the lack of arrival of responses to them
from the General Police despite the frequent urgings upon it (the Legation)
from many sides, it has proceeded to grant these scholars
transit visas for the purpose of Hajj after ensuring there is no objection to
that. Since there is no Saudi consulate in Iran
on one hand, and these individuals wish to travel via the land Hajj route,
the Legation did not see a necessity for them to obtain an entry visa
to one of the neighboring countries and requested the issuance of necessary orders
to border officials to allow them entry into Iraq and to proceed until
they obtain the visa from the Saudi Legation in
Baghdad and not to allow them the opportunity to obtain residency in Baghdad.
We, in turn, have written to the General Police to take necessary action and informed
a copy to the Foreign Ministry (M. Kh.) for information.
Therefore, and in view of the humanitarian aspect mentioned in the Legation's letter
which referred us to the aforementioned Legation's letter, I request
your approval to draw its attention to the letter in a manner that ensures
the pilgrimage of the aforementioned and facilitates the issue as requested.
