The First Session
Minutes of the Secular Council meeting held on 11/27/1949
Based on the invitation of His Eminence the Head of the Community – Rabbi Sassoon Khedhouri – to hold a meeting of this council
for the purpose of electing a new President of the Secular Council at four-thirty in the evening of Sunday,
November 27, 1949, and in view of the end of the term of the current Secular Council on October 30, 1949.
And in view of the receipt of three letters from His Eminence Rabbi Sassoon Khedhouri dated 20, 22, and 27
November 1949, in which he requests to submit his resignation from the General Council, the respected Mr. Tawfiq,
President of the Secular Council (according to the provisions of the second paragraph of Article Six of the Law of the Jewish
Community No. 77 of 1931), has called the General Council to hold a meeting at the Community House at four
and a half post-meridiem on Sunday, November 27, 1949, for the purpose of
considering the aforementioned resignation.
At the appointed time, twenty-one members of the General Council were present, whose names are
recorded elsewhere in this register. Since a quorum was reached, the respected Mr. Tawfiq,
President of the Secular Council, opened the session with a welcoming speech under his chairmanship and directed the secretary to read the minutes
of the previous session. They were read, and he then asked if anyone had an objection to their content, and no
objection was raised. Then, he placed the first item of the agenda up for discussion, which is the election of a new President
for the Secular Council. Mr. Mir Basri, Vice President of the Secular Council, put forward a proposal
to postpone the election of a new President of the Secular Council <del>because of</del> ⟦illegible⟧ until the reading
of the (current) clarification. The President put this proposal to a vote and it was accepted.
The President moved to the second item of the agenda, which is the consideration of the letters of resignation of
His Eminence Rabbi Sassoon Khedhouri from the leadership of the community, copies of which are recorded below –

Out of concern for the interest of the community, I have seen it as my duty to repeat this request of mine to present my resignation

Then the President instructed the Secretary to read the resignation letters, and they were read. Then he proceeded with the deliberation
for the sake of speaking, so Mr. Naim Zilkha, Vice President of the Spiritual Council, spoke and submitted a proposal to endorse
the resignation while submitting a petition to His Excellency the Minister of Justice to accept it, and he read the draft of the telegram that
Rabbi Sassoon Khadhuri suggests and presented it for the benefit of the community. Then His Excellency
Salman Merka Aboudi spoke and requested the reading of the annexed article of the community law regarding the acceptance of
the resignation of the head of the community, so Article Four of the community law was read, then followed by Mr.
Ezra Y. Isaac, who mentioned that there is no explicit article in the law authorizing the General Council

Considering the acceptance or rejection of the resignation of the head of the community, rather the decision on such a matter belongs to

and the second is practical. From the legal side, there is no explicit authorization for the Community Council to accept it
but from the practical side, all persons know the circumstances and capabilities, and he has knowledge and experience in

