an opinion regarding granting the Iranian scholar named Mr. Mirza Shams Shemirani

As a result of the investigation, it appeared that the persons cited by the aforementioned
do not know him, and therefore it is impossible to express an opinion regarding this request of his, and in view
of the current global circumstances, we do not find it appropriate to allow him to enter
into Iraq. Therefore, we kindly ask to reject his request and inform us of that.

181 / 2 / 12 and dated 26 / 2 / 40 (copy attached herewith) to express
an opinion regarding granting the Iranian scholar named Mr. Mirza Shams Shamrani
an entry visa to Iraq.
The investigation revealed that the persons cited as references by the aforementioned
do not know him; therefore, it is difficult to express an opinion regarding this request of his, and considering
the current global circumstances, we do not find it appropriate to allow him to enter
Iraq. Therefore, we request you to kindly refuse his request and inform us accordingly.

Paragraph (b) of Article 3 of the Residence Law defined the transit visa
as that which (entitles the grantee the right to enter Iraq once within
a year from the date of its issuance and reside therein for (15) days). We have noted from this definition
that although this visa is named a (transit visa), there is nothing in its definition that restricts
its granting for the purpose of passing through Iraq only; rather, it may be granted to those who intend to visit Iraq
for a short period not exceeding the period allowed by the transit visa. Accordingly, please kindly indicate
whether you support this.

13 / 5 / 1940. We wish to state regarding the precaution you mentioned, which is
the difficulty of deporting foreigners from Iraq after the expiry of the period allowed for them
to reside in Iraq if their continued stay is undesirable, given
that governments, due to current circumstances, have adopted a policy of closing their countries' doors
to foreigners - that this difficulty applies to all foreigners who
are permitted to enter Iraq under any type of visa. Adopting
the opinion we have stated regarding the transit visa does not increase this risk. Therefore, please
inform us of your opinion on making a decision - in view of current circumstances due to the ongoing
war - on the necessity of the foreigner who requests a visa to enter
Iraq - of whatever type - possessing a visa that assists them in entering
any country neighboring Iraq when the period of residence allowed to them by the type
of visa they requested expires. If they apply thereafter in Iraq for an extension of their residence,
it shall be noted not to extend it until they ensure the continued validity of the visa that

Transit Visas
The Tabriz Consulate, in the process of granting visas to
Iranian subjects, has adopted the granting of a transit visa to those of these scholars who request
an entry visa to Iraq under the pretext of
visiting the Holy Shrines, specifically for those whose
sincerity of intent is difficult to ascertain by the Directorate of General Security and the aforementioned
consulate.
Our guidance ⟦views⟧ not granting such
a proposal because a transit visa is only granted to those who intend
to pass through Iraq to other countries, or upon the auditing of
this department it appeared that [the transit visa], although it is ⟦claimed⟧
⟦fundamentally⟧ that its purpose is to ensure the passage of its holder from the kingdom
to which he belongs to another kingdom, yet it has been used recently
⟦purposes⟧ this clarification that it [grants] the grantee the right to enter
Iraq and stay therein once during a period of one year
from the date of its issuance and to reside there for a period of (15) days as it is.
We ⟦consider⟧ this type of visa to be incomprehensible, just as we have in
our previous ⟦correspondence⟧ that consuls shall not grant if there is
in granting such, especially since the one requesting it has obtained
a visa authorizing him the right to enter one of the countries neighboring Iraq.
Accordingly, our consulates abroad, upon changing instructions in
the approach, the last condition applies in the event of a desire to practice

Iranian scholar called Sheikh Fathallah Shahidi for the purpose of visiting and supervising the repair of his house
located in Najaf. It has been confirmed as a result of the investigation that the aforementioned person has a house in the
Al-Mishraq neighborhood in Najaf where he previously resided when he was in Iraq, and it was also confirmed
that there is nothing against him, therefore we request the favor of deciding what you see fit regarding this request
and informing us.

In view of the end of the season for visiting the Holy Shrines and because there is no justification for the arrival of
the Iranian scholar Mr. Ismail Sajjadi to Iraq, we do not approve granting him
an entry visa to Iraq and we recommend rejecting his request at the present time .
