Rabbi Shlomo ben Shushan of blessed memory told me regarding the matter of happiness -
regarding every person's concern for his property, I heard from the scribes of
Rabbi David Hai Ashkenazi of blessed memory that he wanted to buy the house of Alkhatib
<del>⟦illegible⟧</del> of Ezra Lalo and sent him a messenger
and requested from him to sell him the house he lived in because he heard that
he wanted to sell it, and he sent him an answer that he did not want to sell.
And Rabbi David Hai Ashkenazi of blessed memory sent a messenger a second time
and he answered the same thing.
But His Honorable Excellency (the name) would not turn from his words and sent
to him a third time because perhaps he would sell him the house.
And he sent with the messenger a thousand gold pieces in the hand of the messenger
that he should give them to the seller if he wanted to sell and the money (the seller)
(and he said to him) the seller said to the messenger, to my master, please reach out
your hand and take a little dust from the ground and put it inside the handkerchief
and take it to your Rabbi. And so the messenger did, and filled the handkerchief with dust
and put the gold pieces inside it and brought them to his Rabbi and told him the things.
And when the Rabbi heard these things he was very moved
and said to his friends, see what this man has done,
for he sent me dust to hint to me that the end of man is dust
and what use will the gold pieces and the money be to a man after his death
if not for Torah and commandments and good deeds.
And he said, therefore I no longer desire to buy or to build houses.
And upon mentioning it, God forgot it, and he mentioned that in the book
And what I am writing ⟦for⟧ it to be a memory for Yehuda ben Salem the broker

And after praising God Almighty, may He always guide us to goodness and righteousness
We, the undersigned in this our document, say
That on the day the news of the death of the deceased Aga David reached us
son of Joseph, may his soul rest in Eden
out of good consolation
the arrival of sorrow from every side upon us, especially what reached us
from your high excellence. So the sorrow and grief increased upon us
because of the parting of your dear brother who broke us all
But we have no choice but to submit to the command of God Almighty
And God willing, may He make it the end of sorrow from all sides
And may He not show you any misfortune
And after that, we inform you that on the day the news of the death arrived
of the deceased your brother Aga David Joseph, may his soul rest in Eden, we were all
present in the house of the aforementioned deceased, and the late brother
Aga Isaac David Joseph, may his soul rest in Eden, was present with us and we read
the letter that arrived from your high excellence in the handwriting
of the deceased your brother Aga David Joseph, may his soul rest in Eden, and we understood what
it contains regarding the items listed therein
And at that time we asked the late brother Aga Isaac David Joseph
Do you have knowledge of these items listed in
the letter sent from your high excellence? He answered us
with explicit speech: I have no definite knowledge of this
news, except that one of the days ⟦...⟧ there occurred between me and
your brother words ⟦...⟧ and I replied to him

