Guardianship and the Endower's Conditions
The late Ezra Menahem Daniel endowed the house described above, which is informally divided into two houses, according to the following conditions.
First
The aforementioned endower has endowed this house as an endowment for the soul of his late mother, Rifka daughter of Abdullah Shlomo, provided that it be used as a dispensary for the medication and treatment of the sick among the poor of the Mosaic community, and that this dispensary be named - Rifka Menahem Salih Daniel Dispensary - and the guardian has the right to use the entire endowed property as a dispensary or a part of it, and the revenue obtained from it, he may lease it and spend the revenue obtained from it on the following:
A - On taxes, maintenance, and necessary reconstruction for the endowment.
B - On the medication and treatment of patients who visit that dispensary, and in the absence of poor visitors to the said dispensary, it shall be spent on poor Israeli patients in Baghdad.
Second
In addition to that, the aforementioned endower has endowed and delivered into the hands of the guardian of this endowment an amount of three thousand dinars to be spent on building the endowed dispensary and preparing it to be suitable for the mentioned purpose, as detailed in the same mentioned endowment deed.
Third
The guardianship is assigned to the Lay Council of the Israeli community in Baghdad, and in the absence of such a council at any time, the guardianship shall then transfer to the authority that takes its place. The guardian must entrust the management and operation of this dispensary to the person or body that manages the Meir Elias Hospital.
Note
This endowed house originally belonged to the late Menahem Salih Daniel and is registered in his name, and it passed by inheritance to his son, the late Ezra. However, until now, the transfer transaction has not been carried out in the name of his son Ezra, who endowed it, and it has not been registered in the Land Registry (Tapu) as an endowment. We would like to inform you that the construction of the Rifka Menachem Salih Daniel Dispensary has been completed, and we submit herewith:
A - A table containing the income and expenditure account of the mentioned endowment prepared by the Lay Council's accountant.
B - A table showing the construction costs of the dispensary, totaling 5206.247 Dinars.
It appears from these two tables that there is a deficit of 1090.756 Dinars that must be paid according to the attached Table (C).
The construction took place under the supervision of the subcommittee of the Hospitals Committee. The mentioned committee did its best to avoid this deficit, but it found it necessary to spend these amounts to fulfill the goal intended by its construction, taking into account the latest health and urban systems, knowing that the mentioned deficit resulted from the reconstruction of the old part of the building and the adoption of the piling method in the foundations, whereas the subcommittee had not taken into account the costs of these two works at the start of construction.
The subcommittee, during the construction period, carried out its work with the knowledge of His Excellency the benefactor Senator Mr. Ezra Menachem Daniel.
Therefore, we kindly ask you to mediate with His Excellency and present the matter to him in order to request his consideration of the possibility of covering this deficit, as the budget of the Lay Council or the budget of the Hospitals Committee cannot bear this deficit at the present time, and we believe that His Excellency will agree to add this charity to his numerous charities.

His Excellency,
Distinguished Gentlemen,
On behalf of the Hospitals Committee of the Jewish Community in Baghdad, I have the honor to welcome you, thanking
your kindness in attending this ceremony which we are holding today to inaugurate a humanitarian institute and a
house of charity and benevolence in this dear homeland, namely the Rivka Menahem Salih Daniel Dispensary, which
was built, renovated, and dedicated as an endowment to serve the poor among the sick and a clinic for the needy ⟦upright ones⟧ in this country
by His Excellency the great philanthropist and humanitarian, the respected Senator Mr. Ezra Menahem Daniel, in memory of
his late mother of blessed and good memory, Rivka, may God encompass her ⟦with his vast⟧ vast mercy.
Gentlemen,
The most important concern of the Hospitals Committee in Baghdad for a long time has been to make available to
members of the poor class an outpatient clinic close to their neighborhoods and places of residence, to which they could refer to its doctor whenever
illness befell them, whenever they needed medical consultation, and whenever they lacked medicine to alleviate the pains of sickness.
