The Council met under the chairmanship of the Vice President Mr. Meer Basri and the attendance of members Messrs. Ibrahim
El-Kabir, Yaqoub Shlomo, Gurji Mathalon, Sassoon Bashi, and Abdullah Shina, and considered the letter of the President of the Council
the Lay Council Mr. Heskel Dawood Shemtob numbered T/1463/50 and dated 8/2/1950 addressed
to His Excellency the Minister of Justice with a copy to the Council. After deliberation on the subject, the Council decided to cherish
the presidency of Mr. Heskel Dawood Shemtob and to entreat him to withdraw his resignation and continue presiding over the Council
and to delegate the Vice President Mr. Meer Basri and the member Mr. Yaqoub Shlomo to meet him immediately accompanied by some
notables whom they choose and to inform him of this resolution.

dated 8 / 8 / 1950 to the Presidency of the Lay Council and the text of this council's decision

The subject concerns my resignation from the "Acting Presidency of the Community" and from the presidency of the Lay Council
and membership in this council due to my upcoming travel to Europe for health reasons. Recently, the desire of
both this council and the delegation it appointed, as well as the community notables around the departments, emerged regarding accepting the mission in the community
Therefore, in compliance with the desire of the Government, may God support it, to implement cooperation regarding governmental and communal matters
and to implement the aforementioned desires, it was necessary to state the following observations: -
Acting Presidency of the Community.
What requires drawing attention is that the resignation letter clarifies with the utmost clarity the extreme necessity
which was created by the known difficult circumstances for everyone regarding filling the position of the Presidency of the
Community in an acting capacity by reconciling paragraph (2) of Article (6) of the Jewish Community
Law No. (77) of 1931 with a special erroneous interpretation in the event of a "vacancy in the position of the
Head of the Community," such that the matter led to performing honorary service for a period of (8) months past, and the
mentioned vacancy followed the issuance of the High Royal Decree No. 700 on 4 / 12 / 1941
by implementing the prior resignation.
Speed of electing a new Head of the Community according to Article (11) of the Bylaws.
There is now a vacancy in the position of the Head of the Community, which calls for the application of Article
(11) of the Jewish Community Bylaws No. 36 of 1931 immediately. Because Article (6) paragraph
(2) of the Community Law discussed in the previous paragraph is limited in application to
special cases where there is a "Head of the Community," not in the case of a vacancy in the position of the Head of the Community. Interpretation
to the contrary is considered erroneous from a legal perspective, requiring that the error not be repeated, neither by the council

Accordingly, it is necessary to apply the mentioned regulation in its entirety and elect a head for the community
immediately.

Then the President moved to the fourth item of the agenda, which is the nomination of a member for the Communal Court to fill the vacancy caused by the resignation of the member
Rabbi Daoud Shaul, in accordance with the provisions of the second paragraph of Article Six of the Law for Organizing Religious Courts and according to the request of the Ministry of Justice received
in its letter numbered Dh / 3 / 3 / 1711 and dated 12 / 7 / 1950. The President announced the start of the election by secret ballot. After
sorting the votes under the supervision of the aforementioned committee, the result was as follows:

the Council ⟦elected⟧ Rabbi Hesqel Isaac to be an alternate member in the aforementioned Communal Court.
Before the conclusion of the session, the member Mr. Ibrahim Hayyim Muallim Nassim spoke on the occasion of the first session of the General Council after the death
of the late Mr. Eliyahu Hayyim Tawfiq, one of the active members of this Council, and recorded his deep regret for the loss the community suffered by his passing,
due to the commendable qualities he possessed, the certain concern for the interests of the community, and the great services he provided in the difficult circumstances
that the community went through since he held the presidency of the Lay Council for nearly thirteen years, and proposed that the Council record its regret and share
the grief and sorrow with the family of the deceased for his loss. Then the meeting was adjourned.
