Summary
What the decision of the esteemed Court of Cassation in its esteemed General Assembly has settled on in this regard
That this court, by its decision dated September 17, 1961, has overturned the appealed judgment and considered that Article 53 of
the Personal Status Law has repealed Article 17 of the Sharia Courts Law, which used to authorize the Sharia Court
to issue a legal certificate of death and inheritance in cases that fall outside its jurisdiction. And since the mentioned article
has repealed the aforementioned article, the appealed judgment is in accordance with the law and in accordance with this principle.