The day will come, a day of reckoning, and the day of his coming in peace
On that day the Lord will punish the host of heaven on high and
the kings of the earth on the earth. And on that day a great shofar
shall be blown, and those who were lost in the land of Assyria and the outcasts
in the land of Egypt shall come and worship the Lord on the holy mountain in Jerusalem.
For behold, the Lord is coming out of His place, and will come down and tread on the high places of the earth.
The mountains shall melt under Him, and the valleys shall split like wax before
the fire, like water poured down a slope. The nations heard and trembled;
anguish seized the inhabitants of Philistia. Then the chiefs of Edom were dismayed;
trembling seized the leaders of Moab; all the inhabitants of Canaan melted away.
Terror and dread fall upon them; by the greatness of Your arm they are still as stone,
until Your people pass by, O Lord, until the people pass by whom You have purchased. You will bring them in
and plant them on the mountain of Your inheritance, the place, O Lord, which You have made for Your abode,
the sanctuary, O Lord, which Your hands have established. The Lord shall reign forever and ever.
As it is further said: Behold, the days are coming, says the Lord, when I will raise up for David a righteous
Branch, and he shall reign as king and deal wisely, and shall execute justice and righteousness in the land.
In his days Judah shall be saved, and Israel shall dwell securely; and this is the name by which
he will be called: 'The Lord is our righteousness.' In those days and at that time I will cause to grow
for David a Branch of righteousness; and he shall execute justice and righteousness in the land. In those
days Judah shall be saved, and Jerusalem shall dwell securely; and this is what
will be called: 'The Lord is our righteousness.' For thus says the Lord: David shall never lack
a man to sit on the throne of the house of Israel; nor shall the priests,
the Levites, lack a man before Me to offer burnt offerings, to burn grain offerings, and to offer
sacrifices forever. Thus says the Lord: If you can break My covenant
with the day and My covenant with the night, so that day and night will not come
at their appointed time, then also My covenant with David My servant may be broken, so that he shall not have a son
to reign on his throne, and with the Levites, the priests, My ministers. As the host
of heaven cannot be numbered, nor the sand of the sea measured, so I will multiply the
descendants of David My servant and the Levites who minister to Me.
The law of this death is as stated in the Gemara in [the chapter] 'These
are those who are strangled' and in the chapter 'The trial is finished' we learn it from the verse
as it is written: 'The striker shall surely be put to death, he is a murderer' etc.
And if you say, from where do we know it is by the sword? Say it is by strangulation.
The Gemara has learned it as a tradition, and if you want, say it is a logical deduction:
Since it is said of a murderer 'shall surely be put to death' and it is said
of one who strikes his father or mother 'shall surely be put to death'; just as there it is by strangulation,
so too here it is by strangulation. But perhaps: just as there it is by stoning, so too here
is by stoning? As it is said here 'shall surely be put to death' and it is said of a medium
or an oracle 'shall surely be put to death'; just as there it is by stoning, so too here
is by stoning. We derive 'shall surely be put to death' [singular] from 'shall surely be put to death' [singular] and we do not derive
'shall surely be put to death' from 'shall surely be put to deaths' [plural]. On the contrary, we derive 'shall surely be put to death'
which does not involve desecration of the Sabbath from 'shall surely be put to death' which does not involve desecration
of the Sabbath, to exclude a medium and an oracle which involve desecration of the Sabbath.
This works well for the one who says [strangulation is] burning of the soul while the body remains,
but for the one who says it is burning of the body, what can be said?
He holds like the one who says strangulation is [more] severe.
And the Rabbis, what do they do with this 'shall surely be put to death' of a murderer?
They apply it to the four deaths handed over to the court,
and we do not know which of them it is, so we learn it by a verbal analogy [gezeirah shavah]:
It is said here 'shall surely be put to death' and it is said regarding a subverted city
'You shall surely strike the inhabitants of that city by the edge of the sword';
just as there it is by the sword, so too here it is by the sword. But say
it is by stoning? It is said here 'shall surely be put to death' and it is said of a medium
or an oracle 'shall surely be put to death'; just as there it is by stoning, so too here
is by stoning. We derive 'shall surely be put to death' which cannot be replaced
with money from 'shall surely be put to death' which cannot be replaced with money,
to exclude a medium and an oracle which can be replaced with money.
Today, the fifteenth day of the month of Elul, the year 5683
I, the servant of God, David Eliyahu Yosef Yitzchak HaLevi, have written
and given into the hand of my friend David Yehezkel Yosef Ezra Yitzchak
Moshe Samra, this document, which is valid against me and against my heirs
after me, firm and established, not like a conditional document and not like a template
of documents, but rather with the gravity and strength of all documents customary
in Israel that are required for evidence and for entitlement through them, from this
day and forever; and a symbolic acquisition was made from me, the aforementioned David, with an
instrument fit to acquire with, from now, not like a conditional document
and not like a template of documents, with the annulment of all notifications and notifications
of notifications, and the disqualification of witnesses signed upon them according to the regulation
of our Sages of blessed memory that was prior to this day; and thus said to us the aforementioned
David: Be valid witnesses for me and acquire from me and deliver
into the hand of my aforementioned friend David this document to be in his hand for entitlement
and for evidence, and this is its essence: <del>I hereby admit and confess, I</del>
<del>the undersigned, that there remained with me in the partnership account</del>
managed by Chacham Yehezkel Yosef Ezra, a sum of a Lira
and a half, and one and a quarter Mejidie, and half of the Mejidie
that remained for me in his hand from the proceeds of the house he sold to me,
a sum of three Lira and a half and a quarter and half of the Mejidie,
it is found that the total sum is five Ottoman Gold Lira
and a half and a quarter and half of the Mejidie; and the aforementioned sum, I am
obligated to pay it into the hand of the aforementioned Chacham Yehezkel for the period of
ten days from today, and I have no claim against him
or suit at all, neither on the partnership account nor
on the proceeds of the aforementioned house, and understand this well, and everything is firm and established
and true and certain and correct and enduring.
The words of the young one,
David Eliyahu Yosef Yitzchak HaLevi, may his end be good.