Gentlemen,
The first outpatient clinic in Baghdad was established in 1882 thanks to the efforts exerted at that time by
the Society of the Founders of Dar al-Shifa. This society established a dispensary in the house opposite the Albert
Sassoon School (Alliance), and attached to it in the same building the Dar al-Shifa pharmacy. It appointed a doctor for it, to whom
the poor referred for consultation and to receive treatment free of charge, just as he used to visit the sick in their homes when necessary
without compensation.
All this took place at a time when Meir Elias Hospital had not yet been established, and at a time when members of
the poor class rarely understood the meaning of medical care; indeed, health organizations in Baghdad in general were
only in a primitive state or almost non-existent at all. Therefore, the services provided by that dispensary
and its attached pharmacy were magnificent and priceless.
The effect of the services provided by that health institute to suffering humanity was that
it became an incentive for those with sensitive hearts, which prompted the great philanthropist, the late Meir Elias, to
establish the hospital known by his name in 1908. Thus, the responsibilities of the Society of the Founders of Dar al-Shifa expanded,
and it was not long before the dispensary and its pharmacy were attached to the administration of the aforementioned hospital.
But the building occupied by the dispensary soon began to be affected by the passage of time after
it became old, and the dispensary and pharmacy became without a shelter worthy of a health institute fulfilling all the necessary
required conditions.
Finally, the society approached His Excellency our great philanthropist, Senator Ezra Menahem Daniel, and his renowned zeal drove him
to sponsor every educational or health institute dedicated to serving members of the poor class. He stepped forward to aid
the Hospitals Committee with his well-known keenness to continue the legacy of his noble family in extending <del>white</del> white hands
to charitable institutions of various purposes and differing goals. It was not long before His Excellency presented to our committee
this house belonging to his noble family and his birthplace to be an endowment for the administration of Jewish hospitals
in Baghdad. Then his zeal and enthusiasm for humanitarian projects drove him to renovate this house and establish this

The dispensary, with its health and medical facilities, has thus succeeded in filling the gap that our committee used to complain about regarding
the lack of a permanent headquarters for its outpatient clinic. Thanks to this benevolence, we have been able to expand the purposes of this dispensary,
as it now contains two sections: one for internal diseases and the second for surgical diseases, along with a minor operations room
and two dressing rooms for men and women separately, in addition to the pharmacy.
When necessary, patients are referred to a specialist doctor and the institute for pathological analysis and X-rays at the
Mir Elias Hospital or the Royal Hospital. Thus, with God's help, the desired goal of having such a health institute
in the heart of the poor neighborhoods of the capital has been achieved. The health service provided by this dispensary has become so important that
the number of its visitors from the poor class has reached 200 - 250 daily throughout the seasons of the year.
In this regard, we can only extend our sincere thanks to the health departments attached to the Ministry of Social
Affairs for the encouragement and aid that this committee received from them, and what His Excellency the Minister of Social
Affairs, Mr. Tawfiq Wahbi, bestowed by including this ceremony under his patronage, as well as the kindness of His Excellency the Deputy Director of General Health
by honoring this ceremony with their presence, which is but a shining proof of the interest of our health authorities and their care for such institutes
that cooperate with them as much as possible to combat disease in the capital and facilitate medical consultation for members of the
poor class.
Gentlemen,
Nothing is closer to the pleasure of God Almighty than for a person to feel the need of his fellow human being and rise
to his aid and relieve his need in cases of ailment and illness. This institute, established by His Excellency the generous benefactor, Senator Ezra
Menahem Daniel, is worthy of remaining through the generations as a living, speaking monument to the virtue of the righteous man of humanity and his sympathy for
the afflicted, and an incentive for everyone who carries in his heart a feeling of sympathy and benevolence to follow his example and make his deeds a beacon
and a good model. And God Almighty does not waste the reward of those who do good.
