It has become clear to us as a result of the investigation that Muhammad Qasim was born in Karbala, however we
did not reach a knowledge of the real reasons that made him frequent Iran
except that what is known is that he goes to visit his nieces and to visit the Holy
Shrines. Therefore, please kindly provide us with your decision regarding his return to Iraq
in order to take the necessary legal action.

Subject - Transit Visa.
Paragraph (b) of Article 3 of the Residence Law defined the transit visa
as that which (entitles the grantee the right to enter Iraq once within
a year from the date of its issuance and reside therein for (15) days). We have noted from this definition
that although this visa is named a (transit visa), there is nothing in its definition that restricts
its granting for the purpose of passing through Iraq only; rather, it may be granted to those who intend to visit Iraq
for a short period not exceeding the period allowed by the transit visa. Accordingly, please kindly indicate
whether you support this.
On behalf of the Undersecretary of the Ministry of Interior
A copy thereof to " -
Directorate General of Police for information, with reference to your secret letter numbered S/878 and dated
13 / 5 / 1940. We wish to state regarding the precaution you mentioned, which is
the difficulty of deporting foreigners from Iraq after the expiry of the period allowed for them
to reside in Iraq if their continued stay is undesirable, given
that governments, due to current circumstances, have adopted a policy of closing their countries' doors
to foreigners - that this difficulty applies to all foreigners who
are permitted to enter Iraq under any type of visa. Adopting
the opinion we have stated regarding the transit visa does not increase this risk. Therefore, please
inform us of your opinion on making a decision - in view of current circumstances due to the ongoing
war - on the necessity of the foreigner who requests a visa to enter
Iraq - of whatever type - possessing a visa that assists them in entering
any country neighboring Iraq when the period of residence allowed to them by the type
of visa they requested expires. If they apply thereafter in Iraq for an extension of their residence,
it shall be noted not to extend it until they ensure the continued validity of the visa that

Transit Visas
The Tabriz Consulate, in the process of granting visas to
Iranian subjects, has adopted the granting of a transit visa to those of these scholars who request
an entry visa to Iraq under the pretext of
visiting the Holy Shrines, specifically for those whose
sincerity of intent is difficult to ascertain by the Directorate of General Security and the aforementioned
consulate.
Our guidance ⟦views⟧ not granting such
a proposal because a transit visa is only granted to those who intend
to pass through Iraq to other countries, or upon the auditing of
this department it appeared that [the transit visa], although it is ⟦claimed⟧
⟦fundamentally⟧ that its purpose is to ensure the passage of its holder from the kingdom
to which he belongs to another kingdom, yet it has been used recently
⟦purposes⟧ this clarification that it [grants] the grantee the right to enter
Iraq and stay therein once during a period of one year
from the date of its issuance and to reside there for a period of (15) days as it is.
We ⟦consider⟧ this type of visa to be incomprehensible, just as we have in
our previous ⟦correspondence⟧ that consuls shall not grant if there is
in granting such, especially since the one requesting it has obtained
a visa authorizing him the right to enter one of the countries neighboring Iraq.
Accordingly, our consulates abroad, upon changing instructions in
the approach, the last condition applies in the event of a desire to practice
- 2 -
by actually passing through Iraq, but if he intends to visit Iraq
for a short period, this prevents him from being granted this visa without fulfilling
the mentioned condition.
The company's proposals have been discussed before our directorate
and we discussed this opinion and we have clarified our views
summarized in that the stay of these individuals after the passing of whatever he wishes
and their passports returned on the date of the spender who was inspected by the opinion
mentioned, and therefore I see that the opinion should be delayed in acting as he wishes
and stating our demands as follows:
As for the supplement mentioned by the company in its documents
attached to the report, it is valid because it is necessary that we, after
granting foreigners a visa regulating the right to cross Iraq
for a period less than what was not granted to them as a regular visa, and this is
what we did. As for the observed difficulty in deporting foreigners
from Iraq due to the expiration of the residence period allowed for them
and it being undesirable for their stay to continue, this
difficulty is general and faces all foreigners who
enter Iraq for purposes other than passing through it and who are
in possession of the necessary visa that helps them to
pass into a country neighboring Iraq, and therefore the matter is placed
under the observation of the Professor, Director of Opinion, as to whether the current international situation
is such that it requires us to take a necessary decision

We discussed this question and we explained to ⟦...⟧ that we
aspire to have a law that limits the tragedy
and destitution of those who returned in the history of Iraq, the current discussion
mentioned, and accordingly I see that the decision on acting upon the statement should be delayed
and our demands stated as follows:-
As for the caution mentioned by the police in their memorandum
attached, it is irrelevant because it is necessary for us to grant
granting foreigners a visa to provide the right to cross Iraq
once less than what is granted to them as a regular visa, and this is
what we did. As for the observed difficulty in deporting foreigners
from Iraq after the permitted period of residence for them ends
and they are undesirable for their continued stay, then this
difficulty is general and applies to all foreigners who
enter Iraq for purposes other than transit through it and are
possessing the necessary visa for that, so helping them to
transit to a country neighboring Iraq, and accordingly the order is signed
that Excellency and asks for an opinion on whether the current international situation
is such that it requires taking a necessary decision

This directorate still believes that the transit visa was established for the purpose of passing
through Iraq to another kingdom and not for the purpose of entering and residing in it, even for a
short period, as evidenced by the existence of another visa, which is the ordinary visa mentioned in paragraph
(a) of Article Three and the second paragraph of Article Thirteen of the law. In any
case, we leave the final opinion to the Ministry if it sees otherwise, but what we hope to clarify
in this regard is that some foreigners, especially those whose stay is not desired
in the country, will exploit this aspect and benefit from it to the maximum extent possible, and thus
this directorate will face many difficulties in deporting these people when it is decided that their
stay in Iraq is undesirable, especially since current circumstances have led most governments to close