All these words spoil the good character of people
and all these matters regarding those who go to the cinema more than other
speech and what resembles that, and it is known that everything that exceeds
its limit turns into its opposite, and he who goes to the cinema
often will have a disease of speech, and he who never goes at all
will be unaware of his world and of the universe, and the eye will be
blinded, as King Solomon, peace be upon him, said: 'The wise man’s eyes are in his head,
but the fool walks in darkness.' And therefore, as I told you, a person
must be moderate; he should not go too much nor cut it off entirely.
As for the words that come out of a person's mouth, they
are evidence of his intellect. If the words are good and beloved,
people will love him and say of him: 'This is a sane and understanding man.'
If leaders and peaceful people have a status, it is because their speech
is beautiful and contains nothing bad, and their speech is like pearls and its meanings
are gold. So when a person speaks, he should go and think about the words
before they come out of his mouth, because words are like bullets;
once they leave the pistol, they do not return. Such are words;
once they leave a person's mouth, they do not return. For this reason,
a person must be deliberate in his speech and not hurry
in responding, because haste is from the devil and deliberation is from
the Merciful, as the proverb says: 'The hasty one is prone to error.'

Praise be to God who has guided us to this, and we would not have been guided had
God not guided us. The messengers of our Lord came with the truth, and peace be upon
the messengers, and praise be to God, Lord of the worlds. This prayer is for
discharging debt, and it is recited on Sunday night because Saturday is the day
of rest <del>Saturday</del> and God Almighty has mentioned in His Mighty Book:
God does not like the public utterance of evil ⟦speech⟧ except by one who has been wronged.
<del>The debt</del> And God Almighty said in His Mighty Book in Surah Al-Baqarah:
And when My servants ask you about Me, indeed I am near. I respond to the invocation of the caller
when he calls upon Me. So let them respond to Me and believe in Me that they may be guided.
And God Almighty said in Surah Al-Mu'min: And your Lord says, "Call upon Me;
I will respond to you." Indeed, those who disdain My worship will enter
Hell rendered contemptible. This prayer is recited on Sunday night,
and some of the righteous predecessors used to perform this prayer
every Sunday night, and it consists of four rak'ahs. One recites in every
rak'ah the Opening of the Book once and Surah Al-Ikhlas
ten times. When he finishes his prayer, he says this supplication
seventy times, and it is this:
I seek forgiveness from God the Great, besides whom there is no god but He, the Living, the Sustainer,
and I repent to Him and ask Him for repentance, forgiveness, and guidance for all
that He loves and is pleased with of speech, action, intention, and righteous
deeds that are pleasing to Him. It has been mentioned in some of the Holy
Books that whoever persists in this prayer every Sunday night,
God will forgive his sins, those of his parents, and all believing men
and believing women. This prayer is completed.

