Ezra Menachem Daniel appeared after being identified by the identification witnesses, lawyer Salman Shina and Victor Daoud.
He stated, while in his full mental capacity, maturity, obedience, and choice, as follows =
I have agreed to remove the four plots, which are the properties belonging to me, numbered Land Registry 97, 98/13, 19/16,
and 20/16, located in the Battaween district of Baghdad, from my private ownership and to dedicate them as a valid, final, and perpetual endowment (waqf),
and to attach them to the properties endowed according to the decree issued by the Personal Matters Court in Baghdad under number 134/44
dated 10 / 9 / 1944, under the same endowment conditions included in the aforementioned decree and with all amendments and rulings that have been issued
and may be issued from time to time regarding the aforementioned endowment deed during my lifetime, provided that they be an integral part of that endowment and that
all its rulings and conditions apply to them without restriction or condition and without exception. I have assigned the trusteeship over them under the same conditions, rulings, and manner stipulated
in the endowment deed discussed for myself as long as I am alive, and that it shall pass after me automatically to
the Spiritual Council of the Jewish Community in Baghdad or whoever legally represents it in the event that no trustee or trustees are appointed over
the aforementioned endowments during my lifetime, provided that I retain the right to enjoy the same powers granted to me in the ninth and tenth clauses
of the endowment deed referred to above.
Accordingly, he requested the issuance of the aforementioned endowment deed. Therefore, based on the above, the validity of the aforementioned endowment has been ruled in accordance with the conditions

The Court of Cassation of Iraq was formed on 11/7/1956 in its general assembly composed under the presidency of His Excellency the President Mr. Hassan
Sami al-Tatar and the members, Messrs. Ali Mahmoud al-Sheikh Ali, Mahmoud Khalid, Abdul Jalil Barto, Muhammad Midhat Suleiman,
Muhammad Shafiq al-Ani, and Nuri al-Mawsili, authorized to adjudicate in the name of His Majesty the King of Iraq, and issued the following decision:
Appellant / Petitioner for correction / Emil Saleh Shlomo, in his capacity as trustee over the endowments (Awqaf) of Menahem and Sasson Daniel, in addition to his post.
Appellee / Respondent for correction / 1- Director of Baghdad Region Endowments, in addition to his post.
2- The Third Party - Head of the Administrative Committee of the Jewish Community in Baghdad,
in addition to his post.
Emil Saleh Shlomo, the trustee over the endowments of Menahem and Sasson Daniel, claimed before the Personal Status Court in Baghdad that
the following legal arguments (Hujjas) and Sharia notifications had previously been issued:
1) The Hujja issued by the Baghdad Court on 9 Shawwal 1336 under number (181) and registered at the Baghdad Endowments Department
on 29/Tishrin/1919.
2) The Sharia Hujja issued by the Baghdad Sharia Court on 8 Shawwal 1336 under number (179) and registered at the Endowments Department
of Baghdad on 24/March/1919.
3) The Hujja issued by the Baghdad Sharia Court on 14/Dhu al-Qi'dah/1343 under number (151).
4) The Hujja issued by the Baghdad Sharia Court on 28/Rabi' al-Thani/1347 under number (211).
5) The Hujja issued by the Baghdad Sharia Court on 14/Dhu al-Qi'dah/1343 under number (157).
6) The notification issued by the Baghdad Court on 3/7/1929 under number (8) in notification 156.
And that these Hujjas include the endowment of the properties they covered, provided that their revenue is spent on what was established for them. Then
the two endowers and the two trustees of their endowments applied to the Personal Status Court requesting the amendment of the endowment conditions. So the mentioned court issued
the Sharia Hujja numbered 25/87 dated 17/8/25, in which it was mentioned that it came to remove the ambiguity and vagueness mentioned
in the endowment deed and because that does not touch the essence of the endowment and its basic conditions. Whereas the mentioned Hujja included basic
conditions touching the essence of the endowment, and since the endowers did not stipulate in the endowment deed the right to change and substitute, and since the trustees do not have
the right to amend its conditions, therefore the judge may not violate the endower's conditions unless there is a suspension of the endowment in the conditions or a loss of interest
for the beneficiaries. Accordingly, the mentioned Sharia Hujja was issued contrary to Sharia. The plaintiff requested in his capacity as trustee
over Baghdad endowments, in addition to his post, as he is the addressed adversary, to rule for the annulment of the mentioned Sharia Hujja numbered
25/87 regarding the additional conditions not stipulated in the original endowment deeds and to charge him the expenses.
During the proceedings, the Head of the Administrative Committee of the Jewish Community in Baghdad and the deputy for the Lay Council
of the community entered as a third party in the lawsuit. Because the ruling to be issued touches the interest of the community and its conduct, and it issued on 10/7/1955
under number 102/955 a presence-based ruling providing for the amendment of the Sharia Hujja subject of the lawsuit according to what follows:

1) Cancellation of paragraph (c) of the second clause regarding the spending of endowment revenues on the teaching of sciences and arts.
2) Cancellation of paragraph (d) of the second clause regarding the reserve amount, which begins with the phrase (If a surplus of endowment revenues appears .....) and ends with the phrase (..... in relation to preparing the annual budget for the school administration and under the same conditions specific to it).
3) Cancellation of paragraph (e) of the second clause regarding the opening of a branch or branches in the (⟦Lalbeer⟧ Kadoorie) school, which begins with the phrase (And if a surplus of endowment revenues is obtained after paying all these expenses .....) and ends with the phrase (..... and on feeding and clothing them if the need arises).
Accordingly, the second clause regarding the spending of the endowment shall consist of paragraphs (a and b) only, and paragraphs (c, d, and e) are considered as if they do not exist in the deed. The court also decided not to interfere with everything contained in this deed except for the aforementioned paragraphs, rejected the plaintiff's lawsuit regarding them, and charged both parties the costs.
The head of the Jewish community appealed this third decision - as did the plaintiff - and the two appeals were consolidated. The Court of Cassation of Iraq decided on 10/13/55 under No. 4741 / Personal / 55 to overturn the appealed decision regarding (the paragraph pertaining to the cancellation of the order to maintain reserve amounts in the manner decided by the Lay Council) and to uphold the appealed decision regarding the other paragraphs. Upon the return of the papers and the hearing, the Court of Personal Matters decided on 12/5/1955 to follow the decision of the Court of Cassation and to cancel paragraphs (c and e) from the Sharia deed subject of the lawsuit only and to charge both parties the costs.
The plaintiff appealed the mentioned decision, and it was upheld in cassation on 4/8/1956 under No. 6 / Personal / 56. Due to the dissatisfaction of the appellant - the plaintiff - with the aforementioned cassation decision, he requested its correction and paid the legal securities on 6/17/1956.
Decision / Upon examination and deliberation by the General Assembly, it appeared that the request for correction was not based on any of the grounds for correction mentioned in the amended Article Four of the Law of Civil Procedure, and because what the applicant stated in the memorandum had been previously mentioned in the cassation memorandum and was rejected by the Court of Cassation during its examinations. Therefore, it was decided to reject the request and record the securities as revenue for the treasury. The decision was issued unanimously on 7/11/1956.

The reason for writing this paper is that
we, the undersigned, Abd al-Latif and Abd al-Hamid, sons of Muhammad Nasr, acknowledge that the orchard located in the Al-Sinak district
numbered 212, which is shared between us and Hasil Effendi Daniel, we have hereby sold our entitlement that we have in
the Land Registry to the aforementioned Hasil Effendi Daniel, and we have received the price from the hand of his agent, Salih Effendi Shlomo, and we no longer have any claim
to anything against the aforementioned, neither regarding the price nor regarding the rent for the entire past period, i.e., from the date of his purchase of the aforementioned orchard,
since all the constructions built on the aforementioned orchard intended for exploitation, the cost of their construction was paid
entirely from the private funds of the aforementioned Hasil Effendi, and for this reason we are not entitled to any of the rent that was collected for the past period.
As for the rent for our entitlement from the grounds on which the building is constructed and from the fruit of the orchard, it has reached us in full and complete as part of
the price of selling our shares to the aforementioned, and we have cleared the liability of the aforementioned Hasil Effendi from all claims related to rent in