In conclusion, I pray to God Almighty to guard with His watchful eye His Majesty our Master and King Faisal II the Great
and His Royal Highness Prince Abdul Ilah, the Regent and Great Crown Prince, and to support with His victory and success our esteemed government
for the good of the nation and the homeland. Peace be upon you.

Endower ⟦line⟧ Ezra Menachem Daniel.
On this day, Ezra Menachem Daniel appeared, and after being identified by the identification witnesses Meir Hakham Moshe Doctor and Ezra Meir Baruch, he stated the following:-
I, of my own free will and choice, and in full mental capacity and maturity, have agreed to remove the house located in the Torah neighborhood in Baghdad, which is unofficially partitioned into two houses and numbered with door numbers 73 / 139 and 39 / 94 according to the Tabu deed dated June 323 and sequence 312, registered in the name of my late father Menachem Salih Daniel and transferred to me by inheritance according to the two inheritance distributions issued by the Judge of Personal Matters under No. 136 / 4 Sh dated 11 / 12 / 40 and 34 / 4 Sh dated 29 / 3 / 43, from my private property, and I have endowed it as a valid and perpetual endowment for the rest of the soul of my late mother Rifka daughter of Abdullah Shlomo, provided that it be used as a dispensary for the medication and treatment of the sick among the poor of the Mosaic community, and that this dispensary be named after my late mother Rifka Menachem Salih Daniel. The trustee of this endowment shall have full rights and absolute discretion in what he deems appropriate regarding the use of the entire endowed property as a dispensary or a part of it, and any surplus obtained may be leased, and the revenue obtained therefrom shall be spent first on paying taxes, maintenance, and necessary construction for the endowed property, and secondly on the medication and treatment of the patients who visit that dispensary. In the absence of poor visitors to the aforementioned dispensary, it shall be spent on poor Israeli patients in Baghdad.
Furthermore, I have endowed, restricted, and delivered into the hands of the trustee of this endowment a sum of money amounting to three thousand dinars, of which two thousand five hundred dinars are for spending on the construction of the dispensary <del>⟦illegible⟧</del> endowed by this endowment deed, and furnishing it and preparing it to be fit for the aforementioned purpose at the earliest time the trustee deems appropriate and until the commencement of construction. The trustee may invest the aforementioned amount by purchasing government loan bonds or similar guaranteed methods, and the interest obtained from those funds shall be added to the endowed amount and used for the same purpose of construction. As for the remaining five hundred dinars, they shall be spent on the necessary maintenance of the endowed property from time to time until the commencement of the construction of the dispensary required by its endowment.
I have assigned the trusteeship of this endowment to the Lay Council of the Israeli Community in Baghdad, and in the absence of such a council at any time, the trusteeship shall then transfer to the authority that takes its place.
The trustee must entrust the management and operation of this dispensary, ⟦including⟧ the spending of the endowed amount for the purposes for which it was endowed, to the person or body that manages the Meir Elias Hospital within the limits he sets for it. The person named Eliyahu Hayyim Tawfiq, the current president of the Israeli Lay Council in Baghdad at the present time, appeared <del>⟦illegible⟧</del> according to the presented certificate stating that he is the president of the Israeli Lay Council in Baghdad at the present time, issued by the Presidency of the Israeli Community on 26 / 4 / 944. After being identified by the two identification witnesses mentioned above, he stated: I have received in full and complete the endowed amount of three thousand dinars from the endower, the aforementioned Mr. Ezra Menachem Daniel, and I pledge to preserve it and spend it according to the conditions set forth in the endowment deed listed above.
Based on the above, they requested the issuance of a deed for the aforementioned endowment.
The Decision ⟦line⟧ In view of the above, the endowment has been completed and become binding, and it is ruled upon according to the conditions listed above. It has become a valid and legal endowment. This was written as requested on 30 / 4 / 944 AD.