And they agreed together that the shop they open shall be a partnership
between them from the 10th of Elul, the year 5665. And the capital
of David in this partnership, from cash and goods as detailed in
the ledger in their hands, was two hundred Ottoman Liras and no more.
And the capital of Ezekiel from cash and goods as detailed
in the ledger in their hands was one hundred and fifty Ottoman Liras
and no more. So the total capital of the partnership is three hundred and fifty
Ottoman Liras. And they stipulated between them that the rent of the shop
and what occurs from it in taxes and other things shall be from
the joint funds, and the profits of the shop shall be halved between
the two parties equally, neither more nor less. And we have acquired from
the aforementioned parties, from the aforementioned David and the aforementioned Ezekiel,
regarding what is mentioned above, a complete acquisition from now, not as a mere promise and not
as a form of document, with the cancellation of all notifications and notifications of notifications according to the regulation of our Sages of blessed memory.

and everything is valid and established.

Remainder of the virtues of prayer etc. and among the specificities of the group prayer
is that the Imam, when he prays with a group of people of knowledge
and piety; and if such is not found, then the one who reads the most among them * and if they are equal, then the eldest among them
unless he has a physical defect, or is a slave, or is uncircumcised, for it is not permissible to put him forward.
And they recommended that his voice be loud so people can hear, and that he reads
with Tajweed (correct pronunciation), and that he be a person of wealth and virtue, and from the old
families.
And it is disliked for the Imam to be a profligate, an ignorant person, or a Bedouin for urban dwellers, or a convert
for a state, or a child of adultery, or one known for mockery, or the
servant in the mosque, or one who takes the mihrab without legal right, or the
one hated by a group or most of them, or one performing a voluntary prayer for those performing an obligatory one in the time,
and the one who makes grammatical errors in the recitation in a letter that changes the meaning. As for the error
that does not change the meaning, it is disliked. If he intentionally makes an error that changes
the meaning, his prayer and the prayer of those following him are void. And if he forgets,
he performs the prostration of forgetfulness. Likewise, if he makes an error in the Takbir, his prayer is void.
And the most deserving of the Imamate is the father with his son, the grandfather with his grandson,
the righteous with the wicked, the resident with the traveler, the adult with
the child, the free man with the slave, and the one performing obligatory with the one performing voluntary, and the
blind and the mute with the sighted and the speaking. And the one performing voluntary with
the one performing voluntary, and the one performing obligatory with the one performing obligatory is permissible, even if the
intentions and the prayer differ, such as one who prays Asr behind one who prays Dhuhr,
or prays a missed prayer behind one who prays on time, or prays voluntary behind one who prays
obligatory; all of this is permissible. The follower intends whatever obligation he owes
and prays with him.
And likewise, it is permissible for one who prays Maghrib to follow one who prays Isha,
and when the Imam stands for the fourth rak'ah, the follower sits, recites the Tashahhud, and performs the Taslim.
Likewise, one who prays Isha behind one who prays Maghrib: when the Imam performs Taslim,
the follower stands and completes his prayer alone.

And what happens to them of harm in many ways is mentioned
in places other than this.
And we have mentioned in some of our books the compositions
of what occurs to them regarding that, and Sheikh Abu Zakariya
bin Adi mentioned that and explained it, and he also mentioned that the harm occurs
when the planet Jupiter is falling from the ascendant at
the time of the deposition of the seed in the womb or at the time of its birth,
for that indicates the corruption of the intellect and the badness of
discernment, lack of understanding, stupidity, and idiocy, and loss.
And that may also be due to afflictions that occur to the brain
at the beginning of creation, as Galen mentioned in the book On the Usefulness
of the Parts, in the ninth treatise of it.
And Abu Bakr al-Razi said in the book al-Mansuri in the third
treatise of it that the swelling of the brain and its blockages cause that.
His words regarding what we mentioned of the matter of fools and the insane; as for
the simpletons, they are those who do not manage well and are not guided to
what is for their benefit, and they do not know what harms them and what profits them
from the perspective of intellect and discernment, but they have imagination and memory.
And all of that may be by nature from the origin of the constitution, and likewise
the case for fools and the insane.