In general, however, he sees that there is no scope from a legal standpoint ⟦in the availability of⟧ the General Council
in the matter of accepting or rejecting the resignation, although it cannot be denied that the matter of accepting the resignation
and the matter of the midwife's progress are interconnected and inseparable at the present time.
Then Mr. Daoud Salman, the Honorary Secretary of the Schools Committee, spoke and supported Mr. Ibrahim Al-Kabir,
passing through all the directions he had taken, emphasizing that the recommendation to the competent authorities
or the citation of the answers contained in the law, then alerts the General Council that it is very
necessary to speed up the matter of saving the midwife problem, otherwise the Schools Committee will not continue,
with great regret, to bear the responsibility for closing some schools, especially those that bear the burdens of
the poor class, such as the Munshi Saleh School, for example, which receives a subsidy of 5,500 dinars annually,
and the midwife administrations and other schools. The Schools Committee, in its capacity as the one responsible
for the operation of these schools, believes that it is duty-bound to report the seriousness of the situation and the Council's opinion
to the competent authorities.
Then he was followed by Mr. Meir Youssef, Vice President of the General Council, who mentioned that he thanks
the brothers who provided the opportunity for the General Council to study the subject with all clarity,
but he ⟦believes⟧ that the subject does not need these clarifications and that, in his capacity as Vice President of
the Lay Council, he clarifies to the General Council that the Lay Council faces extremely difficult and serious duties,
knowing that the current Lay Council's term has ended, but it is forced to continue
bearing responsibility, and that he personally, as many agree with him, does not see a link between the matter of
the midwife and the matter of the resignation of the head of the community, but in order to address the situation, one must look at
reality, and the realistic aspect must be given its value regardless of the purely legal
aspect. The Lay Council ⟦is not⟧ able to carry out its work if the midwife problem does not end,
⟦illegible⟧ that it might be difficult for the Council to send the ⟦necessary⟧ ships for safety,
and he emphasized that the Lay Council believes it is necessary to inform the competent authorities of the General Council's opinion
regarding the acceptance or rejection of the resignation.
Then Mr. Saleh Faraj Haitham spoke and presented a detailed picture of how the midwife's revenues
are distributed to schools, hospitals, and charitable institutions.
Then Mr. Salman Al-Kabir concluded with a ⟦practical⟧ proposal ⟦in the name of⟧ the assistant to His Eminence the Rabbi ⟦according to⟧ the rules.
Then he was followed by Mr. Saleh Gilead, who expressed his fear of the Council being hindered in such a
matter, lest it be considered a precedent that binds the General Council in the future.
Then he was followed by Mr. Meir Youssef, who reiterated that it is difficult for the Council to be forced to
forget or decide to close a school or stop the work of a hospital or clinic, and he believes
it is the duty of the General Council to state its opinion clearly on the matter of the resignation, just as the Lay Council
wants before the competent authorities ⟦and departments⟧ ⟦illegible⟧ to decide that there must be a ⟦solution⟧

from the General Council to decide on the issues that ⟦illegible⟧ the financial matter that must be decided.
Then he was followed by Mr. Sahyoun Hayyim, a member of the Lay Council, who supported Mr. Murad in what
he went towards and requested the Council's approval to express its opinion on accepting or rejecting the resignation.
He was followed by Mr. Ibrahim Al-Kabir, stating that the Rabbinical <del>Committee</del> had given importance
more than the matter requires, and facts must be looked at as they are, and he repeated that the present context
constitutes sufficient reasons that gave him the right to request, and it was repeated by the General Council to express its opinion
frankly on accepting the resignation. Then Mr. Ibrahim Al-Kabir supported the words of Mr. Anwar
Nakhla and Salman Al-Kabir, as Mr. Saqr Murad explained that in view of what the honorable
members presented of clarification, he is changing his opinion regarding the illegality of the General Council's right
in the matter of the resignation, and confirming with them that the interest requires notifying the esteemed Ministry
of Justice of the Council's opinion in this regard.
Then Mr. Murad Yusuf submitted the following proposal:
"In view of the resignation of His Eminence the Hakham Bashi
"And the enlightenment of the Council in view of the reasons he presented
"And out of concern for the interest of the community, to petition His Excellency
"The Minister of Justice to accept the resignation."
The President put this proposal to a vote, and the approval was fourteen out of
forty-one members.
Then Mr. Murad Yusuf submitted a proposal to adjourn the meeting until four-thirty
on the evening of Sunday, December 4, 1949, for the purpose of considering the issue of electing
a president and a new Lay Council. This proposal was put to a vote and accepted, and thus the
session was concluded.

Minutes of the Extraordinary General Council Meeting (Postponed)
Held on December 24, 1944
Upon the invitation of Mr. Eliyahu Hayyim Tawfiq, President of the Jewish Lay Council in Baghdad (according to
the provisions of the second paragraph of Article 6 of the Jewish Community Law No. 77 of 1931), there attended
at the community administration headquarters at 4:30 PM on Sunday, December 24, 1944, forty-
five members whose names are recorded elsewhere in this register to hold the postponed meeting for the election of a President
and a new Lay Council due to the expiration of the current Lay Council's term.
Since a quorum was present, the President opened the meeting and instructed the Secretary to read the minutes of the
previous meeting, then asked if anyone had an objection to the minutes; no objection was raised. Then the President instructed
the distribution of papers to the members to elect a President and members of the Lay Council, and requested His Eminence Rabbi
Salman Huqi Aboudi and Messrs. Daoud Salman and Yamin Murad to supervise the election. After classifying
the opinions by the aforementioned committee, the following result appeared:-

one vote. Eighteen missing votes appeared in the election papers.
