It is understood from the legal expression contained in paragraph (b) of Article Three
of the Residence Law that the (transit visa) came restricted for the purpose of transit because the specified period
for residence in Iraq under this visa is only to ensure that the traveler takes the measures
necessary to continue his journey after resting from the hardships of travel. This rule is followed
by all other kingdoms and the evidence for its implementation for the purpose of transit is the text contained
in the second paragraph of Article Thirteen of the same law, which requires that there be collected
from a foreigner who enters Iraq with a transit visa and is granted permission to reside according to Article Six
the difference between the transit visa fee and the regular visa fee in addition to the residence book fee.
Based on the above, a transit visa cannot be granted to persons for whom
the condition of obtaining a visa authorizing them to enter one of the kingdoms neighboring Iraq is not met
because it cannot be considered for any purpose other than transit through it.
Accordingly, please inform us of the result of what you decide in this regard.

cases in which it was seen that this visa should be granted to children
exceeding the period allowed for such persons to reside in Iraq
and the proportionality of this period with the purpose of transit

from the Residence Law ⟦...⟧ considering the difference in the fee
⟦and supports⟧ the police's point of view as the law did not stipulate
the text regarding not causing trouble for the person

The Ministry of Foreign Affairs presents its compliments to the Imperial Iranian Legation in
Baghdad and with reference to the previous communication in the Legation's memorandum No. 842 dated
January 18, 1940, has the honor to state that it is difficult for the competent Iraqi
authorities to handle the residency cases of a group of foreigners as a unified case,
rather, the regulations and laws require them to study each case individually and not to grant
a residency permit except after confirming the existence of a relationship for the person that justifies their stay in Iraq.
Therefore, in this situation, it is unfortunately not possible to meet the Legation's request regarding extending the residency periods
of the persons mentioned in the Legation's list attached to its memorandum No. 831 dated
15 / 1 / 1940, noting that the authorities will study the matter of each request from them
individually and grant a residency permit to those whose stay is not seen as problematic, and apply the regulations
and laws against those whose behavior is found to be inconsistent with the interest of the country.
The Ministry takes this opportunity to express its highest appreciation and respect.

We convey to your position below a copy of the letter from the Royal Iraqi Legation in Tehran
Number 1284 / 4 / 2 and dated 10/28/39 regarding the request to grant the Iranian scholar
Named Abu al-Hasan Pish Namaz Amoli an entry visa to Iraq for your kind perusal.
Noting that we did not find as a result of the investigation anyone who knows the aforementioned in Najaf
Also, Hajj Abdul Wahid Sukkara has denied knowing him. Therefore, we recommend rejecting his request
And we ask you to kindly inform the Ministry of Foreign Affairs of this so that the Iraqi Legation can be notified
of the matter;

The Iranian scholar named Abu al-Hasan Pish Namaz Amoli visited this Legation
Holder of Iranian passport number 32387 dated 10/9/39 issued from
Tehran, requesting to be granted an entry visa to Iraq for the purpose of visiting and attending to some private
interests according to his claim.
The place of residence of the aforementioned is in Najaf as mentioned in his passport, and he cites
Sheikh Abdul Wahid al-Hajj Sukkara and Mr. Kadhim Al-Naib, an employee in the Ministry of Economy.
